Midstream critical material processors are essential to America’s manufacturing and energy future:

“Critical minerals are not only vital to America’s energy supply, but to our national security as they are a key component for defense technologies and weaponry. I am proud to introduce this bill alongside Congressman Guthrie and Newhouse to establish a national roadmap to bring the development and processing of key minerals back to the USA. Securing America’s energy independence starts with securing our critical minerals supply chain,” said Congressman Fulcher.

“Today I was proud to introduce the Securing America’s Midstream Critical Materials Processing Act alongside Congressmen Newhouse and Fulcher to help ensure America has control over its manufacturing and energy future. For too long our nation has been reliant on the CCP and other foreign adversaries for the essential facilities to process critical materials into usable resources for our manufacturing industry. This bill will help provide a pathway to reshoring the processing of critical materials and uncovers the extent to which the CCP has exploited this supply chain. If our nation is to become energy independent once again, secure our supply chains, and reshore job creating industries then we must produce and process our critical materials here at home, I am proud to be leading this bill that will help accomplish this,” said Congressman Guthrie.

“It is no secret the United States is in a dangerous position with our reliance on adversaries like the CCP for the critical minerals we use in everything from our energy sector to our defense industrial base. Millions of Americans are looking for financial relief as the rising costs of everyday goods have soared 20 percent since President Biden assumed office. These vehicles consume roughly seven times as much electricity on a single charge as a typical home does in a day and charging centers can require as much power from the electrical grid as a small city. Infrastructure aside, electric trucks cost roughly twice as much as diesel trucks, and these vehicles are not able to haul nearly as much. I am proud to lead this effort alongside my colleagues to stop the EPA from enforcing these irrelevant rules to meet Biden’s Green New Deal agenda.”

“These regulations are not only disastrous for our economy, but Alaskans know well that EV technology just doesn’t work in rural states—especially those with extreme cold temperatures and communities separated by thousands of miles where reliable transportation is a matter of life and death,” Sullivan said. “Make no mistake, this thinly-disguised attempt to get rid of the internal-combustion engine without congressional authority will only hurt hard-working families across the country, worsen the supply chain crisis, and deepen our reliance on Chinese Communist Party-controlled critical minerals. We’re urging every one of our colleagues to put the interests of American families above the demands of the radical environmentalists, and support our CRA resolutions overturning these ludicrous rules to ensure Americans and Alaskans continue to have access to the vehicles of their choice that actually work.”

“President Biden’s EV mandate is delusional,” Ricketts said. “This rule will make it harder for low-income families to buy a car or rural families to get to their jobs. I promised Nebraskans I’d use every tool I have to fight this. Our bipartisan legislation will keep costs down, defend consumer choice, and protect us against becoming more dependent on the CCP.”

“Michigan is not afraid of the future, but we demand to be a part of it,” James said. “The Biden administration’s EPA tailpipe emission rule is another out-of-touch regulation that will crater the Michigan auto industry and decimate our middle-class and most vulnerable. Folks in my district simply can’t afford to spend an additional $12,000 on an expensive, unreliable EV. I’ve always said, if you want an EV, get an EV. But allowing the Biden administration to continue stifling consumer choice will only harm the American people. This is a de-facto electric vehicle mandate that will put all 77,580 manufacturing jobs in MI-10 at great risk of extinction. I am proud to lead this effort to prevent Biden’s rule from ravaging the livelihoods of thousands in Michigan and across the country.”

BACKGROUND

Light and Medium Duty Vehicles Rule: On Wednesday, April 12, 2023, EPA announced the “Multi-Pollutant Emissions Standards for Model Years 2027 and Later Light-Duty and Medium Duty Vehicles,” a proposed rule to reduce emissions from light-duty and medium-duty vehicles starting with model year (MY) 2027 through MY2032. In this rule, EPA is proposing multipollutant emissions standards for light-duty passenger cars and light trucks and Class 2b and 3 vehicles (“medium-duty vehicles”). EPA estimates that due to this proposal electric vehicles (EVs) will make up two-thirds of new vehicles by MY2032, a whopping 67 percent of overall vehicle production. In 2022, EVs accounted for a mere 5.8 percent of new cars sold in the US. The administration unveiled its finalized light and medium-duty vehicles rule on March 20, 2024. The members will be leading Congressional Review Act (CRA) efforts in both the Senate and House of Representatives to overturn the light- and medium-duty standards announced last week and the heavy-duty standards announced today.

“Biden’s EV mandates are delusional. American consumers and workers will pay the price for his Administration’s attempt to get rid of internal-combustion engines,” the members said. “His EV mandate for heavy trucks will make everything more expensive as it wreaks havoc on our nation’s supply chain and makes us more reliant on China.

“The Biden administration has no plans for how to achieve the power generation, infrastructure, and critical minerals needed to make their EV mandate work,” the members continued. “They’re going to make car graveyards a reality across America by forcing the country to rely on current EV technology that doesn’t hold up for extreme cold, isolated communities, or long-distance drivers. We will be introducing Congressional Review Act legislation in both the House and Senate to make sure Biden’s EV mandates never become reality.”

Senators Ricketts and Representative James will be introducing the CRA for the light- and medium-duty vehicles rule. Congressman Fulcher and Senator Sullivan will be introducing the CRA for the heavy-duty vehicles rule. The CRAs will be introduced once both rules are submitted to Congress. Sullivan and Ricketts are both members of the Senate Committee on Environment and Public Works. James and Fulcher are both members of the House Committee on Energy and Commerce.

BACKGROUND

Title II of the Clean Air Act (CAA) addresses mobile (transportation-based) sources of air pollution emissions via the tailpipe by seeking to reduce pollutants from both on-road and nonroad vehicles (vehicle emission standards), as well as transportation (gasoline & diesel) fuel. Within Title II, CAA section 202 provides the Environmental Protection Agency (EPA) with the authority to set emission standards for new motor vehicles.

Beginning in 2010, EPA began to interpret CAA section 202 as providing the Agency authority to regulate greenhouse gas (GHGs) emissions from cars and trucks. Between 2010 and the end of 2022, EPA promulgated three rounds of GHG standards for light-duty vehicles covering model years 2012-2026, and two rounds of GHG standards for medium- and heavy-duty trucks covering model years 2014-2027.

See Ricketts and Sullivan’s joint statement on the announcement here.

Heavy Duty Vehicles Rule: On Wednesday, April 12, 2023, EPA announced the “Greenhouse Gas Standards for Heavy-Duty Vehicles – Phase 3” which would apply to heavy-duty vocational vehicles such as delivery trucks, refuse haulers, dump trucks, public utility trucks, transit, shuttle, school buses, and trucks typically used to haul freight. These standards build on the Heavy-Duty NOx standards for MY 2027 and beyond, which EPA finalized in December 2022, representing the third phase of EPA’s Clean Trucks Plan. The administration unveiled its finalized heavy-duty vehicles rule Friday.

###", 1, "2026-03-30T01:40:41Z", "2026-04-07T20:47:55Z"], ["https://fulcher.house.gov/2024/03/27/id-1f626af0-bc8e-4314-9aea-aa4b4ab6210c/", "Congressman Fulcher and Kilmer Introduces Legislation to End Blood Quantum Rule for Native Americans", "2024-03-27", "2024", "2024-03", "Republican", "House", "ID", "Russ Fulcher", "F000469", "fulcher.house.gov", "fulcher", "https://fulcher.house.gov/category/press-releases/", "scraper", "FOR IMMEDIATE RELEASE: Wednesday, March 27

CONTACT: Marisa Melton, (208) 743 – 1388, marisa.melton@mail.house.gov

Congressman Fulcher and Kilmer Introduces Legislation to End Blood Quantum Rule for Native Americans

WASHINGTON D.C. – U.S. Congressman Russ Fulcher (ID-01) and Derek Kilmer (WA-06) introduced the Tribal Border Crossing Parity Act. This legislation will redouble America’s efforts to end a half-century-old U.S. immigration policy that requires Native Americans to carry proof of their blood quantum, documents proving they’re at least 50 percent Native American when exercising their treaty-protected right to cross between the U.S. and Canada freely.

Currently, the Department of the Interior issues certificates to prove an individual’s Native American or Alaskan Native heritage. This can be challenging for many eligible individuals who may lack access to necessary records. The blood quantum requirement also infringes on the sovereignty of federally recognized Tribes to determine their own membership.

The Tribal Border Crossing Parity Act would simplify this process for border crossing by eliminating the blood quantum requirement. Ultimately, the bill would allow Tribal members to use their Tribe-issued IDs as proof of membership in a federally recognized Tribe to cross the border.

“I am pleased to join this bipartisan effort to support the Kootenai Tribe in my district, by updating this clearly outdated policy,” said Rep. Fulcher. “Native Americans have the sovereignty to determine tribal eligibility on their own accord. Requiring someone to prove 50% tribal blood quantum is clearly unnecessary.”

This legislative effort addresses issues stemming from the Jay Treaty of 1794, which was pivotal in preventing a second war with Great Britain, establishing trade policies, and setting the U.S.-Canada border inadvertently dividing Tribal lands. The treaty originally allowed Native Americans to travel freely across the border. However, the 1952 Immigration and Nationality Act amendment imposed a blood quantum requirement for this right, complicating cross-border travel for many Tribal members.

“Requiring Native Americans to prove their blood quantum in order to exercise their treaty-protected rights is ridiculous and discriminatory,” said Rep. Kilmer. “The federal government must respect the sovereignty of each federally recognized Tribe to determine who is eligible to exercise their treaty rights.”

The bill, developed in collaboration with the Jay Treaty Border Alliance- a coalition advocating for Tribal sovereignty and addressing border-related concerns – is endorsed by the National Congress of American Indians, Kootenai Tribe of Idaho, and Prairie Band Potawatomi Nation.

“The “Prairie Band Potawatomi Nation strongly supports the Tribal Border Crossing Parity Act, an Act that will help reclaim the rights inherent to our people and our Potawatomi relatives across the border,” said Joseph Rupnick, Chairman of the Prairie Band Potawatomi Nation. “Our forced removal to Kansas, coupled with the 50% blood quantum requirement to cross the U.S.-Canada border, has disrupted our connections with our relatives and members in Canada. This Act paves the way for reuniting our people and preserving our language and culture. It recognizes our sovereign authority to determine our own membership and to maintain the bonds that geography and policy have strained. We commend Rep. Kilmer and Rep. Fulcher for taking steps to reinforce the promises made in the Jay Treaty.”

“The U.S.-Canada border directly divided the Ktunaxa/Kootenai people between two countries,” said Jennifer Porter, Chairwoman of the Kootenai Tribe of Idaho. “Although we were promised the right of free passage across the border in the Jay Treaty, that promise has not been kept. I applaud Rep. Fulcher and Rep. Kilmer in their efforts to restore respect and mobility of the Ktunaxa people as originally intended by the Jay Treaty. By removing the blood quantum requirement, Congress acknowledges the rights of U.S. Tribes to define their community and membership, reinforcing the foundations of self-governance and cultural integrity.”

“The National Congress of American Indians (NCAI) commends Representatives Kilmer and Fulcher for their leadership in introducing the Tribal Border Crossing Parity Act and calls upon all members of Congress to acknowledge its critical significance and expedite its passage,” said Larry Wright, Jr., Executive Director of the National Congress of American Indians. “NCAI supports the implementation of the Jay Treaty and the removal of the United States’ 50% blood quantum requirement—a requirement that starkly conflicts with both the principles of federal Indian law and the UN Declaration on the Rights of Indigenous Peoples, impedes Tribal citizens’ First Amendment rights to freely practice their religion, and undermines Tribal sovereignty.”

# # #", 1, "2026-03-30T01:40:41Z", "2026-04-07T20:32:04Z"], ["https://fulcher.house.gov/2024/03/22/id-6e657328-2339-41ee-9137-fb3d99612edd/", "U.S. Congressman Russ Fulcher Cosponsors Bipartisan Legislation by Representatives Maloy, Peltola, Curtis, Moore, Lee, and Costa to Clean Up Abandoned Hardrock Mines", "2024-03-22", "2024", "2024-03", "Republican", "House", "ID", "Russ Fulcher", "F000469", "fulcher.house.gov", "fulcher", "https://fulcher.house.gov/category/press-releases/", "scraper", "FOR IMMEDIATE RELEASE: Friday, March 22

CONTACT: Marisa Melton, (208) 743 – 1388, marisa.melton@mail.house.gov

U.S. Congressman Russ Fulcher Cosponsors Bipartisan Legislation by Representatives Maloy, Peltola, Curtis, Moore, Lee, and Costa to Clean Up Abandoned Hardrock Mines

WASHINGTON D.C. – Today, U.S. Congressman Russ Fulcher (R-ID), cosponsored Representatives Celeste Maloy (R-UT), and Mary Peltola (D-AK) bipartisan Good Samaritan Remediation of Abandoned Hardrock Mines Act alongside Reps. John Curtis (R-UT), Blake Moore (R-UT), Susie Lee (D-NV), and Jim Costa (D-CA).

This legislation would make it easier for “Good Samaritans,” including state agencies, local governments, nonprofits, and other groups, to clean up and improve water quality in and around abandoned hardrock mines.

“I am proud to join my colleagues in co-sponsoring this legislation that will make it easier for state agencies, local governments, and Good Samaritan groups to clean up abandoned hardrock mines around Idaho,” said Rep. Fulcher “This bipartisan effort will take a much-needed step forward to improve communities and water quality across the state.”

There are over 140,000 remnants of abandoned hardrock mines on federal land with at least 22,500 that pose health and environmental risks. Utah could have between 8,000 and 11,000 abandoned hardrock mines on BLM (Bureau of Land Management) lands, but a complete inventory has not been conducted.

The Good Samaritan Remediation of Abandoned Hardrock Mines Act would create a pilot permitting program under the Environmental Protection Agency (EPA) to allow cleanup projects to move forward and ensure Good Samaritans have the skills and resources they need to complete permitted work. This program is designed for low-risk projects that will improve water or soil quality or otherwise protect human health and the environment.

“Utah’s mining industry has made vital contributions to the national production of critical minerals like uranium and copper,” said Rep. Maloy. “This commonsense piece of legislation would allow states and private organizations to clean up abandoned mines without being held liable by the EPA, and that will allow Utah to continue to thrive.”

“Today, hardrock mines are well regulated, and new projects are subject to strict safety and environmental protection rules,” said Rep. Peltola. “That was not always the case, however; hundreds of thousands of abandoned mines that no longer have anyone responsible for cleaning up and remediating the land dot the country. This bill would give Good Samaritans a path to help clean up abandoned mines that threaten our communities and our environment.”

“In Utah and across the West, we’re surrounded by the legacy of our pioneering mining industry, but with that comes the responsibility to address what is left behind at mine sites,” said Rep. Curtis. “The Good Samaritan Remediation of Abandoned Hardrock Mines Act represents a critical step forward, empowering those who are ready and willing to help clean up these sites without the fear of undue legal repercussions.”

“Utah and America’s western region at large have a proud history of providing vital resources to support our evolving mineral needs,” said Rep. Moore. “Unfortunately, we still have work to do to clean abandoned mines from decades ago when we did not have the same rigorous environmental standards we have today. Thankfully, many organizations want to be part of abandoned mine remediation efforts, and this bill will make it easier for these “Good Samaritans” to participate in the cleanup of abandoned mine sites. I’m proud to work with Representative Maloy and my colleagues on commonsense bills like this to encourage state agencies, local governments, and organizations to get involved in making a positive difference.”

“Abandoned hardrock mines can be found across the iconic terrain of the American West — including in my district, home to some of the oldest mine lands in Nevada,” said Rep. Lee. “These hazards are pervasive and perilous, posing an ongoing threat to people and the environment alike. ‘Good Samaritan’ partners stand ready to work with the federal government to clean up these sites, and I’m proud to help introduce bipartisan legislation that will cut through the red tape currently preventing them from doing so.” “This bipartisan, commonsense bill will mean cleaner waters and safer landscapes for our communities. That’s a win for Nevada families and our natural resources.”

“For decades, abandoned hardrock mines have polluted public lands, waterways, and watersheds along the Central Valley. These mines put communities at a high risk of exposure to substances that are hazardous to their long-term health. Our bill empowers Good Samaritans to safely remediate our public lands, create new jobs, and ensure clean drinking water for local communities,” said Rep. Costa.

“Today’s bipartisan Good Samaritan introduction is an encouraging sign that the mining industry, environmental organizations, and local communities can unite behind commonsense legislation to tackle the long-overdue cleanup of legacy abandoned mine sites. This legislation, along with its bipartisan Senate companion, would allow mining companies to utilize their equipment and technical expertise to clean up abandoned sites without fear of incurring additional legal liability. These bills are critical to removing the obstacles that have prevented the remediation of important legacy land and water resources for far too long. We commend Reps. Celeste Maloy and Mary Peltola for their shared vision and leadership to advance the environmental progress we all desire,” said Rich Nolan, President and CEO of the National Mining Association.

“There is no constituency for orange, polluted rivers,” said Chris Wood, president and CEO of Trout Unlimited. “More than 40 percent of our western headwater streams—the places trout live and communities get their drinking water—are negatively affected by abandoned hardrock mines. It is gratifying to see more than a bipartisan third of the U.S. Senate sponsored legislation that would accelerate efforts by ‘Good Samaritans’ to clean up historic mine pollution. With today’s introduction of a House ‘Good Sam’ bill, we are closer than ever to advancing common-sense legislation that would help address one of the most pervasive water quality threats in America. We thank Representatives Maloy and Peltola for their leadership, and we look forward to getting this bill across the finish line.”

“We thank Congresswoman Maloy and Congresswoman Peltola for their introduction of the Good Samaritan Remediation of Abandoned Hardrock Mines Act, which would leverage the resources of qualified private entities to clean up abandoned hardrock mine sites, the largest source of pollution on our public lands and waters. By addressing liabilities that have long tied the hands of would-be ‘Good Samaritans’ we can restore degraded watersheds and riparian habitat to enhance opportunities for hunters and anglers,” said Patrick Berry, President and CEO of Backcountry Hunters & Anglers.

Full text of the legislation can be found here.

Senators Martin Heinrich (D-NM) and Jim Risch (R-ID) reintroduced a companion piece of legislation in the Senate.

###", 1, "2026-03-30T01:40:41Z", "2026-04-07T20:32:04Z"], ["https://fulcher.house.gov/2024/03/20/id-66e74b41-805a-476a-9586-0c811d22f227/", "PRESS RELEASE – U.S. Congressman Russ Fulcher Introduces Legislation to Build and Retain an Experienced Energy Workforce", "2024-03-20", "2024", "2024-03", "Republican", "House", "ID", "Russ Fulcher", "F000469", "fulcher.house.gov", "fulcher", "https://fulcher.house.gov/category/press-releases/", "scraper", "FOR IMMEDIATE RELEASE: Wednesday, March 20

CONTACT: Marisa Melton, (208) 743 – 1388, marisa.melton@mail.house.gov

U.S. Congressman Russ Fulcher Introduces Legislation to Build and Retain an Experienced Energy Workforce

WASHINGTON D.C. – Today, U.S. Congressman Russ Fulcher (R-ID) and Congresswomen. This program would provide grants to non-profit organizations eligible to use the talents of U.S. individuals aged 55 or older in other programs administered by the Secretary.

“Given all the workforce challenges happening in our federal energy department and in the energy industry, it is vital we find all avenues for expertise from those who dedicated their careers with the Department of Energy,” Congressman Fulcher said. “Having adequate resources to fulfill the technical and other needs by DOE is important as we encourage them to explore many of the vast domestic energy sources available.”

The EWP would allow DOE to administer programs like those at the Environmental Protection Agency, U.S. Department of Interior, U.S. Department of Agriculture, U.S. Forest Service, and other federal agencies. Under the Older Americans Act, these agencies can place skilled and experienced workers aged 55 or older in agency positions.

“As we continue to fortify our nation’s energy future, we must also recognize the invaluable expertise of our seasoned workforce,” Congresswoman DeGette said. “Investing in our skilled professionals is not just prudent, it’s essential for the prosperity and sustainability of our energy sector.”

“For over 25 years, the Experienced Worker Program has connected experienced professionals with federal agencies providing cost-effective talent, mentorship, and expertise, while filling essential workforce needs,” Cito Vanegas, CEO & President of NEW Solutions said. “The program quickly becomes invaluable to an agency and their mission-critical projects. Almost a year ago, the House passed H.R. 2, the strongest border security bill this country has ever seen. In response, President Biden ignored it, along with the carnage, human strife, and homeland security risks that come with an open border.

It is President Biden’s policies that have made young women like Laken Riley fearful of leaving their houses because of criminals wandering our streets. Crime is increasing at unprecedented rates and enough fentanyl to kill the entire human population has been trafficked into our country.

How does the President respond? He refuses to enforce immigration law, while simultaneously attacking the 2nd amendment rights of legal citizens. Our nation has never been more unsafe.

Contrary to what the President said, the American people are not living “the greatest comeback story ever told”. The truth is, due to the out-of-control government tax and budget demands, consumer confidence is plummeting, overall prices are up almost 18% and Americans are paying roughly $11,400 more annually to buy basic necessities.

America has $34 trillion in national debt. We should cut the federal budget (starting by going back to “pre-COVID” spending levels) and prioritize securing our own borders before sending more money to other countries to secure theirs.

Since President Biden came into office, gasoline is up 33%, electricity and natural gas are both up 29%. Senators John Barrasso (R-WY), Jim Risch (R-ID), and Mike Crapo (R-ID) introduced a companion piece of legislation in the Senate.

“With over 61% of Idaho designated as federal land, individuals live in constant fear they could lose access to the water their family has utilized for generations,” said Rep. Fulcher. “I am proud to co-sponsor the Water Rights Protection Act to further recognize state water laws and bring peace of mind to farmers and ranchers across the state.”

“According to the Utah Constitution, the water in the state belongs to the people of Utah. Unfortunately, federal agencies have a long history of undermining our water laws by requiring co-ownership of water rights as a condition for permit agreements on federal lands. I’m proud to lead my colleagues in sponsoring this bill which clarifies that states have the power to allocate water rights, and the federal government can’t infringe on that ability,” said Rep. Maloy.

“Kansas ranchers and farmers depend on the Sunflower State’s rivers and waterways and know how to steward them appropriately. Ron Estes.

“I’m pleased to join my colleagues in re-introducing the Water Rights Protection Act. This bill protects ranchers, farmers, and tribes from having their water unlawfully seized by the federal government. As Vice Chairman of the House Natural Resources Committee, I am committed to keeping the Biden administration in check and preventing government overreach of individual Americans‘ rights. Then, in 2022, they received conditional approval to remodel veterans homes located in Lewiston, and Pocatello.

When the BABBA was enacted in 2022, Congress was assured previously approved state projects, such as the ones in Idaho, would receive a waiver from compliance standards requiring the construction of government buildings to use materials sourced from U.S. supply chains and manufacturers.

Now that the VA is walking back those claims, the WAIVER Act would allow these projects to be grandfathered in.

“The VA needs to stop playing politics with Idaho’s heroes,” Congressman Fulcher said. “The VA promised Idaho a waiver to build and remodel these homes, and I intend to make them keep their word.”

“America’s veterans have waited far too long for updated facilities in Idaho and around the country. Due to the VA Secretary choosing to selectively apply requirements, veterans will wait longer and it will cost taxpayers more money for needed facility updates,” said Senator Risch. “The WAIVER Act will push the VA to be consistent with other agencies, advance American manufacturing and production in the best way possible, protect taxpayer dollars, and enable state veterans’ homes to move forward with important, planned projects to help America’s veterans.”

“Biden’s VA is playing political games with our veterans, and Idaho’s leaders are lockstep in pushing back. It is unacceptable that help for our veterans is in peril because of bureaucracy. This is a classic example of the federal government moving the goalposts midgame. The State of Idaho is living up to our end of the deal but the feds aren’t, and veterans are the ones who will suffer,” Governor Brad Little said. “I appreciate Congressman Russ Fulcher and Senator Jim Risch for taking steps to slash the red tape at the VA so construction and renovation on our veterans homes in Boise, Lewiston, and Pocatello can move forward as planned.”

“The VA in Washington, D.C., keeps changing their story and pulling the rug out from under the states,” Idaho Division of Veterans Services Administrator Mark Tschampl said. “This isn’t just an Idaho issue, either. Dozens of facilities for veterans in other states are on the line, too, because the VA won’t issue the waivers for our projects, which were approved for funding before the passage of this new law. United States and Idaho v. United States. The brief supports the State of Idaho in defending its pro-life law, the Defense of Life Act, against the Biden administration’s efforts to preempt it with their wrongful reinterpretation of federal law. Fulcher and Risch were joined by the entire Idaho delegation, 24 U.S. Senators, and 93 U.S. Representatives.

The amicus brief outlines several issues with the Biden administration’s case against Idaho’s bill. The brief clarifies:

The administration is wrongfully misinterpreting the Emergency Medical Treatment and Labor Act (EMTALA) into federal agency guidance and claiming it provides a national abortion mandate for “stabilizing” abortions;

EMTALA does not mention abortion in any capacity, and the statute’s purpose is to ensure any person seeking help in an emergency room receives help regardless of his or her ability to pay;

EMTALA protects women in active labor and their unborn child(ren);

There is no federal right to an abortion; and

SCOTUS ruled in Dobbs v. Jackson Women’s Health there is no constitutional right to an abortion and it returned abortion-related decisions to the states.

“The case of Moyle v. United States and Idaho v. United States involves an elective, induced abortion which is against Idaho law,” said Congressman Fulcher. “The Biden administration has no authority to use EMTALA to avoid holding these individuals accountable for breaking the law, and this sets a precedence that is harmful to women and children around the country.”

“The Biden administration’s overreaching efforts to expand abortion nationwide is an attempt to take power away from the American people,” said Congressman Simpson. “The Supreme Court rightfully ruled that states have the right to protect life, yet this administration continues to undermine that decision. I strongly support the right of all states to protect the unborn, and I reaffirm this priority by joining this amicus brief.”

“Idahoans have passed a strong law to protect the lives of mothers and the unborn, yet the Biden administration is seeking every opportunity to expand abortion. This administration cherrypicked pieces of existing statute and wrongfully reinterpreted it to fit their agenda,” said Senator Risch. “Their manipulation of federal law cannot usurp state law, and there is no federal right to an abortion. This amicus brief demonstrates how the administration’s substantial federal overreach is aimed at undermining pro-life protections not only in Idaho but around the nation.”

“The Supreme Court has ruled it is the states’ ability to protect the right to life, yet the Biden Administration continues to exercise federal overreach to advance its abortion agenda,” said Senator Crapo. “The Administration must stop its ongoing attacks on state-issued pro-life protections, including in Idaho.”

U.S. Representatives who joined in submitting the brief: Robert B. One of the biggest being the Southern border.

“The United States sees more legal immigration than anywhere in the world,” Congressman Fulcher said. “The individuals entering illegally are not coming with hopes of living out the ‘American Dream’. They are helping China bring fentanyl across the border. They are trafficking an all-time high number of women and children. They are known terrorists on the FBI watch list, and more.”

The Lower Snake River Dams were another big topic of the night as individuals expressed concern for their communities if the dams were removed. Fulcher assured everyone in the room it takes an act of Congress to remove the dams and he will not let that happen.

The Congressman also answered questions regarding Good Neighbor Authority, federal land, the national budget, COVID, and more.

Fulcher ended the night by telling the room answering questions and listening to community members’ concerns is one of the best parts of his job. He stated is it an honor to serve Idaho’s first district, and thanked everyone for coming out.

For more information on future events, visit Congressman Fulcher’s social media @RepRussFulcher

###", 1, "2026-03-30T01:40:41Z", "2026-04-06T23:46:48Z"], ["https://fulcher.house.gov/2024/01/10/id-fd224a8c-1de8-4090-90e9-841d1e146480/", "PRESS RELEASE – Congressman Fulcher to Host Town Hall Update in Sandpoint Monday, January 15", "2024-01-10", "2024", "2024-01", "Republican", "House", "ID", "Russ Fulcher", "F000469", "fulcher.house.gov", "fulcher", "https://fulcher.house.gov/category/press-releases/", "scraper", "FOR IMMEDIATE RELEASE: Wednesday, January 10th

CONTACT: Marisa Melton, (208) 743 – 1388, marisa.melton@mail.house.gov

Congressman Fulcher to Host Town Hall Update in Sandpoint Monday, January 15

WASHINGTON D.C. – U.S. Congressman Russ Fulcher is hosting a town hall update on Monday, January 15th in Sandpoint at 5:30 p.m. at the VFW Post 2453.

The Congressman will be touching on topics relating to the national debt, border security, the Snake River Dams, and more.
