Gerry Connolly (VA-11), Chris Deluzio (PA-17), Dan Kildee (MI-08), Jennifer McClellan (VA-04), Joe Neguse (CO-02), and Abigail Spanberger (VA-07). The bill will make it easier for survivors of miners who died of pneumoconiosis, also known as \u201cblack lung disease\u201d, to access benefits through the Black Lung Benefits Act of 1972. An identical bill has been introduced in the Senate by Senator Mark Warner of Virginia.\n\n\u201cGenerations of mine workers have worked in dangerous conditions to power America and provide for their families and communities,\u201d said Rep. Morgan McGarvey. \u201cKentucky was at the forefront of the last energy revolution, but we paid for it with the health and safety of our miners. I\u2019m proud to join with my colleagues Senator Warner and Congressman Cartwright in righting a past wrong, and I\u2019ll continue fighting to ensure these families receive the benefits they\u2019ve more than earned.\u201d\n\nResearch has shown that repeated exposure to coal dust and other materials puts miners at risk of developing black lung disease. Inhaling dust on the job scars the lungs, impairs breathing, and other respiratory complications that can have life-altering consequences and lead to disability and death.\n\nThe Black Lung Benefits Act of 1972 makes those disabled by black lung due to occupational exposure eligible for monthly payments and medical benefits. The miner\u2019s surviving dependents are also able to claim benefits in the event of a miner\u2019s death. However, under current law, the burden is on the survivor to prove that black lung substantially contributed to the miner\u2019s death, despite many of these families facing significant grief and economic insecurity.\n\nThe Relief for Survivors of Miners Act would fix these barriers to benefits to ensure families of miners are properly compensated. Specifically, the legislation:\n\nRe-establishes a pre-1981 \u201crebuttable presumption\u201d that a miner who died from respiratory-related conditions had died due to black lung if the miner was previously disabled due to black lung.\n\nImproves legal representation by paying attorney\u2019s fees and medical expenses incurred during the claim process.\n\nRequests a Government Accountability Office report on the financial impact of these payments and other ways to improve the claims process and benefits for survivors.\n\n\u201cMiners from Northeast Pennsylvania \u2013 and across the country - have made tremendous sacrifices to power our nation, and the families of miners who lost their lives to black lung disease deserve our support,\u201d said Rep. Cartwright. \u201cThis bill is critical to removing the unwarranted red tape preventing families from receiving the benefits they deserve and will expand resources to help families secure the support they need.\u201d\n\n\u201cWhen a miner dies, their families are left not only grieving and planning a funeral, but they also often lose the benefits they relied on for groceries and paying the bills.\u201d said Vonda Robinson, Vice President of the National Black Lung Association. \u201cThe Relief for Survivors of Miners Act will make their lives a little easier, and help to make sure that families are not left in poverty after their loved ones die.\u201d\n\n\u201cThe UMWA has been at the forefront of battling black lung disease for more than fifty years,\u201d said Cecil E. Roberts, International President of the United Mine Workers of America. \u201cEnacted by Congress in 1969 as part of the Federal Mine Health and Safety Act, the black lung benefits system has been helpful to thousands of miners and their families. But more needs to be done. The cost of living has dramatically increased since 1969, miners are contracting the disease at younger ages and there are more severe forms of the disease. Unfortunately, the number of families experiencing homelessness is on the rise nationally.] We write to request information from your agencies so we can work together to improve federal programs to better serve vulnerable families.\n\nThe Low Income Housing Tax Credit (LIHTC) and Section 8 Housing Choice Vouchers are our largest programs to secure housing stability for vulnerable Americans. It is essential that all our federal housing programs, but especially LIHTC and Section 8, directly serve the needs of low-income families. There is a potentially concerning trend of fewer families with children accessing stable housing through federal assistance, especially LIHTC and Section 8 vouchers. The database on the Department of Housing and Urban Development\u2019s website shows that the percent of people with children in subsidized housing nationally has fallen to 33 percent, which is the lowest percentage in a decade and an overall decline of eight percent from 2010. According to research from the Center for Budget and Policy Priorities, the number of families receiving rent assistance fell by 250,000 or 13 percent from 2004 to 2016.\n\nAlthough Congress has not provided needed investments to expand federal housing programs to fully meet the demands of our housing crisis, we remain concerned about fewer and fewer families with children being served by these programs. We ask that you provide responses to the following questions:\n\n1. Do your agencies have data showing how many new families are being accepted in federal housing programs?\n\na. Please provide a breakdown of information about families\u2019 access to developments subsidized by the Low Income Housing Tax Credit and Section 8 Housing Choice Vouchers.\n\n2. The investigators uncovered numerous violations, including 305 minors working illegally and two 10-year-old children working as late as 2:00 a.m. Despite the best efforts of the hardworking federal investigators, reports of child labor have continued to make headlines while staffing shortages at the Wage and Hour Division remain pertinent due to underfunding.\n\nThis legislation improves the pipeline, capacity, and resources into the Department of Labor\u2019s Wage and Hour Division (WHD) and Occupational Safety and Health Administration (OSHA). The doctor said everything looks so good, don't come back for another month. The next day, my wife called me laughing from work and she said, \u201cyou're not going to believe this \u2014 I just peed my pants\u201d. And the next call, she called crying from the emergency room and she said \u201cmy water broke\u201d.\n\nAnd we couldn't be cared for at the hospital where we were \u2014 they didn't have a level of NICU high enough for us and we were transported to a different hospital in an ambulance. We didn't leave for 109 days. And our babies were born fortunately at 26 weeks and had gotten some of the surfactant, some of the things we know help these premature babies, but they were a half and a pound and 15 ounces, respectively.\n\nWe went through the ventilator, we went through all the pumping stories, we had to use other people's freezers \u2014 it makes me think about all the things you have to go through. But even then with these such fragile, fragile human beings, they got one cc of breast milk over eight hours delivered through a hydraulic arm because they can't tolerate it and then they have to grow. And you can't change the caloric content of breast milk. And we know with premature babies that if you're using a cow supplement, a bovine supplement, to up the caloric count of that breast milk \u2014 it has terrible consequences for preemies. And we know the advantages of human fortified breast milk.\n\nSo we found out about that and in Kentucky, insurance wouldn't cover it. And so we fought and we fought and we fought to try and get our babies out of the hospital just as any parent would do. And it makes me realize the way policy interacts with this because when you're sleeping in a hospital chair, you say a lot of prayers and you make a lot of promises.\n\nAnd one of the promises I made, I said if we ever get out of here, we're going to do something about this. I didn't know what but we'll do something to help. And a year later I ran for the state senate and passed the first insurance mandate in Kentucky history where we mandated the coverage of human fortified breast milk for premature babies. So raising this awareness, getting people to understand what goes on, to know the humans behind these stories, the successful outcomes. It is up to all of us to ensure that those public servants have the tools, resources, and support they need to carry this mission through. As you know, a shortage of bus drivers and fiscal constraints have plagued schools across the country. Jefferson County Public Schools has lost a third of its bus drivers since before the COVID-19 pandemic. This bus driver shortage, in addition to other salient factors, led to a bus fiasco on the first day of school at JCPS with long delays and logistical potholes.\n\nLike many JCPS parents, I sent my son on a bus for his first day at a new school, and he didn\u2019t get home until after dinner. Some kids weren\u2019t picked up at all or didn\u2019t get home until nearly ten o\u2019clock at night, leading to worried parents and hungry kids. Every parent deserves to send their kids to school with peace of mind that they\u2019re being taken care of and will come home safely. Let me be clear: our school bus drivers and our JCPS faculty and staff went above and beyond in ensuring that these kids got home safely despite the challenges that arose. Nevertheless, we cannot allow this to happen again.\n\nAs the dust settles and students begin to return to the classroom, I will continue to monitor ways we can best uplift and support our school system. All of the color drained from her face. She looked up at me and said, \u201cOh no, which school was it?\u201d Then, the next day, when my wife was dropping our kids off at elementary school, Clara told her, \u201cHey Mommy, please be safe at work today.\u201d\n\nBreaks your heart. It\u2019s devastating. As if the senseless, constant loss of life day after day after day after day weren\u2019t enough, knowing that our kids are living with this very real fear is awful.\n\nBut of course they\u2019re afraid. Why wouldn\u2019t they be afraid? Gun violence is the number one cause of death for children in this country. Think about that. More kids die from gunshots than anything else in this country \u2014 and what do we get? Thoughts and prayers, excuses and political posturing that ensure a troubled individual with destructive thoughts can go and buy a weapon of war in a moment\u2019s notice.\n\nThis morning, we learned that the shooter at Old National Bank was seeing a psychiatrist for suicidal ideation, and walked in and within 40 minutes, had purchased an AR-15 and the ammunition to go with it. Six days later, it took him less than four minutes for him to shoot and kill five of his coworkers, injure seven others, and for the police to come and he fired upon them. The shooter\u2019s parents spoke out, and they said we\u2019re doing nothing and it\u2019s not working. The victims\u2019 families have said that we\u2019re doing nothing and it\u2019s not working.\n\nDr. Jason Smith, Chief Medical Officer and Trauma Surgeon who was on call that day in Louisville, has said that we\u2019re doing nothing and it\u2019s not working.\n\nWe must do something. As part of the first freshman class serving in Congress post-January 6th, I join my Democratic colleagues in their efforts to ensure our democracy works for everyone. As we remember January 6th, I am grateful to the brave officers who protected the Capitol, and my thoughts are with the loved ones of the five police officers who lost their lives. Nothing should ever interfere with the peaceful transfer of power, and all those involved in the planning and execution of this deadly insurrection should be held accountable.
