In light of the growing strategic challenge posed by the People's Republic of China \u2013 and in the aftermath of Vladimir Putin's unlawful invasion of Ukraine \u2013 the FY23 NDAA equips the Department of Defense (DoD) and U.S. military with the right resources and authorities to meet the greatest threats to the United States and our common defense. \"I am incredibly pleased that the House has passed this year's NDAA, which is vital for the continued strength of our military and the well-being of our service members and military families.\" said Congressman Carson.\n\nAmong the many provisions in this legislation is a bipartisan amendment introduced by Rep. Carson aimed at fighting pancreatic cancer. The amendment increases pancreatic cancer research funding at the Department of Defense's Congressionally Directed Medical Research Programs (CDMRP) by $5 million in funding for an early detection initiative (EDI). Some of America's most important medical research is led by the Defense Department so these funds will help save lives. \"I am also honored that this year's legislation builds on my ongoing efforts to fight pancreatic cancer\" said Congressman Carson.\n\nThe NDAA also includes the Coast Guard Reauthorization Act, which contains legislation authored by Congressman Carson to make Duck Boats safer\u2014the Duck Boat Safety Act. Duck Boats are a type of amphibious passenger vehicle popular with tourists; they can travel on roadways and on water. The legislation would enact recommendations from the National Transportation Safety Board to make the vehicles safer.\n\n\"The NDAA also includes provisions to make Duck Boats safer and honor the memory of the Coleman family from Indianapolis, as well as all who have died in Duck Boat accidents.\" Congressman Carson reminded everyone that this major safety problem hit close to home when nine members of the Coleman family from Indianapolis were killed in a Duck Boat accident in 2018 on Table Rock Lake in Branson, Missouri. Only Tia Coleman and her nephew, Donovan, survived. In total, 17 of the 31 passengers on the boat were killed. Since then, Tia Coleman has become an advocate for greater Duck Boat safety.\n\nThe NDAA also includes many other key provisions, including:\n\nAuthorizing support for a 4.6% pay increase for service members and civilian personnel, 2.4% inflation bonuses for service members earning less than $45,000 annually and a $15/hour wage for workers on federal service and construction contracts.\n\nSupports HBCUs and other minority institutions in allocating over $111 million for research activities at HBCUs and establishes a pilot program to increase research capacity at minority serving institutions.\n\nSpousal change of service station reimbursement: Authorizes financial reimbursement for moving expenses for spouses with home businesses.\n\nExtends the authorization of the Afghan Special Immigrant Visas (SIV) program, the deadline for those who qualify to apply for SIVs, and allows those Afghans wounded during their service to the U.S. government to apply for the SIV program even if they have not met the one-year minimum employment threshold. This provision reaffirms the commitment to Afghan citizens who, at great personal risk, supported U.S. operations in Afghanistan.\n\nUnfortunately, the NDAA did not include Congressman Carson's provisions requiring an investigation into the death of American journalist Shireen Abu Akleh. Additionally, we are encouraged by and would like to thank you for your continued investment in protecting our vulnerable populations from sexual abuse. As you consider priorities for the Labor, Health and Human Services, and Education Subcommittee, we urge you to appropriate $10 million to the Centers for Disease Control and Prevention (CDC) National Center for Injury Prevention and Control for child sexual abuse prevention research activities in Fiscal Year 2023.\n\nThe CDC estimates that 1 in 4 girls and 1 in 13 boys will become victims of child sexual abuse, an adverse childhood experience that can impact how they think, feel, and act over their lifetime. Child sexual abuse is associated with long-term physical and mental health issues. A 2018 study estimated that the lifetime economic burden of CSA in the United States was at least $9.3 billion in 2015; however, because child sexual abuse is underreported, this is likely an underestimate. Additionally, another newly published study found that the United States spends approximately $5.4 billion each year to incarcerate people for sex crimes against children, including $508 million annually on federal prisoners in 2021. In 2021, Congress appropriated $1.5 million for child sexual abuse prevention research. That means for every federal dollar spent on research, the United States spent about $2982 on punishment. Child sexual abuse is indisputably a criminal justice problem as well as a public health problem. Despite the wide-ranging impact of child sexual abuse, there are currently very few scientifically validated prevention interventions. In order to successfully combat child sexual abuse, additional resources to provide evidence-based, proactive intervention remain crucial. Moreover, increased investment in prevention will help ensure the responsibility to stop or report abuse does not rest with children. In the absence of validated prevention efforts, organizations and individuals that work with children developed and implemented idiosyncratic and untested prevention efforts.\n\nThe COVID-19 pandemic has also clarified just how vulnerable we are without effective prevention programming. The National Center for Missing and Exploited Children reported a nearly 100% increase in online enticement reports and a 63% increase in CyberTipline reports between January and September 2020, compared to the same months in 2019. Likewise, INTERPOL reported increased consumption of child sexual exploitation and abuse materials among several member countries during the pandemic. In addition to increased online offending, data from US and UK Stop It Now! helplines indicate a surge in requests for help by stepfathers with sexual thoughts about their stepdaughters. These increases are likely due to steep pandemic related job losses and work-from-home/learn-from-home policies that leave at-risk men who were previously managing their urges with too much time, too much access to children, and too little structure. We can anticipate that risk for online and intra-familial offending will remain high until pre-pandemic employment levels are regained, a process that could take years.\n\nIn FY 2020, $1 million was allocated to the CDC\u2019s Division of Violence Prevention, which funded two grants to study perpetration prevention. In FY 2021, the program received an increase to $1.5 million, and an increase to $2 million in FY 2022. This early funding is much appreciated; however, achieving prevention at a large scale will require a significant increase in federal investment, not just incremental increases year over year. We must take continued action to ensure the health and safety of children who remain at risk of experiencing sexual abuse. While this issue is largely preventable, regrettably there are substantial gaps in proactively keeping children from harm. A CDC report on the current state of child sexual abuse prevention outlined several serious but addressable gaps in existing research efforts, including:\n\nInadequate information on the scope of child sexual abuse victimization and perpetration. Prevalence estimates provide essential information about where, when, and whom prevention efforts should target, yet there are currently no high-quality perpetration prevalence estimates in the US or elsewhere.\n\nIncomplete understanding of factors that lead to child sexual abuse perpetration. Studies that follow large samples of at-risk individuals over time are needed to identify risk factors that promote offending, as well as protective factors that inhibit offending.\n\nAbsence of validated prevention strategies. U.S. trade laws allow the American steel industry to mitigate the harm inflicted on it by unfairly traded foreign imports. In 2015 and 2016, after years of unfair trade, domestic producers sought trade relief on four critical steel products: corrosion resistant steel (CORE), cold-rolled steel, hot-rolled steel, and cut-to-length plate. Domestic producers brought these cases as they were facing the crippling effects of a surge of foreign imports which took a record 29 percent of the U.S. market in 2015, bringing the industry\u2019s capacity utilization rate to as low as 70 percent.\n\nAfter detailed investigations by the U.S. Department of Commerce (DOC) and the U.S. International Trade Commission (ITC), those agencies concluded that for each of the products described above, foreign producers were engaging in unfair trade and those unfairly traded imports were causing material injury to domestic producers and ordered anti-dumping and countervailing duties. Those orders are now subject to five-year sunset reviews by the DOC and ITC.\n\nDomestic producers began recovering in the years after the orders went into place, but like the rest of the world, faced severely suppressed demand and production levels during 2020 due to the global pandemic. As the economy and demand have begun to rebound with our emergence from the pandemic, so too has the domestic steel industry\u2019s production levels. However, foreign imports surged into the U.S. market again. In 2021, foreign imports were up 43 percent, taking 21 percent of the U.S. market for all steel products. There is no indication that imports are going to slow down in 2022, as steel imports are up 28 percent in the first quarter of 2022 versus the first quarter 2021.\n\nGlobal overcapacity in steel markets remains a significant issue. A recent OECD Steel Committee meeting heard reports that producers in Southeast Asia expect to bring over 90 million metric tons of steelmaking capacity online over the next 5-6 years. The OECD is also projecting that global steel demand will stagnate and potentially decline this year, partly as a result of the ongoing conflict in Ukraine. These developments will contribute to overcapacity, leading to a new flood of steel imports that could devastate domestic steel producers, just as they begin to recover from the effects of the pandemic \u2013 and this problem will be much worse if these orders are not maintained. As we have seen from the pandemic and supply chains shortages, Americans need a strong and healthy steel industry. Steel, including the flat steel products at issue here, is the backbone and key material for so many critical supply chains necessary for our national and economic security. Your attention to this matter is greatly appreciated.\n\nAmerican industry and workers can more than compete and succeed in a fair market that responds to supply and demand principles. Unfortunately, our manufacturers must increasingly operate in a global market dominated by state-owned and subsidized firms. These firms operate irrespective of market conditions, often permitting them to operate at an economic loss and sell products at less than fair market value.\n\nAnti-Dumping (AD) and Countervailing Duty (CVD) laws exist to protect United States producers and workers from economic injury resulting from unfairly traded imports. According to the ITA, in recent years, the agency has experienced a surge in the number of AD and CVD petitions filed by domestic industry. Even during 2020 and 2021, amid the challenges of the COVID-19 pandemic, such petitions increased nearly 50 percent compared to the prior two years, leading ITA to initiate 154 new AD and CVD investigations\u2014more than any other two-year period this decade. The first quarter of 2022 has already seen an additional 17 cases initiated.\n\nAs ITA undertakes these labor-intensive and time-sensitive investigations, which require thorough analysis and evaluation/verification of evidence submitted by foreign respondents, it must also vigilantly review and enforce 664 existing AD and CVD orders through annual administrative reviews\u2014which can be as demanding as original investigations\u2014and circumvention inquiries, as well as five-year \u201csunset\u201d reviews. It should be noted that ITA and ITC have found merit to claims of economic injury resulting from unfairly traded import investigations. ITA has consistently seen a rise in the number of calculated AD/CVD rates in each of the last three fiscal years including 772 in FY 2021.\n\nWe strongly encourage the Committee to consider these factors when establishing funding levels for Enforcement and Compliance activities at ITA to ensure the agency has adequate resources and personnel to protect American firms and workers from economic injury from unfairly traded exports.\n\nThe ITC is an independent, quasi-judicial commission responsible for investigating and making timely and objective determinations involving imports that cause injury to a domestic industry in violation of United States trade laws. Its status as an independent agency whose commissioners are equally split between the parties provides confidence to affected stakeholders that decisions and remedy recommendations made by the Commission are solely based on the facts and relevant law and are free of political interference. Among the ITC\u2019s mission priorities are conducting AD/CVD investigations and reviews and trade involving United States intellectual property rights under Section 337 of the Tariff Act of 1930.\n\nThe ITC continues to experience similar numbers to ITA for trade remedy investigation caseloads, as well as concomitant reviews of existing orders. According to the ITC, the agency has experienced a surge in the number of AD and CVD petitions filed by domestic industry. Only eight such petitions were filed in 2014. Since then, however, more than 100 new petitions have been filed, and there is no sign of abatement. Meanwhile, the ITC must now review the AD and CVD orders put in place over the last several years, with the ITC anticipating it will institute 40 and 35 reviews in FY2022 and FY2023, respectively. Additionally, cases investigated by ITC are increasingly complex and include petitions involving multiple countries. The increased funding request will also allow the ITC to address its growing portfolio of mandates in the trade enforcement area, including additional responsibilities under recent trade deals.
