While I’m supportive of this action, due to this Administration’s gross incompetence, it is forced to delay implementation of a law that the Department of Treasury recommended Congress pass and President Biden signed into law himself. This action is inadequate, as tens of millions of taxpayers are still left in limbo as the courts will need to decide the legality of this action from the Biden Administration. Congress must act immediately to enshrine the former $20,000 and 200 transaction threshold into law permanently.”

“This very provision was included in the American Rescue Plan that was passed with only Democrat support two years ago," said Senator Shelley Moore Capito. "Republican efforts to repeal these new requirements have been ignored by my Democrat colleagues until the past week when they realized the massive complications that would ensue this tax filing season. I am glad that the IRS moved to issue the exact one-year delay I have been pushing for by offering an amendment this week to delay for a year, but I am concerned about what authority they have to enforce their delay and will continue working to find a lasting solution."

"The Biden Administration is backpedaling to protect Democrats from the consequences of their own actions," said Grover Norquist, President of Americans for Tax Reform. "This likely illegal action from Joe Biden's IRS is clearly politically timed, coming just one day after Senate Democrats blocked a Republican amendment to delay the new 1099-K thresholds. Congress must provide certainty to taxpayers by acting early next year to permanently restore the prior threshold of $20,000 and 200 transactions."

Background:

Over the past two years Congresswoman Miller has worked to fix this unbearable Democrat-created tax on working class West Virginians.

In May of 2021, Congresswoman Miller introduced the Saving Gig Economy Taxpayers Act, which would repeal an unnecessary tax hike included in the costly and partisan American Rescue Plan. The bill would protect everyday Americans using online payment platforms, gig economy workers and small e-commerce sellers from being taken advantage of, and ensure they continue to have access to flexible and reliable income streams.

Last week, Congresswoman Carol Miller (R-WV) and Senator Shelley Moore Capito (R-WV) introduced the Emergency Taxpayer Paperwork and Audit Relief Act, to delay the implementation of the Democrat budget gimmick in the American Rescue Plan that lowers the threshold for Americans to receive a 1099-K form from the IRS for an additional year. Before this law change, a taxpayer would have to earn at least $20,000 and have at least 200 transactions to qualify for a 1099-K form if they made money through an e-commerce platform or worked as an independent contractor through a gig economy app. Congressional Democrats expanded this by eliminating the 200 transaction requirement entirely and lowering the $20,000 hurdle to just $600 in the American Rescue Plan Act of 2021.

Today, the Internal Revenue Service (IRS) announced a delay in the implementation of the 1099-K reporting requirement for one year. They did not state where the IRS receives the authority to usurp the direction of Congress on the implementation of tax policy.

Democrats in Congress have refused to acknowledge the problem they created or negotiate a solution and it is now up to the Republican-led House of Representatives to fix this issue next year.

Senator Shelley Moore Capito Background:

Senator Capito is a cosponsor of the Stop the Nosy Obsession with Online Payments, or SNOOP Act, legislation to strike the tax code provision inserted by in the American Rescue Plan that requires third-party payment platforms to report businesses’ gross transaction volumes totaling more than $600 to the IRS. Senator Capito is also a cosponsor cosponsored S. 4817, which would prevent the IRS from using any of the $80 billion included in the Inflation Reduction Act funding to conduct audits of taxpayers making less than $400,000. Recently, Senator Capito supported an amendment which would have repealed the reporting threshold.

###", 1, "2026-03-30T01:40:41Z", "2026-04-08T03:32:05Z"], ["https://miller.house.gov/media/press-releases/miller-capito-introduce-emergency-bill-save-west-virginia-taxpayers", "Miller, Capito Introduce Emergency Bill to Save West Virginia Taxpayers", "2022-12-16", "2022", "2022-12", "Republican", "House", "WV", "Carol D. Before this year, the threshold was $20,000 and 200 separate transactions. The Democrats lowered this to $600 with no transaction minimum to claim they paid for their out of control spending package, essentially raising billions of dollars in taxes on working class Americans and overloading the IRS with additional paperwork. This bill will allow the Republican-controlled House of Representatives more time to raise this threshold and prevent 30 to 50 million new forms from being sent out next month.

“Democrats in Congress have failed the American people by ignoring an issue they created to fund their ridiculous spending bills,” said Congresswoman Carol Miller. “I introduced the Saving Gig Economy Taxpayers Act in May of 2021 to restore the threshold to levels that were working just fine before Democrats complicated the system and gave taxpayers new headaches. Democrats refused to negotiate a compromise to fix this issue over the last year, meaning tens of millions of taxpayers will receive an unexpected 1099-K form from the IRS in January if a solution is not found by December 31st. The Emergency Taxpayer Paperwork and Audit Relief Act that I introduced today with Senator Capito will delay the implementation of the Democrat’s onerous reporting requirements for one year, giving a Republican-controlled House of Representatives time to fix the issue that Democrats refuse to address and saving West Virginia taxpayers from the pain of inept Democrat governance.”

“The Democrats’ so-called ‘American Rescue Plan,’ which contributed largely to our high inflation economy, also included a new tax liability for tens of millions of Americans starting this upcoming filing season,” said Senator Shelley Moore Capito. “If Democrats who voted for the American Rescue Plan get their way, you may now be facing additional taxes because you received money from friends or family through payment apps like Venmo and Paypal, or sold tickets to a concert or sporting event. It would also give the government access to any information regarding transactions exceeding $600, regardless of intent. My legislation would immediately delay the implementation of this burdensome and intrusive change to our tax code, and protect West Virginians from unnecessary oversight from the federal government.”

"Biden and Democrats thought they could come after Americans' PayPal and Venmo transactions without anyone noticing. People noticed," said Grover Norquist, President of Americans for Tax Reform. "This bill will prevent millions of taxpayers with more than $600 in transactions from third-party vendors from being told by Biden's IRS that they have a new tax liability this year. Thanks to the leadership of Rep. Miller and Sen. Capito, Republicans will have an additional year to implement a permanent fix to Democrats' failed policies."

“The $600 threshold for 1099-K information reporting is bound to confuse scores of taxpayers next year who participate in the digital economy, even for non-taxable transactions such as selling used items online at a loss," said Andrew Lautz, Director of Federal Policy, National Taxpayers Union. "Neither taxpayers nor the IRS are prepared for the deluge of paperwork, which is why NTU is glad to support Rep. Miller’s and Sen. Capito’s efforts to delay these reporting requirements for a year. This will buy Congress more time to work out a solution that ensures taxes owed are taxes paid while still limiting taxpayer confusion and paperwork burdens.”

“Small businesses that utilize third party payment platforms will soon be inundated with new paperwork as a result of the expanded Form 1099-K reporting requirements," said Kevin Kuhlman, Vice President of Federal Government Relations at National Federation of Independent Businesses. "NFIB opposed this expansion since it was buried at the last minute into the American Rescue Plan Act. The increased reporting will further complicate the already difficult tax compliance burden small businesses and individual filers face. Given the tight timeline as this Congress concludes, NFIB thanks Congresswoman Carol Miller and Senator Shelley Moore Capito for pushing to delay the reporting requirement for a year to provide more time to increase the thresholds and reduce the paperwork burden on small businesses. NFIB urges Congress to include this delay in the government funding legislation.”

Background:

Before the law change, a taxpayer would have to earn at least $20,000 and have at least 200 transactions to qualify for a 1099-K form if they made money through an e-commerce platform or worked as an independent contractor through a gig economy app. Congressional Democrats expanded this by eliminating the 200 transaction requirement entirely and lowering the $20,000 hurdle to just $600 in the American Rescue Plan Act of 2021.

An American getting rid of old exercise equipment from his garage online now qualifies as a salesman of workout equipment, a teenager babysitting the neighbors’ kids is in the childcare business, and roommates who split rent are now property managers. According to Democrats law change in the 1099-K form, all of these people are eligible to be unfairly taxed and will be more likely to be audited by the IRS.

Congresswoman Carol Miller previously introduced H.R. 3425, The Saving Gig Economy Taxpayers Act, which will return this threshold to the time tested standard. It has the support of every Republican on the House Ways and Means Committee. At the state and federal levels, we must push back against these radical policies, protect Americans' retirement savings, and empower our energy industry."

"The Employee Retirement Income Security Act (ERISA) is supposed to protect retirement investment plans by requiring plan managers to be subject to fiduciary responsibilities," said Rep. Greg Murphy, M.D. "However, the Biden administration's proposed changes to ERISA abandon fiduciary responsibility by allowing 'woke' ESG factors to dictate investment returns – putting Americans' retirement savings at risk. In fact, funds with a higher rating saw a loss of 13 percent on average last year. This must change.

Southeast Asia is diverse. The nations range from highly developed Singapore to rapidly developing Cambodia to deeply troubled Myanmar. Laos and Vietnam have not shed the vestiges of authoritarianism remaining from their communist days, and Thailand once again has fallen into functional military rule.

While we enjoyed a productive visit to Singapore, much of our focus was on Cambodia. These are two very different countries that delivered to us a consistent message: China is outmaneuvering the United States in this region with investments, loans, trade and exchanges. This is China’s backyard. It has natural advantages of geography, history and culture, and it has been cultivating this region for many years.

Our first impression was the people of Cambodia – their warmth, sincerity, and desire to advance on the world stage. The leaders in these countries told us they prefer a stronger American presence, which they see as a necessary counterweight to China.

They respect and admire the United States. They follow trends in the United States. They send their children to study in the United States. They like the way American companies do business. However, they also told us that they will accept investment and trade from whomever offers it on favorable terms. Our allies in the region—including Japan, South Korea and Australia—are investing and trading there, but they cannot carry our interests.

The United States has many interests in this critical region, and they aren’t all economic. We want to foster greater freedom and openness, both in general principle and as a barrier against Chinese Marxist-Leninist influence. Vietnam and Laos have yet to move away from their communist past.

Cambodia is emerging as a new nation and is advancing rapidly. Over the past 30 years, it has rebuilt its society from the ground up after the heartless genocide of their population.

The United States must work with these countries over the long term to develop and strengthen economic and political ties and to foster common values. Trade and investment open the door for greater influence and American democratic values that will translate into greater freedom and prosperity for them.

There are many opportunities for American business in Cambodia, including construction, manufacturing, food processing and other endeavors. We are equipped to meet Cambodia’s demand for energy, particularly cleaner generation offered by LNG and hydropower.

Cambodia is looking to take its place among advanced developing countries. More trade and investment will lead to prosperity and a greater chance to foster the kinds of freedoms that have been the basis of our strongest alliances for decades.

We can take several steps to start moving along this path. First, we need to reauthorize the importation of a broad range of qualified goods under the Generalized System of Preferences (GSP). This is critical to opening the U.S. market to countries in the Asia-Pacific region. Cambodia needs better access to markets in the U.S., its second-largest trading partner.

The U.S. should move quickly to include Cambodia in the Indo-Pacific Economic Framework for Prosperity (IPEF).

This will tie it more closely to us and our most important allies and developing country partners in the Asia-Pacific region. IPEF can be a launch point for the United States to reenter the Comprehensive and Progressive Agreement for Trans-Pacific Partnership, which features high-standards trade and market access chapters.

Unfortunately the Biden administration has a moratorium on new trade deals and the Indo-Pacific Economic Framework for Prosperity (IPEF) is a pipe dream unless the administration recognizes the role that Congress plays in setting trade policy.

We have the means to make Southeast Asia a key partnership region. This will lead to the expansion and adoption of U.S. values, including the rule of law, human rights, and upward economic mobility.

Free and fair trade, when done well, can lift people out of poverty and provide economic benefits for all countries involved. The U.S. can no longer afford to retreat from the international stage.

A clear presence in the heart of the Indo-Pacific will ensure U.S. interests are well positioned into the 21st Century.", 1, "2026-03-30T01:40:41Z", "2026-04-08T03:20:33Z"], ["https://miller.house.gov/media/press-releases/icymi-congresswoman-miller-talks-american-energy-independence-commitment", "ICYMI: Congresswoman Miller Talks American Energy Independence, Commitment to America, Recent Legislation on Inside West Virginia Politics", "2022-10-03", "2022", "2022-10", "Republican", "House", "WV", "Carol D. I don’t understand why we stop our energy sources when we should be as energy independent as possible. This is just one more kick in the teeth to West Virginia and to our country.”

“[The Mountain Valley Pipeline] needs to be on the front burner. We’ve been struggling with it since Biden first took office. We have to be energy independent. We certainly should learn from Europe on what happens when you’re not. I don’t like living off of reserves quite frankly. They’re there for a reason, but it’s not just to power us. We need to be producing energy.”

On the Commitment to America: “One is that we have an economy that is strong. Fighting inflation. I’ve been wearing a pin for quite a while that says ‘It’s the spending stupid.’ We are spending money that we don’t have hand over fist and America is really suffering. I don’t know if you’ve bought a 2x4 or a sheet of plywood, or maybe you’ve been to the grocery store and bought milk and bacon…It’s time to stop spending and put people back to work.”

“The other is a nation that is safe. I have been to the border and seen how open it is. In our state, in particular, we have a sensitivity to the opioid epidemic and drugs. The fentanyl that is coming through our border – it’s criminal what is happening…We want a country that is safe. We want an economy that’s strong. And we also want a country that’s still built on freedom. We just need to restore the people’s voice in their government.”

On the No Surprises for Survivors Act: “The most horrific thing a woman would experience is rape. They should not have to pay to have a rape kit done on them because that’s part of the procedure for the police department to help them identify that they actually have been indeed raped and that they have the evidence. Specifically, the legislation will ensure patients with private health insurance do not face out-of-pocket costs or surprise medical bills for forensic medical exams, commonly known as rape kits.

The bill is included in a broader package of mental health and consumer protection bills under consideration by the Ways and Means Committee.

“Sexual assault is one of the most abhorrent acts of violence a woman can experience,” said Congresswoman Carol Miller. “It is unacceptable for any sexual assault victim to receive a bill for a forensic medical exam, which is critical to ensuring their recovery and collecting any evidence needed for an investigation. This commonsense, bipartisan legislation will protect victims and ensure no woman who experiences sexual violence has to pay a dime for a forensic medical exam.”

“The last thing a survivor of sexual violence should have to worry about is an unexpected medical bill,” said Congresswoman Gwen Moore. “This legislation is needed because too many survivors, grappling with trauma, also become burdened with the cost of a forensic medical exam – even though they shouldn’t be. Unfortunately, independent analysis and media reports have found that some victims still receive bills for these services and can be left to pay for them out-of-pocket.

The No Surprises for Survivors Act protects victims of sexual violence from out-of-pocket expenses and surprise medical bills by:

Requiring coverage of forensic medical exams with zero cost sharing: The bill requires private insurers to provide coverage, without cost-sharing, for forensic medical exams regardless of where they are administered (unless reimbursed by the state under VAWA).

Protecting victims of sexual violence from certain surprise medical bills: The bill further provides that forensic medical exams are covered under the emergency services protections of the No Surprises Act, regardless of where they are performed.

Facilitating reimbursement, where appropriate, from states: The bill specifies that if an individual receives a forensic medical exam where the state is responsible for the out-of-pocket costs associated with such exam, private insurers must provide appropriate notice to help victims avoid bills and streamline the reimbursement process.", 1, "2026-03-30T01:40:41Z", "2026-04-08T03:08:33Z"], ["https://miller.house.gov/media/press-releases/congresswoman-miller-urges-us-action-trade-taiwan", "Congresswoman Miller Urges U.S. Action on Trade with Taiwan", "2022-09-14", "2022", "2022-09", "Republican", "House", "WV", "Carol D. Congresswoman Miller also highlighted her recent trip with her Congressional colleagues to Cambodia and Singapore, where she witnessed firsthand the urgent need for the U.S. to establish itself as a trade and investment leader in the region in order to combat China’s growing influence.

On Increasing Trade with Taiwan: "I understand the Administration is working on [Indo-Pacific Economic Framework] as well as another separate negotiation with Taiwan. While I am glad that we're beginning to engage in the region, I remain very concerned about the lack of congressional consultation for these agreements. The Constitution grants Congress with the authority to regulate commerce with foreign nations. Without Trade Promotion Authority, any agreement led by the Administration lacks the trade tools necessary to provide true market access to these nations. There are many avenues in which the U.S. can strengthen our trade with Taiwan. I think we have a huge opportunity for U.S.-Taiwan energy cooperation. In 2021, Taiwan imported 97.4% of its energy, and while it is working on decarbonizing its economy, we have another opportunity to work together on carbon capture technology."

On Her Trip to Cambodia and Singapore: "I recently returned from heading a [Congressional Delegation trip] with my colleagues where we visited Cambodia and Singapore. These countries are anxious for U.S. trade leadership in the region. They have industries that want increased access to the U.S. markets, and we need to stand ready to work with them. The story that I heard from across the economic spectrum of ASEAN countries is that the U.S. involvement and American investment is critical to create an open and prosperous region. The United States must take a leadership role with these countries or our competitors will. They'll fill the vacuum if we don't. By not including all countries in the ASEAN regional trade negotiations, we are risking splintering the fastest growing trade bloc in the world."

On Her U.S. Trade Leadership in the Indo-Pacific and China Act: "This bill asserts the United States should play a sustained role in establishing an open, rules-based trading system in the Indo-Pacific, and that the United States should have a long-term strategy for maintaining a balanced trading relationship with China. Without legislation to continue these programs, they will expire September 30, 2022, reducing payments to participating rural hospitals by $0.6 billion. The effect on community health care access would be catastrophic without the continuation of these programs."

Background:

According to the American Hospital Association, Congress established the Medicare-Dependent Hospital (MDH) program in 1987, allowing eligible hospitals to receive the sum of their prospective payment system (PPS) payment rate, plus three quarters of the amount by which their cost per discharge exceeds the PPS rate. These payments allow MDHs greater financial stability and leave them better able to serve their patients and communities. The ARCH Act would extend this important program for five additional years, helping to provide needed financial stability to rural hospitals.

The ARCH Act would also extend the enhanced low-volume Medicare adjustment for five years. Medicare seeks to pay providers their costs of furnishing services. However, certain factors beyond providers’ control can affect the costs of furnishing services. Carol Miller

America faces a two-fold energy crisis – record high gas prices, such as more than $4.00 per gallon in West Virginia, and the potential for rolling blackouts. The answer to both of these problems is to produce more American energy, not less. Our energy crisis is entirely caused by poor policy decisions, but I am confident we can work our way back to energy leadership by implementing smart policy and empowering our energy-producing states, like West Virginia. The energy crisis demands significant action at every level of government and the private sector.

West Virginia is a leader in the coal and natural gas industries, both of which are crucial technologies for keeping American energy reliable and affordable. However, it’s become harder to produce both. America is at an inflection point. We have the opportunity to take the lead on a wider range of technologies that can maintain affordability and reliability while simultaneously helping America lead the world in reducing carbon dioxide emissions. Technologies like carbon capture and clean hydrogen production utilize the natural gas and coal resources we have an abundance of in the Mountain State, while working toward global emissions reduction goals.

In addition to increasing domestic energy production, we must also address this crisis by utilizing the tax code to promote affordability, reliability, and reduced emissions. I am a cosponsor of two key bills that can have a real-world impact on driving down energy costs and emissions while also preserving the key role that fossil fuels hold in our economy.

First, the Energy Sector Innovation Credit (ESIC) is the signal needed to draw emerging technologies into the market. This bipartisan bill, a permanent addition to the tax credit, takes a technology-inclusive approach that encourages private sector innovation and investment in new power sources.

Second, the tax credit known as 45Q rewards companies for capturing and sequestering carbon dioxide. 45Q, according to models from the Rhodium Group, can help lower emissions by a magnitude of pp to 4 gigatons of emission reductions by 2050. This is equivalent to the emissions produced by 29 million cars for 30 years, or more than all the emissions produced from all U.S. coal and natural gas power plants produced over the last two years. It would also strengthen the economy by creating thousands of new construction and operations jobs and encouraging buildout of new carbon capture facilities nationwide. I support a permanent 45Q tax credit as rolled out in House Majority Leader Kevin McCarthy’s (R-CA) Innovation Agenda in 2021.

Congress needs to find ways to work together, across party lines, to create strong policies that work for our economy and the environment. For example, killing America’s coal industry in the name of lowering emissions does nothing for global emissions when Russia, China, India, and much of the developing world continues to build one new coal plant after another.

The most basic way to look at the global energy challenge is to understand that American manufacturing is cleaner. Global industry – China in particular – is much dirtier than U.S. industry. This is an area where America has and can continue to lead.

America has an abundance of opportunities in innovative emerging technologies, which have the potential to create millions of jobs, dramatically lower energy prices, and ensure our grid is reliable.

We need to improve our regulatory and permitting processes, unlock American resources, and leverage innovation. Reliance on China and other authoritarian governments must come to an end. Instead, the U.S. needs to refocus its attention on promoting our domestic mining and production capabilities, along with encouraging the technologies of the future.

This approach is based on the real-world commitments that industry has set forth to put American energy first. In West Virginia, with our strong energy producers and abundant resources, we are in a prime position to continue to support the U.S. as a global energy leader and truly solve the energy crisis.

###", 1, "2026-03-30T01:40:41Z", "2026-04-08T02:59:24Z"], ["https://miller.house.gov/media/press-releases/congresswoman-miller-tours-herbert-hoover-high-school-construction-site", "Congresswoman Miller Tours Herbert Hoover High School Construction Site, Southern West Virginia Community and Technical College", "2022-08-02", "2022", "2022-08", "Republican", "House", "WV", "Carol D. Carol Miller

West Virginia small businesses have been through a lot over the last two years: pandemic closures, loss of sales, worker shortages, supply chain disruptions, skyrocketing inflation, and record high gas prices. Data from the National Federation of Independent Business shows that small business confidence is at a 48-year low. This is concerning, but not surprising. Traveling around my district, I hear from small business owners who are struggling to keep their doors open and the lights on. They’re angry that failed policies mean they can’t find workers and they’re disturbed that President Biden’s Washington is giving them nothing but problems.

As a defender of our small businesses, I was appalled last week to see Senate Majority Leader Chuck Schumer was teeing up a vote on a new small business tax to fund President Biden’s agenda. That’s right – a brand new federal tax for small businesses. The proposal would be a significant tax increase for certain small businesses and is inaccurately being characterized by Senate Democrats as ‘closing a loophole.’ Not a penny of Senator Schumer’s new tax will be paid by large corporations.

Senate Democrats need to come to the conclusion that now is not the time to raise taxes on small businesses. As they grapple with record inflation, the highest in 40 years, we need to support our vulnerable employers, not burden them with more federal taxes. I’m sure many West Virginia small business owners and their employees would be happy to show that they already pay more than their fair share to Uncle Sam.

West Virginia small businesses are the backbone of our economy. Ninety-five percent of our state’s businesses are small, representing nearly half of all West Virginia payroll. These businesses aren’t using a loophole. They’re hanging on by a thread, and they need our help. Now is not the time to throw a new small business tax at them. You just don’t throw money at something and go ‘Well I hope they fix it.’”

On Inflation, Rising Gas Prices, and Biden’s Irresponsible Spending: “The inflation has increased every single month since Joe Biden took [the] presidency, and it’s really their economic crisis. All of the spending that we just keep doing, more and more and more spending. The cost of gasoline is up 48%, lodging is up 25%, baby food is up 10%. Everything is rising, and it’s got to stop. The spending has got to stop.”

Background:

The Special Supplemental Nutrition Program for Women, Infants, and Children (WIC) accounts for about half of all infant formula sales in the United States. Last night, Congresswoman Miller voted for H.R. 7791, the Access to Baby Formula Act. The legislation would require formula manufacturers to submit a plan on how they would protect WIC program participants in the event of a supply chain disruption when bidding for a WIC contract. It would also require coordination between the U.S. Department of Agriculture and the Food and Drug Administration (FDA) to ensure awareness of supply chain issues and to support WIC participants. Lastly, the bill would ensure appropriate guardrails are in place while allowing the Secretary of Agriculture to act quickly and efficiently in an emergency.

Earlier this month, Congresswoman Miller joined her House Republican colleagues in sending a letter to President Biden and FDA Commissioner Robert Califf urging them to immediately address the nationwide shortage of baby formula.

###", 1, "2026-03-30T01:40:41Z", "2026-04-08T02:29:07Z"], ["https://miller.house.gov/media/press-releases/congresswoman-miller-nasa-deputy-administrator-attend-west-virginia-robotics", "Congresswoman Miller, NASA Deputy Administrator Attend West Virginia Robotics State Championship", "2022-05-16", "2022", "2022-05", "Republican", "House", "WV", "Carol D. Parents are understandably frustrated and scared by this shortage. In fact, the formula shortage has reached crisis levels in recent weeks. The share of baby formula 'out of stock across the U.S. hit 40 percent on April 24' and a 'total of 26 states have out of stock rates of 40 to 50 percent.' Notably, CVS, Walgreens, and Target are among the stores putting limits on how much formula customers can buy at one time. This new problem is compounded by the historic inflation caused by the Biden administration that is already burdening families. FAS holds patents on five continents that cover more than 3.7 billion people including the United States and Canada. Frontieras’ FASFormTM streamlines the processing of solid hydro carbonaceous materials and maximizes the energy output in each of its three forms: solids, liquids, and gas. FASForm is extremely efficient, and products can be delivered to market at or below market comparable prices without relying upon any government subsidies or carbon credits.

Frontieras’ patented technology, Solid Carbon FractionationTM (SCF), reforms coal, waste plastics and Hydrogen production by extracting volatiles, moisture, and contaminants. In preparation for breaking ground on its first commercial site, Frontieras constructed a test plant that validated the results using the West Virginia coal as its feedstock. Frontieras’ new SCF process extracts the highest gas and liquid yields to produce material and monetary difference in processing coal for both public and private enterprises.

Frontieras conducted an exhaustive search through Texas, Wyoming and West Virginia before identifying the contracted site. No business or organization should be punished because the IRS can’t do its job efficiently.”

“As a former small business owner, I understand many small business people’s frustrations during this period of economic instability. Many are hurting due to no fault of their own as a result of the pandemic, rising inflation and other factors,” said Congressman Levin. “In a time when divisiveness and disagreement often keeps us apart, one thing I believe we can all come together on is how small business owners and their employees make up the fabric of our communities, and how vital it is that they receive aid urgently. I’m grateful to my colleague Congresswoman Miller for her incredible work on this effort.”

The letter reads in part, “The ERTC was designed to help businesses and nonprofits facing revenue reductions due to the economic uncertainty caused by the COVID-19 pandemic. The conference committee, which includes a select group of Republican and Democrat members from the United States House of Representatives and Senate, is tasked with producing bipartisan, bicameral legislation to address China's growing threat. Congresswoman Miller was chosen for the role by House Republican Leader Kevin McCarthy (R-CA).

"China represents the most significant power competition and geopolitical threat to America that we've seen in decades," said Congresswoman Miller. "The Chinese Communist Party (CCP) has jeopardized supply chains, unleashed a pandemic that devastated our economy, and moved ahead in the global trade arena without any accountability or repercussions. Those days are over. I look forward to working with my conference committee colleagues to produce legislation that meets this critical moment, confronts China's growing threats, and puts U.S. jobs, prosperity, and national security first. It is high time China is served a reality check, and Congress is going to do just that."

"Countering the Chinese Communist threat is the single most pressing issue we can undertake in this Congress. We cannot continue to choose inaction or a weak approach if we want to secure a revitalization of our domestic manufacturing and bring those jobs back to the United States. This Congress cannot bend or bow to China's lobbying efforts. We need strong voices in this process who will put American interests above all else. Always great to have you back at Ways and Means!

As you might be aware, in December 2021, my colleague Darin LaHood and I introduced the U.S. Trade Leadership in the Indo Pacific and China Act. This bill has two main objectives. First, the bill states that the U.S. should play a critical role in the Indo-Pacific through establishing an open, rules-based trading system. Second, the bill also directs USTR to submit a report to Congress that outlines America's long-term trade and economic plan with China.

We are at a critical juncture in our relationship with China. We need to ensure that China is fulfilling its commitments made in the Phase One agreement, and, at the same time, chart a path forward for our long-term engagement with this critical trading partner.

I understand the Administration is in the process of crafting the Indo-Pacific Economic Framework. I think that this is a step in the right direction to engage in this region, particularly now that China has requested to join CPTPP. However, I remain concerned about the Administration moving forward with this agreement without relying on the trade tools provided by Congress. In my view, the result will be both a less ambitious agreement that does not increase market access for our exporters and a less durable agreement that may be reversed or abandoned by future administrations.

We must reauthorize Trade Promotion Authority to ensure we can open markets for American goods and build truly resilient supply chains.

Ambassador Tai, Commerce Secretary Raimondo has made comments about how the Indo-Pacific Economic Framework would not be a traditional trade agreement, nor would it require approval from Congress. Do you agree with this assessment of the agreement?

As you know, our Constitution vest the power to regulate commerce with foreign nations with the Congress. Given that fact, why does the Administration believe it has the Constitutional authority to bind the country to any Indo-Pacific Economic Framework agreement without presenting it to Congress?

Would you agree that for the strongest agreement possible, with the best outcomes for American workers and businesses, that Congress should not only be consulted on such agreements, but approve any agreement through TPA?

###", 1, "2026-03-30T01:40:41Z", "2026-04-08T02:06:17Z"], ["https://miller.house.gov/media/press-releases/pictures-congresswoman-miller-visits-clay-county", "PICTURES: Congresswoman Miller Visits Clay County", "2022-03-21", "2022", "2022-03", "Republican", "House", "WV", "Carol D. In the piece, she discusses how the consequences of these crises are felt not only in America's border states, but in West Virginia.

Carol D. Miller: Biden's Open Border Worsens West Virginia's Drug Crisis

March 13, 2022

President Joe Biden's open-border agenda has resulted in unprecedented national security, humanitarian, and public health crises. Since he took office, over 2 million illegal immigrants have been apprehended at the southern border. I recently traveled to Del Rio, Texas to see firsthand from United States Customs and Border Protection (CBP) officials the situation at the U.S.-Mexico border.

What I witnessed was heartbreaking. Border Patrol agents are overworked and understaffed. Families and children are sitting in detention facilities waiting to be processed. Human smugglers and drug cartels are running rampant, bringing criminals and deadly drugs across the southern border and into our communities and across the nation.

West Virginia has long struggled with the devastating effects of the opioid epidemic. After years of positive progress, the crisis has exploded since the onset of the COVID-19 pandemic and unprecedented lockdowns. The prolonged isolation caused many to turn to drugs. Drug overdoses claimed more American lives last year than ever before. It's projected that overdoses in West Virginia jumped 62 percent last year, and more than 1,600 people died of an overdose.

This epidemic has become deadlier as people turn to potent synthetic opioids like fentanyl. Fentanyl and fentanyl related substances are fueling overdoses. More than 64,000 Americans have passed away between May 2020 and April 2021 from the drug and make up 64 percent of total U.S. overdose deaths. This highly lethal synthetic opioid is 100 times more potent than morphine and 50 times more potent than heroin.

The majority of America's fentanyl is being smuggled across the southern border from Mexico. In Fiscal Year 2021, 11,201 pounds of fentanyl were seized at the southern border, an increase of 134 percent from the previous period. That is enough fentanyl to kill every American seven times over.

My trip to the southern border made it clear that the consequences of Biden's border crisis reach far beyond Texas, New Mexico, Arizona, and California. President Biden may be able to ignore the ripple effects of his border crisis, but West Virginians cannot.

I often think of Kermit, a town of less than 400, where 12 million hydrocodone tablets flooded the town at the height of the opioid epidemic. That's 30,000 pills per man, woman, and child. We all know people who have been personally touched by addiction – whether they're the person in line next to you at the grocery store, sitting next to you in the pew at church, your neighbors or your friends. We have all felt the tragic consequences of this disease.

President Biden MUST secure America's border with Mexico to stop the flow of drugs, before any more lives are lost.

###", 1, "2026-03-30T01:40:41Z", "2026-04-08T02:06:17Z"], ["https://miller.house.gov/media/press-releases/pictures-congresswoman-miller-visits-southern-border-sees-bidens-border-crisis", "PICTURES: Congresswoman Miller Visits Southern Border, Sees Biden's Border Crisis Firsthand", "2022-03-07", "2022", "2022-03", "Republican", "House", "WV", "Carol D. The ERTC was designed to help small businesses and nonprofits rehire and retain employees they had to let go due to the COVID-19 pandemic. It was overwhelmingly supported in the bipartisan Coronavirus Aid, Relief, and Economic Security (CARES) Act passed in March 2020 and has gained support from numerous national small business and nonprofit advocacy organizations.

"By reinstating the ERTC, struggling small businesses and nonprofits can access one of the last remaining pandemic recovery programs to receive the help they need to replenish their workforce and get back on track," said Congresswoman Miller. "As we continue to emerge from this public health emergency, we must remember that small businesses and nonprofits in West Virginia and across the country still need our support. I urge Congressional leaders to pass our bill as soon as possible to give these businesses and employees the certainty they need to keep their doors open."

"Inclusion of the ERTCRA as part of the upcoming spending package is critical for small businesses throughout the nation," said Carla Balakgie, President & Chief Executive Officer, National Automatic Merchandising Association (NAMA). "Employers are experiencing challenges filing their 2021 tax returns and some are even being penalized for lawfully taking the credit in the first pay periods of Q4. These employers are not asking for anything more than they were originally promised and were depending on. Quick passage is the best way to rectify the wrongful early termination of ERTC."

"From the day the Employee Retention Tax Credit was announced as part of the CARES Act in March 2020, charitable nonprofits recognized the refundable payroll tax credit as a lifeline, enabling their organizations to deliver desperately needed services to people in local communities throughout the country," said Tim Delaney, President and Chief Executive Officer, National Council of Nonprofits. "This fall, in direct reliance on the promise of ERTC relief, frontline nonprofit service providers staffed up, parochial schools reopened, nonprofit performing arts organizations commenced their fall seasons, and many more charitable organizations brought employees back to work – only to see the ERTC taken away retroactively. Charitable organizations everywhere celebrate the bipartisan group of Representatives who are leading the charge to restore the ERTC and urge all Members of Congress to work for swift passage of the ERTC Reinstatement Act."

Click here to read the full letter.

Background:

Originally, to be eligible for the ERTC, business owners had to demonstrate at least a 20% decline in gross receipts in either a given quarter compared to the same quarter in 2019 or the immediately preceding quarter. Alternatively, the business owner may have been eligible if the business is subject to a full or partial suspension of business operations due to a government order.

Specifically, for last year's third and fourth quarters, business owners can qualify for the ERTC as a "recovery startup business" or qualify as a "severely financially distressed employer." To claim the ERTC as a "severely financially distressed employer," the business must have suffered at least a 90% decline in gross receipts in a specific quarter compared to the same quarter in 2019.

The ERTC was scheduled to expire at the end of 2021, but the recently enacted Infrastructure Investment and Jobs Act disallowed this credit for the fourth quarter of 2021. Many small businesses continued to take the tax credit into the fourth quarter, and now face a retroactive tax increase and a complex, frustrating process in reconciling the credit that they will now have to forfeit.

The bill was introduced in the House of Representatives by fellow Ways and Means Members Stephanie Murphy (D-FL), Kevin Hern (R-OK), and Terri Sewell (D-AL) and cosponsored by over 60 bipartisan House Members. Carol Miller (R-WV) and Jodey Arrington (R-TX), Ways and Means Committee members and Congressional Energy Export Caucus co-chairs, penned an op-ed for Real Clear Energy titled, "The European Energy Crisis: Biden Is Too Little, Too Late." In their op-ed, Reps. Miller and Arrington lay out the ways President Biden's disastrous energy policies have kneecapped American energy production and emboldened Russia to invade Ukraine.

The members also highlight their Energy Security Cooperation with Allied Partners in Europe (ESCAPE) Act, which would advance American energy exports to the European Union and North Atlantic Treaty Organization (NATO) allies, and reduce their reliance on Russian energy.

The European Energy Crisis: Biden Is Too Little, Too Late

By: Reps. Carol D. Miller and Jodey Arrington

Europe's energy shortage has deteriorated into a geopolitical crisis that President Biden has failed to address, let alone acknowledge. Their climate policies have pushed Europe away from reliable energy sources and towards less reliable options, causing benchmark oil prices to skyrocket above $100 a barrel and painful prices at the pump for consumers. This has squeezed Europe's energy supply, slowed their economic recovery, and, worst of all, subjected their collective security to nefarious actors like Russia.

The continent's dire predicament has been years in the making, and the divestment in traditional energy sources has emboldened Moscow to increase their leverage over neighboring countries by establishing itself as a top natural gas supplier.

Today, approximately one-third of Russian gas fueling Europe crosses Ukraine. Recent events in the region have called into question the security and reliability of Russian energy, causing a panic in global markets. While shipments continued during Russia's 2014 annexation of Crimea, there's no guarantee they will continue this time around. As Ukraine-Russia tensions come to a head, our strategic competitors and adversaries are seizing this opportunity to re-position themselves in the global energy market and international political landscape.

President Biden has enabled Russia's recent aggression by unilaterally punishing American energy production. He cancelled the Keystone XL pipeline and federal drilling leases, which has left the world more reliant on Russian oil. Biden also waived critical sanctions on the Nord Stream 2 pipeline, relinquishing U.S. negotiating power with Russia and increasing Europe's dependence on Russian energy. Unfortunately, the Biden Administration's energy policy has dangerously played right into Putin's hands.

Now more than ever, we should be encouraging domestic production, protecting American energy independence, and expanding our oil and gas exports. American natural gas production has grown substantially since 2018 and is now equipped to provide significant amounts of energy to Europe and the rest of the world, but only if commonsense policies and leadership allow it. The U.S. produces exponentially cleaner natural gas than Russia. If American energy were to replace Russian energy in Europe, global greenhouse gas emissions would fall by 72 million metric tons per year. Promoting American energy production helps our partners in a time of crisis, supports workers here at home, and advances global emission reductions.

Energy experts and policymakers have long warned the Biden Administration of the ramifications of their energy policies in the global energy arena. We introduced the Energy Security Cooperation with Allied Partners in Europe (ESCAPE) Act last March to expand American energy exports to Europe and NATO allies and reduce their reliance on Russian energy. Additionally, our legislation would reestablish sanctions on Russian pipelines, including Nord Stream 2, that were signed into law but not enforced by President Biden until this week. While Europe currently imports more than 40% of their natural gas from Russia, the ESCAPE Act would help make American energy more attractive and affordable. America stands ready to provide her allies what Russia can't: safe and reliable energy without any strings attached.

Had the policies prescribed in the ESCAPE Act been implemented, and President Biden acknowledged the global concern regarding Russia's increased aggression and America's energy retreat, the current situation could have been avoided. Unfortunately, it is too late for any substantive action that is not simply a response to Putin's invasion. President Biden must recognize that his decimation of American energy opened the door for Russia's ongoing aggression, diminished our leverage in negotiations, and resulted in a missed opportunity in meeting Europe's energy demands. It is clear—the only solution to lowering energy prices for consumers, protecting American energy independence, and stabilizing the situation in Europe is for President Biden to implement the ESCAPE Act and unleash the full power of American energy production.

Carol D. Over the past year, China has maneuvered to establish itself as a superior trade and economic leader on the global stage and most importantly, in the Indo-Pacific region. Comprised of many nations and partners, the Indo-Pacific is home to dynamic economies, crucial supply chains, and critical manufacturing and defense hubs. It represents one of the fastest growing regions in the world.

"Our bill instructs President Biden to assert U.S. trade leadership in the Indo-Pacific, as this will strengthen American competitiveness, putting our workers and businesses in the best position to compete globally and protect global trade norms and standards abroad. The bill establishes congressional intent and support for new or updated trade programs and authorities, as well as consideration of updating and modernizing the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP). Our bill also ensures Congress has robust and necessary access to information on the progress of the administration's trade and economic negotiations in the Indo-Pacific. Most importantly, it requires American trade leaders to develop a comprehensive, responsible, and long-term trade and economic plan on China, including any further Phase One implementation efforts or consideration for a Phase Two agreement."

"With a new administration, and new realities presented by the COVID-19 pandemic, the evolving power competition between the United States and China commands swift and decisive American leadership. The Indo-Pacific region will be the primary stage of this economic competition, and it is vital that the Biden administration wake up to this reality and move swiftly to seize this integral moment.
