On behalf of the Ninth Congressional District of California Congresswoman Barbara received and submitted the follow requests for projects as part of the process for developing the 2009 Water Resources Development Act:\r\nAlameda County Flood Control and Water Conservation District\r\nSan Lorenzo Creek Flood Damage Reduction  to make improvements along the creek and the Don Castro Dam.\r\nImprovements include: raising the Don Castro Dam 5 feet, modifying the outfall structure, de-silting at Don Castro Reservoir at the upstream end, and constructing floodwalls along the downstream of San Lorenzo Creek.\r\nThe improvements will provide increased flood protection to contain 100-year design flow within San Lorenzo Creek, reduce potential for future flooding, enable the District to apply to FEMA with a Letter of Map Revision to remove the 100-year floodplain designation, and eliminate the mandatory requirement to purchase flood insurance.\r\nThere are approximately 2,500 parcels that are located in the FEMA high hazard flood zone.\r\nCity of Berkeley\r\nBerkeley Marina Dock Replacement Project  to replace 270 berths and keep them in a safe, operable, accessible, and rentable condition.\r\nThe Berkeley Marina is the largest municipal marina in Northern California and supports a variety of recreational and commercial activities. Due to the age and condition of the D/E and O docks replacement is required to keep them in a safe, operable, accessible, and rentable condition. The project would replace 270 of the Berkeley Marina's 1,000 berths.\r\nThe D/E and O dock are some of the oldest docks in the Berkeley Marina dating back to the 1960's. They are rapidly deteriorating and require significant ongoing maintenance, with costs escalating to where the City's Marina Fund spends approximately $200,000 annually to replace dock sections which can no longer be repaired or maintained in a safe or serviceable condition. Replacement of the dock would allow the Marina to continue to offer recreational activities and enhanced access to the San Francisco Bay.\r\nAdditionally, these docks were designed and constructed before the passage of the Americans with Disabilities Act, and thus fail to meet current ADA standards. The new construction would allow not only disabled access to the docks but would include accessible berths for disabled boaters. Programs at the Berkeley Marina provide and encourage boating water related experiences for a variety of disabled persons.\r\nMaintenance Dredging of the Berkeley Marina's Channel, Entrance and Fairways  to achieve a depth of -10 feet and remove 90,000 cubic yards of dredge volume\r\nThe Berkeley Marina is the largest municipal marina in Northern California with 1,000 berths supporting a variety of recreational and commercial activities, including 100 legal aboards. Year-around marina access is not available, especially at low tides, unless dredging to maintain a depth of -10 feet below mean low water occurs. Dredge volume for this project would be approximately 90,000 cubic yards.\r\nMaintenance dredging of the entrance channel and fairways will allow year-around access to the Berkeley Marina for both commercial and recreational vessels. The marina is home port to the Hornblower fleet of cruise and events boats ranging in size from 40 to 120 feet in length. There is also an active fleet of commercial charter fishing boats that operate out of the Marina.\r\nDue to its proximity to the central bay and consistent winds, more than 70 percent of the boats berthed in the marina are sailboats, and approximately 40 percent of the Marina berths are for larger vessels. The depth required for these vessels is significantly greater due to their deeper draft.\r\nCity of Emeryville\r\nRestoration of Emeryville Marina Harbor Wetlands  to create a natural habitat for the wildlife that inhabits the marina mudflats and shoreline.\r\nThe shoreline at the Marina is approximately 1100 feet with mudflat extending approximately 60 feet from the shoreline at low tide. The entire mudflat appears blighted, especially during low tide, with concrete landfill debris strewn about. The project would remove the concrete landfill debris in addition to any non-native invasive plants from the mud-flat wetlands and shoreline before installing new native vegetation within the coast and tidal zone. Emeryville seeks to work with a wetlands restoration specialist to prepare concept plans and facilitate the issuance of Regulatory Permits from the USACE, Regional Water Quality Control Board, the Department of Fish and Game, and BCDC.\r\nThe shoreline's current condition is unattractive to visitors in addition to harming the environment. The benefits of the project will be cleaning up an environmental hazard, returning the shoreline to its natural use, and serving as a destination and attraction to residents and visitors of the East Bay. An additional benefit is the shoreline, once repaired, will be a classroom for the students of Emery Unified School District, Berkeley School District, and Oakland Unified School District to learn about the natural habitat of the San Francisco Bay and Marina while supporting additional earth science lessons.\r\nCity of Oakland\r\nOakland Inner-Harbor Tidal Canal Easement  to clarify permitting jurisdiction and allow for construction of a continuous San Francisco Bay Trail.\r\nThe City of Oakland is constructing a pedestrian/bicycle trail along its shoreline as part of the 500-mile San Francisco Bay Trail. At three locations, the trail needs to be built on boardwalks into the Federal-owned Tidal Canal, in order to pass under bridges that span the Canal from Oakland to Alameda. These are critical gaps in the continuity of the trail. The City of Oakland would like Congress to require the Secretary of the Army to grant permanent easements for the trail, authorize construction of the trail by the City, and clarify permitting jurisdiction. By 2006, it imported 62% of its energy.\n\nThree years ago, the city of Truckee was about to sign a long-term contract for electricity purchased from a new, state-of-the-art, EPA-approved coal-fired power plant in Utah. It was forced to abandon this contract because the power was not ideologically acceptable -- even to be imported. The replacement power now costs Truckee consumers nearly twice as much.\n\nIf this folly is imposed nationally, it will have disastrous consequences to the economy and to the quality of life of the people of our nation for generations to come.\n\nFinally, I need to note that the environmental left has not only devastated California\u2019s once-abundant energy capacity, it has produced an unprecedented water crisis by the deliberate diversion of 200 billion gallons of water from Central Valley agriculture for the enjoyment and prosperity of the Delta Smelt.\n\nI have been told that this is the last Water and Power Subcommittee hearing for this year. That\u2019s bad news for 40,000 unemployed San Joaquin Valley workers who have urgently asked Congress to turn the Delta pumps back on. In the second century AD, Ptolemy recorded year-round precipitation throughout the Mediterranean.\n\nWe also know that there were other periods when the earth\u2019s climate was much cooler than it is today. During the Little Ice Age, from 1300 through 1850, the Thames River and New York Harbor regularly froze over. Indeed, during the Little Ice Age, a wave of religious zealotry swept Europe blaming witchcraft for the dramatic climate changes of the era.\n\nGiven the constant variability of the earth\u2019s climate, proper water management requires accurate and abundant data, and I certainly applaud any effort to assure that in planning for our future needs we do so with the scientific data necessary to make informed decisions.\n\nI just want to be sure that it is science and not ideology that is driving the effort.\n\nThat\u2019s why I get a little nervous watching, for example, how the Secure Water Act was rushed through this house. Without any debate or dialogue or hearings on this side, it was dropped into a 1,216 page omnibus bill that could not even be amended.\n\nUnder the guise of the Secure Water Act, the Bureau of Reclamation recently announced a new \u201cRiver Basin Study Program\u201d that will \u2013 quote \u2013 \u201cbetter define options for future water management of Western river basins\u2026\u201d\n\nThe use of the term, \u201cfuture water management\u201d has raised concerns by many western water users that this is a program whose purpose is not to produce reliable data but rather to search for ways to justify increasingly Draconian restrictions on water usage. What we need is an open assessment of the most viable, economical and certain options of assuring an abundance of water for the people of these regions from the natural resources that we enjoy.\n\nIf the warming trend that began in 1850 and peaked in 1998 resumes, then the need for more dams and aqueducts will become acute. I submitted a series of questions to the Bureau of Reclamation to clarify the intent of these studies and I have yet to receive answers. Then in 2007, he enlisted.\n\nWhen his sister, Chastity, begged him not to go, he said that he felt by going into the military, he was protecting his family.\n\nHe was an exemplary soldier who commanded the friendship and respect of his colleagues. While at Fort Hood, he became close friends with another Californian, Jake Velloza, and they shipped out to Iraq together.\n\nHe had fallen in love with Amanda Harazin while stationed at Fort Hood. Amanda is known as \u201cA-J\u201d to her friends, but Jeremiah called her the \u201cLove of his life.\u201d They were to have been married on May 30th.\n\nBut on May 2nd, outside of Mosul, Iraq, at a Combat Outpost in Hammam Alil, American soldiers were attacked by two gunmen wearing Iraqi Police uniforms. Two U.S. soldiers \u2013 Jeremiah McCleery and his best friend, Jake Velloza -- were killed in that attack and three others were wounded.\n\nOn May 14th \u2013 the day before he was supposed to return to a happy homecoming and impending marriage \u2013 Jeremiah McCleery returned to his hometown to be buried beside his mother. The local paper described the scene with these words, which speak volumes about the community which helped to mold this American hero:\n\n\u201cAcross the Sierra Valley people lined the highway, some with their hands over their hearts as a mark of respect. In Portola, streets were lined with flag-waving citizens. Shop owners left their stores to join in, temporarily suspending business as usual.\u201d\n\nM. These come with a hefty price tag: $577 million, with assignment of rights to over 110,000 acre feet of water. There are hundreds of such claims that are likely to follow.\n\nIt is important that these claims be settled. They involve some of the oldest standing litigation in the federal court system. They establish something that the people of their regions \u2013 both on and off reservation \u2013 have lacked, and that is a certainty about future water rights and apportionments.\n\nBut here is what has troubled me in my brief tenure as Ranking Member of your Water and Power subcommittee.\n\nThese are settlements of outstanding litigation involving the United States Government. It seems to me that the only relevant question is whether these settlements are advantageous to the government compared to its likely liability under current law.\n\nIf we were the board of directors of a private corporation deciding whether to approve a negotiated legal settlement, we would be guilty of breaching our fiduciary responsibility to stockholders if we made that decision without consulting legal counsel.\n\nThe administration has expressed reservations about all of these bills, and that should be a warning to us. What troubles me most is that we have been unable to get a straight answer to the most important question at issue, and that is, \u201cDo these settlements exceed the likely liability of the government if these claims went to court?\u201d\n\nOr to be more blunt, are we cutting our losses or are we giving away the store? I can\u2019t get a straight answer to that question.\n\nThe three well-intentioned bills before us today are prime examples of what\u2019s gone wrong. This Administration \u2013 and I might add, the last Administration \u2013 have repeatedly testified that they cannot support funding levels in these settlements, yet they fail to provide Congress basic answers or consistency when we ask for alternative funding amounts or whether the bills are beneficial to the American taxpayer.\n\nAs a result, Congress is being forced to choose a funding amount in the dark and without an informed opinion from our legal counsel. In essence, we are a blind-folded arbitrator.\n\nI\u2019m new around here, but I spent 22 years in the California legislature, many of them on the relevant committees that heard settlement bills. The central testimony in all of those settlements was from the Attorney General\u2019s office \u2013 as our legal counsel. They would appear before us and testify that in their professional legal judgment the settlements were justified under current law and that the state\u2019s liability and legal costs could potentially exceed the settlement if the matter went to trial.\n\nThis is the one critical issue that has not been addressed for these bills.\n\nI asked this question in committee and didn\u2019t get an answer. Last week I sent a letter asking the Departments of Justice and the Interior asking for their assessment of the government\u2019s liability and haven\u2019t received an answer.\n\nI think this is a reasonable request and one that should be answered to the satisfaction of this committee and the House before these bills are acted upon.\n\nThere is precedent for such opinions, based upon the Department of Justice testimony in 1994 before this Committee on the Colville settlement. There, Peter Steenland, a Clinton Justice Department official testified: \u201cthe Federal government is not that well postured for a victory on this claim which has been pending for over 40 years. Absent the settlement, we could well litigate it for another 10 years and the outcome could easily be a significant cost to the taxpayers and the public.\u201d\n\nIf the Clinton Administration could give Congress a straight answer, then there\u2019s no reason why the current one can\u2019t.\n\nThere\u2019s a simple word for this. Transparency. We\u2019re assured this is a guiding principle of the administration. This bill drafted in 1994 by then Senator Joseph Biden provided $1.6 billion to enhance investigation and prosecution of the violent crime perpetrated against women, increased pre-trial detention of the accused, imposed automatic and mandatory restitution on those convicted, and allowed civil redress in cases prosecutors chose to leave unprosecuted. Since then the bill has been reauthorized in both 2000 and 2005.\r\nSince the bill's passage, there has been nearly a 25 percent increase in domestic violence reporting rates by women and a 37 percent increase in reporting rates by men. The number of individuals killed by an intimate partner has decreased by 24 percent for women and 48 percent for men.\r\nThe passage of this legislation was a landmark achievement for women across this country and around the world  giving them the protection under the law that they needed and deserved. Yet there is still much work that needs to be done on this issue.\r\nAround the world one in three women has been beaten, coerced into sex, or otherwise abused in her lifetime. Here in the United States, nearly one third of American women report being physically or sexually abused by a husband or boyfriend at some point in their lives. And as we all know a substantial number of cases of violence and abuse never get reported.\r\nAs one who understands domestic violence from a deeply personal basis, I remain committed to working to ensure that all women both here and abroad are protected from the egregious act of domestic violence. First of all, I want to say what a delight it has been to work with Chairwoman Napolitano, who has given all of these bills a fair, balanced and complete hearing.\n\nWe have six Water and Power subcommittee bills before us today. They are bi-partisan and well intentioned and seek to stretch scarce water supplies throughout the Southwest. But I do have some serious concerns that need to be addressed in the near future.\n\nA generation ago, the principal objective of our water and power policy was to create an abundance of both. It was an era when vast reservoirs and hydro-electric facilities produced a cornucopia of clean and plentiful water and electricity on a scale so vast that many communities didn\u2019t even bother to meter.\n\nBut the last generation seems to have abandoned this objective, and to replace it with a very different philosophy that now dominates public policy: that the government\u2019s principal focus is not to produce abundant water and power, but rather to ration shortages that government has caused by abandoning abundance as its primary objective.\n\nThe result is increasingly expensive water and power that is now affecting our prosperity as a nation. We\u2019re no longer looking at cost-benefit analyses of which projects make economic sense and which do not. Instead, practicality has been replaced by an entirely new ideological filter: those projects that ration or manage shortages are considered worthy regardless of their feasibility or cost \u2013 and projects that produce abundance are to be discouraged regardless of their economic benefits or simple common sense.\n\nWhich brings me to the fine point of the matter. Four of these bills deal with water recycling \u2013 trying to stretch dwindling supplies rather than create new ones. The administration opposed these bills and was honest and candid in pointing out that we have already authorized 53 such projects without the funds to finance them, producing a $624 million backlog. The bills before us today add another four projects to the waiting list and another $110 million to the backlog. And yet still there\u2019s no process for prioritizing.\n\nMy biggest concern is that these four recycling bills will cost from a low of $980 per acre foot to a high of $5,400 per acre foot and this is simply not fiscally rational or fiscally sustainable.\n\nI don\u2019t believe it is fair to oppose these bills today since there hasn\u2019t been a standardized framework with which to judge them. These bills have been in the process for some time and there aren\u2019t any similar bills behind them.\n\nBut I do want to ask that after this batch of projects is added to a growing backlog of unfunded and fiscally questionable recycling projects that we establish a rational standard for cost-benefit analysis for all future measures. I believe it can be as simple as requiring the Bureau of Reclamation to certify that the project is the least expensive alternative before federal funds may be released.\n\nSince we are approving these bills on a bi-partisan basis today I would hope that we can work together in a bi-partisan manner to assure that we\u2019re not mandating cost-prohibitive water recycling programs just because we like the general idea with no concern about the actual cost.\n\nFinally, we have two non-related bills introduced by Mr. Matheson of Utah which I whole-heartedly support. One, HR 2008 clears the way for a 50 megawatt hydropower project. The other, HR 2950 allows the Uintah Water District to prepay its obligations to the federal treasury. This is in the interest of the District that can be relieved of interest costs and regulatory burdens. It is also in the interest of the nation, at a time when it is running a catastrophic deficit.\n\nMy only concern is this should take an act of Congress. It's time we provide the necessary help for our local law enforcement agencies to hire officers to help reduce crime rates.\r\nThe legislation would amend the Community Oriented Policing Services (COPS) Act to direct funding to the five cities with the highest violent crime rates according the 2007 Federal Bureau of Investigation's Uniform Crime Reporting statistics. Those cities are: Oakland, CA; Atlanta, GA; Baltimore, MD; Detroit, MI; and Memphis, TN. Specifically these cities would become eligible for hiring grants that could increase police forces by five to 10 percent by adding officers to patrol areas affected by violent crime. And I have spent the last three years watching as that law has dangerously deepened California\u2019s recession. It uses a different mechanism than Cap and Trade, but the objective is the same: to force a dramatic reduction in carbon dioxide emissions.\n\nUp until that bill took effect, California\u2019s unemployment numbers tracked very closely with the national unemployment rate. But then in January of 2007, California\u2019s unemployment rate began a steady upward divergence from the national jobless figures. Today, California\u2019s unemployment rate is more than two points above the national rate, and at its highest point since 1941.\n\nWhat is it that happened in January of 2007? AB 32 took effect and began shutting down entire segments of California\u2019s economy. Let me give you one example from my district. The City of Truckee, California was about to sign a long-term power contract to get its electricity from a new, EPA-approved coal-fired electricity plant in Utah. AB 32 and companion legislation caused them to abandon that contract. The replacement power they acquired literally doubled their electricity costs.\n\nSo when economists warn that we can expect electricity prices to double under the cap and trade bill, I can tell you from bitter experience that in my district, that\u2019s not a future prediction, that is an historical fact.\n\nGov. Schwarzenegger assured us that AB 32 would mean an explosion of new, green jobs -- exactly the same promises we\u2019re hearing from cap and trade supporters. In California, exactly the opposite has happened. We have lost so many jobs that the UCSB economic forecast is now using the D-word \u2013 Depression \u2013 to discuss California\u2019s job market.\n\nM. Speaker, the Cap and Trade bill proposes what amounts to endlessly increasing taxes on any enterprises that produce carbon dioxide or other so-called greenhouse gas emissions. We need to understand what that means. It has profound implications for agriculture, construction, cargo and passenger transportation, energy production, baking and brewing \u2013 all of which produce enormous quantities of this innocuous and ubiquitous compound. In fact, every human being produces 2.2 pounds of carbon dioxide every day \u2013 just by breathing.\n\nSo applying a tax to the economy designed to radically constrict carbon dioxide emissions means radically constricting the economy.\n\nAnd this brings us to the fine point of it.\n\nWhen you discuss the folly of the Hoover Administration \u2013 how it turned the recession of 1929 into the depression of the 1930\u2019s, the first thing that economists point to is the Smoot-Hawley Tariff Act that imposed new taxes on over 20,000 imported products.\n\nWaxman Markey is our generation\u2019s Smoot Hawley. In fact, it\u2019s worse because it imposes new taxes on an infinitely larger number of domestic products on a scale that utterly dwarfs Smoot-Hawley.\n\nLet\u2019s ignore for the moment the fact that the planet\u2019s climate is constantly changing and that long term global warming has been going on since the last ice age. Let\u2019s ignore the fact that within recorded history we know of periods when the earth\u2019s climate has been much warmer than it is today and others when it has been much cooler. Let\u2019s ignore the thousands of climate scientists and meteorologists who have concluded that human-produced greenhouse gases are a negligible factor in global warming or climate change.\n\nIgnore all of that and still we are left with one lousy sense of timing. In the most serious recession since the Great Depression \u2013 why would members of this house want to repeat the same mistakes that produced that Great Depression? Watching how California has just wrecked its economy and destroyed its finances, why would they want to do the same thing to our nation?\n\nM. Speaker, this is deadly serious stuff. It transcends ideology and politics.
