In order to qualify for 501(c)(3) status, nonprofits and houses of worship cannot engage in tax-exempt political speech. Despite widespread support for the Johnson Amendment among thousands of nonprofits and houses of worship, the Trump Administration reversed course on a lawsuit targeting the Johnson Amendment in an attempt to exempt two churches from complying with the law.\n\n\u201cCongress has considered and rejected multiple attempts to modify the Johnson Amendment,\u201d the lawmakers wrote. \u201cMembers have long understood the moral imperative of shielding nonprofit service organizations, including houses of worship, from electoral politics while protecting taxpayers from being compelled to subsidize political speech. Your Proposed Consent Decree is nothing more than a transparent end-run around Congress, which has consistently rejected attempts to change this 70-year-old law.\n\n\u201cThe Proposed Consent Decree seeks to exempt two specific organizations favored by the government out of the more than 1.5 million 501(c)(3) organizations in the United States from following the law,\u201d the lawmakers continued. They noted that the reasoning in the proposed settlement \u201cblows the door wide open for both secular nonprofits and all other religious organizations to petition the courts for their own free pass to engage in tax-exempt electoral speech. Lewis, an ordained Baptist Minister and hero of the Civil Rights Movement, issued a moral call to his colleagues on November 8, 2017:\n\n\u201cFifteen years ago\u2026Democrats and Republican came together to preserve the last remaining sanctuary that was free from partisan politics. In our heart of hearts, we understood that we had a moral responsibility to put the good of our nation before campaigns. My friends, we need that vision and unity again today.\u201d\n\nCongressman Lewis was defending the Johnson Amendment\u2014a foundation stone in the nation\u2019s wall of separation between church and state and a shield for tax-exempt organizations\u2019 integrity\u2014as the House Committee on Ways and Means considered an ultimately unsuccessful attempt to demolish it. In this same spirit, we are writing to express our serious concerns regarding the settlement that the Internal Revenue Service (IRS) has proposed in the matter of National Religious Broadcasters Association et al v. Bessent.\n\nThe Proposed Consent Decree asks the Court to exempt two religious organizations from obeying the law by reinterpreting the verbs \u201cparticipate\u201d and \u201cintervene\u201d and classifying communications from houses of worship to their congregations as compliant with the Johnson Amendment without any accompanying explanation for that classification. This reinterpretation is not permissible under the statute as enacted and sustained by Congress; presents serious constitutional concerns as a potential violation of the Equal Protection Clause; fails to disclose any fiscal effects of reinterpreting the law; and sidelines the principled and compelling opposition expressed by thousands of nonprofits, houses of worship and faith-based organizations that would be harmed by adopting this proposal.\n\nCongress was in the process of modernizing the tax code in 1954 when then-Senator Lyndon Baines Johnson offered a provision clarifying reasonable boundaries between electoral politics and tax-exempt activities, including religious exercise. It was so noncontroversial at the time that Congress incorporated the Johnson Amendment without extended debate and Republican President Dwight D. Eisenhower signed it into law. Congress has considered and rejected multiple attempts to modify the Johnson Amendment because, as Congressman Lewis noted, Members have long understood the moral imperative of shielding nonprofit service organizations, including houses of worship, from electoral politics while protecting taxpayers from being compelled to subsidize political speech. Your Proposed Consent Decree is nothing more than a transparent end-run around Congress, which has consistently rejected attempts to change this 70-year-old law.\n\nAs explained in a letter sent to then-Commissioner Billy Long on July 18, 2025, the Proposed Consent Decree seeks to exempt two specific organizations favored by the government out of the more than 1.5 million 501(c)(3) organizations in the United States from following the law. In exempting two religious entities in terms limited to religious activities, the IRS is creating an Equal Protection Clause violation which could spread as organizations seize upon this Proposed Consent Decree to sue for their own exemptions. The settlement\u2019s reasoning blows the door wide open for both secular nonprofits and all other religious organizations to petition the courts for their own free pass to engage in tax-exempt electoral speech. This settlement radically reinterprets the law and creates another opening for political actors to use charitable nonprofits to anonymously funnel unlimited money into elections.\n\nThe Proposed Consent Decree also fails to acknowledge the potential costs of implementing this ill-judged settlement. The Congressional Joint Committee on Taxation evaluated the Johnson Amendment repeal measure that Congressman Lewis opposed in 2017 and determined that such legislation would cost taxpayers $2.1 billion over 10 years. While the ultimate cost of the Proposed Consent Decree would ultimately depend on the extent of the exemptions granted, we are concerned that there will be very real costs to taxpayers if more nonprofits are able to engage in electoral activity. Under current law, political donations are subject to federal and state taxes. If this Proposed Consent Decree takes effect, contributions could be redirected from taxable sources to the churches covered by the settlement to become newly tax-deductible, with more to follow if and when other religious organizations and nonprofits seek the same allowance. The result would be reduced federal revenue. If you have prudently estimated the potential costs of this settlement and its aftermath, we urge you to publicize the results of your calculations.\n\nWe are also concerned that your Proposed Consent Decree would harm the many religious institutions and people of faith who oppose weakening the Johnson Amendment. During previous attempts to weaken the law, more than 4,600 faith leaders, 5,800 nonprofit organizations and 106 religious and denominational organizations expressed strong and principled opposition. Faith leaders across religious denominations united across their differences to affirm that \u201cfaith leaders are called to speak truth to power, and we cannot do so if we are merely cogs in partisan political machines.\u201d If this decree weakening the Johnson Amendment shield goes into effect, houses of worship in which the clergy and congregation wish to remain apolitical could be pressured to engage in taxpayer-subsidized electoral politics by elected officials, candidates or donors. Such an outcome would be highly detrimental to religious freedom in America.\n\nThe First Amendment protects religious communities in two different ways\u2014through the Establishment Clause, which prevents the government from imposing or endorsing one or more religions, and the Free Exercise Clause, which protects every person\u2019s right to worship in whatever manner they choose. The IRS should reject the false tension that the religious Right has tried to create between these two principles. The Religious Free Exercise and Establishment Clauses are equally essential, and they stand best when they stand together. The Broadband Equity, Access, and Deployment (BEAD) program was established by Congress in the Bipartisan Infrastructure Law to provide high-quality, affordable, and sustainable broadband to connect the nearly 25 million Americans that continue to wait for high-speed internet access. We urge you to ensure that states receive the full funding and flexibility they retained prior to the issuance of the restructuring notice to fully meet these statutory objectives.\n\nThe broadband division of the Bipartisan Infrastructure Law begins with this congressional finding: \u201cAccess to affordable, reliable, high-speed broadband is essential to full participation in modern life in the United States.\u201d This fundamental reality is why the BEAD program was established to fulfill the subsequent finding that \u201cthe benefits of broadband should be broadly enjoyed by all.\u201d To achieve this goal, the statute states that funding recipients must \u201censure coverage of broadband service to all unserved locations\u201d before using any funds for other purposes. The restructuring notice appears to violate this requirement by allowing applicants to exclude certain unserved locations. Such an allowance would defy bipartisan congressional intent, which was predicated on the understanding that public investment was needed to achieve universal service precisely because building the infrastructure to cover many rural areas was too costly to be profitable.\n\nIn addition to excluding unserved, predominantly rural locations, the restructuring notice would likely result in others receiving worse service. The Bipartisan Infrastructure Law requires that \u201cpriority broadband projects\u201d funded by the program be \u201cdesigned to provide broadband service that meets speed, latency, reliability, consistency in quality of service, and related criteria as the Assistant Secretary shall determine; and [to] ensure that the network[s] built by the project[s] can easily scale speeds over time to meet the evolving connectivity needs of households and businesses, and support the deployment of 5G, successor wireless technologies, and other advanced services.\u201d Of currently available technologies, fiber-optic networks are faster and more reliable and can scale speeds much more easily. We made the decision to invest larger sums now in broadband infrastructure that would be resilient and capable of meeting Americans\u2019 growing digital demands for decades.\n\nThe restructuring notice also undermines the Bipartisan Infrastructure Law\u2019s provisions designed to ensure that broadband service is affordable and put to good use. The new rules remove specific requirements that ensured that participating providers would provide a low-cost internet option for low-income customers as required by the statute. Additionally, while the Bipartisan Infrastructure Law specifically allows funds to be spent on \u201cbroadband adoption, including programs to provide affordable internet-capable devices,\u201d the notice rescinds approval of previously approved \u201cnon-deployment activities\u201d and puts all funding for these activities on hold. For example, this provision of the notice puts on hold a South Carolina plan to use BEAD program funds for virtual primary health\u2014equipping low-income households in rural health deserts with access to the full suite of virtual health services at no cost to the patients. If the broadband infrastructure being built by BEAD program funds isn\u2019t put to good use, much of the investment will have been wasted.\n\nAs reflected in the Bipartisan Infrastructure Law\u2019s congressional findings, high-quality internet access is a requirement to fully participate in the world, and the BEAD program is our once-in-a century opportunity to finish closing the digital divide. We fear this opportunity would be squandered by the restructuring notice and its changes to coverage, quality, and affordability. This growth isn\u2019t being fueled solely by our \u201csmiling faces and beautiful places.\u201d South Carolina is retaining our workforce and attracting new talent thanks to historic private capital investment fueled by President Biden\u2019s legislative initiatives.\n\nBiden\u2019s Inflation Reduction Act (IRA) and CHIPS and Science Act are making landmark investments in renewable energy, electric vehicles, semiconductor manufacturing, and research into emerging advanced technologies. Companies have invested, on average, twice as much in South Carolina under President Biden ($8.3 billion a year) than under President Trump ($3.9 billion a year). Nearly 55,000 new jobs have been announced. In fact, five of the six largest investments in South Carolina over the past four years are by companies that benefit from IRA incentives.\n\nIn addition to becoming a national hub for the EV industry, South Carolina is poised to lead in alternative energy technologies, thanks to its designation as a Tech Hub under the CHIPS and Science Act and subsequent $45 million award. South Carolina\u2019s SC Nexus initiative will spur research into new clean energy technologies and create 14,000 new jobs across the Upstate and Midlands.\n\nMany of these new investments are still being developed and only half of the Bipartisan Infrastructure Bill\u2019s funds have been allocated. But the effects of President Biden\u2019s leadership are clear \u2014 during the last four years, South Carolina\u2019s economy experienced its fastest growth rate since the Clinton Administration.\n\nIt cannot be understated how much President Biden has done to make our nation\u2019s greatness accessible and affordable for South Carolina\u2019s families; capping insulin for Medicare patients at $35 per month, approving student loan forgiveness for over 5 million borrowers, and removing medical debt from people\u2019s credit score to make it easier to purchase a home or take out a small business loan.\n\nPresident Trump assumed the presidency promising to repeal the Inflation Reduction and the Affordable Care Acts, and eliminate the Departments of Energy and Education. These short-sighted actions would be a disaster for our state and nation. Electric vehicles and clean energy technologies are industries of the future.
