Our bill protects independent contractors, franchisees, entrepreneurs, and anyone seeking flexible work options.\n\nAmong its many provisions, the Employee Rights Act would codify the common law definition of an employee, allowing independent contractors to keep the flexibilities they currently enjoy.\n\nI sent a letter to Labor Secretary Marty Walsh this summer, urging him in no uncertain terms to uphold the rule issued during the Trump administration which specifically protects the flexibilities that independent contractors want and need.\n\nIf you aren\u2019t an independent contractor, you may wonder why this is such a big deal. Let me tell you why. If the Biden administration succeeds in scrapping the independent contractor model, we'd be giving the federal government authority to dictate how Americans earn their living.\n\nOr, at the very least, we'd be allowing the government to eliminate a perfectly valid career path that's lifted millions of people out of poverty, grown wealth substantially in this country and helped them accomplish the American dream.\n\nThe modern workforce is entrepreneurial, and our government should facilitate that spirit, not crush it under the weight of bureaucracy. In a downturn economy, this would be disastrous for our states\u2019 farmers, ranchers, and fruit and vegetable growers, often short-handed to harvest specialty crops.\u201d\n\n\u201cThis unsustainable and unrealistic increase will have disastrous effects on our farmers and growers \u2014 in addition to the burdensome costs passed down to consumers already battling soaring inflation,\u201d said Clyde. \u201cMy home state of Georgia alone faces an unprecedented 14% one year increase, detrimentally harming our agricultural production and unquestionably benefitting foreign competitors. I strongly urge Secretary Walsh to put American farmers, rural communities, and consumers first by retracting the recommended wage raise hike for H-2A workers.\u201d\n\n\u201cYear over year, the Adverse Effect Wage Rate proves to be the biggest driver of cost increases and unpredictability in the H-2A program. These increases continue to threaten the livelihoods of our farmers. We urge the Department of Labor to take decisive steps to improve and stabilize the AEWR,\u201d said American Farm Bureau Federation President Zippy Duvall.\n\n\u201cGA farmers produce over 30 different fruit and vegetable commodities and all require intensive hand labor. Our only dependable labor source is through the H2-A program but this excessive wage rate increase will only result in fewer jobs being offered in Georgia. This increase will ultimately drive more jobs to our foreign competitors while making our country more reliant on foreign suppliers and harming our nation\u2019s ability to feed itself. Rising wage rates are a reality that our growers expect and plan for but a 14%, one year increase is unsustainable. We must find a way to develop a program where growers are not waylaid by double-digit increases year over year,\u201d said Chris Butts, Vice President of the Georgia Fruit and Vegetable Growers Association.\n\n\u201cWe appreciate all of the hard work that has been devoted to this extremely important issue for Georgia agriculture from Congressman Clyde and his staff. The impact of a 14% wage increase in a single year for H-2A workers in Georgia will be devastating to Georgia\u2019s farmers and will remove over $100 million from Georgia\u2019s rural economy. This shock comes as farmers are already facing record high input costs and a much smaller share of the food dollar. Any robust program to meaningfully bring financial relief to patients at the prescription counter must address the root cause of skyrocketing drug prices \u2014 pharmacy benefit managers (PBMs)...\n\nPBMs are middlemen between pharmaceutical manufacturers, pharmacies and health insurers. They artificially spike prices, emboldened by a lack of transparency in the drug pricing chain, without providing any value to consumers. The biggest three PBMs, which account for almost 80% of the nation\u2019s prescriptions, are owned by health insurers, creating a massive conflict of interest.\n\nPBMs dramatically inflate drug prices by demanding huge rebates from manufacturers in return for placement on insurers\u2019 lists of covered medications known as formularies. Since 2006, when PBMs took a more active role in the market, drug prices have increased by 313%. Annual rebates now exceed $200 billion, approaching half of the country\u2019s prescription drug market.\n\nIn 2020, total gross expenditures for branded medications reached $517 billion. In an ironic and careless twist, this legislation punishes one of Georgia\u2019s largest employers and local providers of electric vehicles (EV), Kia Motors.\n\nWhen Senators Warnock and Ossoff wrote and voted for this bill, they purposefully disadvantaged global automakers, like Kia, with a manufacturing presence in Southern, conservative states and prioritized automakers in Northern, unionized states.\n\nThe bill subsidizes wealthy taxpayers, who purchase $80,000 electric vehicles, by modifying the plug-in vehicle tax credit to a \u201cclean vehicle\u201d tax credit valued at up to $7,500. These subsidy modifications eliminate the manufacturing cap on the number of EV sales eligible for the tax credit and increase the base credit to $3,750. It is a convoluted formula for the credit that applies to automobiles manufactured in Mexico, Canada, or the United States of America, but does not apply to many of the most affordable and popular electric vehicles sold in America.\n\nSo, the Inflation Reduction Act removes the tax credit for many of the most economical electric vehicles, such as those made by Kia, putting their customers and Georgia\u2019s economy at a disadvantage. Last week, when President Joe Biden signed the bill into law, he literally signed away Kia\u2019s customers\u2019 eligibility to receive the full amount of the tax credits that they were eligible for up until 3 weeks ago, and both of Georgia\u2019s Senators voted for it.\n\nKia\u2019s parent company, Hyundai Motor Group, has pledged to invest $5.54 billion in opening an electric vehicle plant and battery manufacturing facility in Bryan County, Georgia, bringing over 8,500 jobs to our state. While they plan to break ground soon and begin production in the United States once the facility is constructed, they cannot meet the changes in policy overnight.\n\nBoth Kia Motors in West Point, Georgia, home to 2,700 Georgia employees, and Hyundai Motors in Montgomery, Alabama, have plants in the United States that produce thousands of vehicles that are exported all over the world. While we all want to combat China\u2019s influence over critical minerals and battery components, manufacturers with a strong commitment to the United States, and who were originally eligible for the EV credit, should have received a waiver to give them time to comply with the changes. This legislation disrupts automotive manufacturing businesses in Georgia, harms Georgia\u2019s workforce and hurts Georgia\u2019s economy.\n\nInstead of doing their job and ensuring that the legislation was not detrimental to our state before voting for it, Senators Warnock and Ossoff simply did what Chuck Schumer, Nancy Pelosi and President Biden ordered.
