I commend the Medical Executive Committee and the medical staff for their extraordinary commitment to our community. The MEC\u2019s open letter fulfills their regulatory obligation to notify CMS of adverse conditions involving supplies, staffing, medications, equipment, pharmaceuticals, and patient placement challenges. This notification is a serious step that I am sure our physicians do not take lightly. It reflects the reality that systemic failures have reached a point where medical professionals have an obligation and must formally document conditions that compromise their ability to deliver appropriate care to Virgin Islands residents, a truth that can no longer be ignored.\n\n\"These conditions did not develop overnight. In April, I and my office met with key stakeholders in our healthcare sector from both districts. Given the escalating concerns related to our hospitals in the Virgin Islands\u2014including staffing shortages, supply deficits, and operational challenges\u2014my office met with hospital leadership and these dedicated providers to identify what more can be done. For decades, I and my predecessors have worked to address the structural inequities that undermine Virgin Islands healthcare. I have fought relentlessly on multiple fronts to secure healthcare equity for the Virgin Islands, and I want to be clear about the scope of that work and the barriers we continue to face.\n\n\"Medicare payments for the Virgin Islands are calculated using the Tax Equity and Fiscal Responsibility Act of 1982. Under TEFRA, the respective base years are 1982 for the Schneider Regional Medical Center and 1996 for the Governor Juan F. Luis Hospital. The base year reimbursement system, which relies upon an inflation adjustment, does not accurately capture the expenses of patient care services. In the face of these obstacles, I have introduced legislation for healthcare equity in every Congress, and included in annual appropriations legislation language to urge the Centers for Medicare and Medicaid Services to update the payment data and formulas for the hospitals in the Virgin Islands. Additionally, I have met repeatedly with CMS leadership to urge the use of their administrative scope to assign a new base period, which is more representative of the reasonable and necessary cost of inpatient services. Despite these extensive efforts, TEFRA rebasing still requires CMS administrative action that has not materialized due to technical obstacles and the politics of healthcare in America.\n\n\"During the Biden Administration, I successfully secured transformative changes to Medicaid funding for the territories. I secured provisions in legislation to change the percentage of Medicaid payment by the federal government from 55 percent to 83 percent and raise the ceiling on the total amount of annual Medicaid funding. This change directly strengthened healthcare delivery across the Virgin Islands and provided paid access to healthcare for thousands more in our community. This permanent change in law represented a historic shift in how the federal government supports territorial healthcare, providing critical resources that had been denied for decades.\n\n\"I have long-championed extending and permitting Medicaid and Medicare Disproportionate Share Hospital payments to U.S. territories. DSH payments help close the financial gap caused by geographic isolation and rural conditions, which drive up the cost of care and strain our hospitals that already operate with limited resources. Additionally, I have advocated for Medicare and Medicaid payment systems that allow rural and geographically isolated hospitals an increased reimbursement rate, including Critical Access Hospital designation for our facilities. I have discussed with federal officials other programs and creative mechanisms to create larger funding for the hospitals.\n\n\u201cBeyond hospital funding mechanisms, addressing the economic security of our most vulnerable residents is essential to reducing healthcare system strain. For too long, our most vulnerable citizens in the Virgin Islands and other U.S. territories have been denied access to Supplemental Security Income (SSI), an integral program that supports our elderly and disabled residents with the greatest needs, solely based on their place of residence\u2014a United States territory. Since my first term in Congress, I have made obtaining access to SSI for Virgin Islanders an ongoing priority. I introduced Right to Democracy to attorneys who gave pro bono support all the way to the Supreme Court in United States v. Vaello-Madero (a case challenging the lack of SSI in the U.S. territories). In 2021, I had SSI for the Virgin Islands and other territories included in President Biden's Build Back Better legislation, which passed in the House of Representatives, but the Build Back Better package did not advance through the Senate. I am proud to continue co-leading the Supplemental Security Income Equality Act with Congressman Moylan to end decades-long disparities in federal benefits eligibility, because based on ZIP code alone, otherwise eligible citizens in territories are denied benefits. Access to SSI is critical not only for the dignity and economic security of our most vulnerable residents, but also for the sustainability of our healthcare system\u2014when our elderly and disabled citizens have adequate income support, they can better afford healthcare services and reduce the strain on already overburdened hospital resources.\n\n\"Following Hurricanes Irma and Maria in September 2017, which devastated our healthcare infrastructure and amplified problems that already existed, I worked aggressively to secure federal support to rebuild critical infrastructure in the Virgin Islands. I successfully advocated for cost-match reductions and extensions that provided critical financial relief for our hospitals in the Territory. Through the changes in law I obtained in the Bipartisan Budget Act of 2018 for the rebuild of the Virgin Islands, FEMA has now obligated more than $928 million for the Roy L Schneider Regional Hospital and $834 million for the Juan F. Luis Hospital rebuilds, creating an unprecedented opportunity to transform our healthcare infrastructure. During COVID-19, I secured additional support and funding streams to help our healthcare system weather another crisis that strained already limited resources.\n\n\"Since my April meetings with physicians and hospital leadership, I have remained in constant communication with our healthcare community. I deeply value the commitment of the medical community and the honesty with which they have described the conditions on the ground. A CMS notification could lead to federal inquiries, accreditation reviews, or required corrective action, just like we weathered in 2013. While such scrutiny is serious, it may also be the catalyst needed to force long-avoided changes. Ultimately, this moment demands that all of us set aside politics and prioritize care for every Virgin Islander. Virgin Islanders cannot afford another decade of avoidable decline.\n\n\u201cOur hospitals should not operate under reimbursement formulas based on data from forty years ago. Our medical staff and dedicated hospital employees should not endure resource challenges, poor working conditions, and stagnant wages, while carrying an ever-increasing burden. Every Democrat in the House voted no.\n\nThe 2 Republicans who voted against the bill, Congressman Thomas Massie (KY-4) and Congressman Warren Davidson (OH-8), opposed the legislation as they wanted to see further federal funding cuts. They held out hoping for full dismantlement.\n\nThis bill includes the largest cuts to healthcare in American history. This loss of funding \u2013 nearly one trillion dollars \u2013 will eliminate healthcare coverage for at least 13.7 million Americans and make it harder for people to access vital medical services. In Medicaid alone, funding is cut by more than $730 billion, which will leave 7.6 million people uninsured. The Virgin Islands presently has 21,000 Medicaid enrollees presently, many of whom will be impacted through loss of service or disenrollment.\n\nMedicare funding was cut by more than $500 billion and vital programs, including the Social Services Block Grant \u2013 which provides more than $4.2 million to the Virgin Islands \u2013 are eliminated until 2034. With 20,000 Medicare enrollees in the U.S. Virgin Islands, services are sure to be impacted. Federal funding for the Virgin Islands\u2019 Meals on Wheels Program and the Low-Income Home Energy Assistance Program (LIHEAP) has also been eliminated until 2034.\n\nRepublicans\u2019 reconciliation bill will make everyday life more expensive for Americans and removes programs which gave opportunities and support for a better life. It is estimated that more than 4 million students will see a reduction, or elimination, of their Pell Grants. The requirements for \u2018full-time\u2019 students are increased from 12 to 15 credits, which will decrease the maximum award for any student taking 12 credits by $1,479. In addition, students that are enrolled less than half-time will no longer receive Pell aid.\n\nThis bill harms efforts to lower energy costs, increase clean energy manufacturing and jobs, and eliminate economic assistance for communities on the frontline of the climate crisis. Unobligated funds will be rescinded from Inflation Reduction Act programs including Environmental Justice Block Grants, State-Based Home Energy Efficiency Contractor Training Grants, and the Greenhouse Gas Reduction Fund. One of these programs already in place in the Virgin Islands is the Solar for All Program, which provided $62.5 million for homes and businesses.\n\nRepublicans voted to cut $35 billion in funding for the Supplemental Nutrition Assistance Program (SNAP), which includes children, working families, seniors, veterans and people with disabilities. This includes a $1 million cut to the Summer Electronic Benefits Transfer (EBT program), which gives food assistance to children when they cannot rely on school lunches. This will impact the more than 15,000 Virgin Islands residents who rely upon SNAP for access to nutritious food for their wellbeing. The $35 billion cut includes a $1 billion decrease in funding for the Nutrition Assistance Program in Puerto Rico despite tremendous efforts and advocacy from their lobbyists, led by Republican Governor, Jenniffer Gonzalez-Colon and Congressman Pablo Hernandez.\n\nThe reconciliation bill does not provide the increased rum cover over rate. Rum cover over is the rebate of federal excise taxes on distilled spirits produced in or imported into the rest of the United States from the Virgin Islands and Puerto Rico. Despite Congresswoman Plaskett\u2019s success in securing a Republican lead for the rum cover over legislation (H.R. 1378), Congressman Ron Estes (KS-4), and the support of 24 of her colleagues \u2013 16 Republicans and 8 Democrats \u2013 the extension for Puerto Rico and the Virgin Islands was not included in the bill.\n\nIt is unfortunate that at the last minute while trying to find additional funds, the Republicans attempted to remove duty drawback - an export-promotion program that American alcohol and tobacco companies rely upon for a refund of duties paid at the time of import when similar goods are exported. That program saves the alcohol industry alone approximately $30 billion. Because of that concern, the full push of the rum industry was not present for rum cover over as the industry prioritized its efforts on safeguarding duty drawback which represented direct dollars to their industry. It\u2019s also important to recognize that many discretionary provisions that made it into the bill were included to secure the necessary votes to advance the legislation \u2013 which ultimately was not the case with the provision for an increased rum cover over rate.\n\nDuring the 18-hour markup in the Ways and Means Committee for the tax provisions of the reconciliation bill, Congresswoman Plaskett offered an amendment to increase the rate of the rum cover offer, to publicly demonstrate the bipartisan support for this provision. Both Democrats and Republicans emphasize the importance of the increased rum cover over rate. The Ways and Means Chairman, Jason Smith, publicly stated that he would work to advance this, and the Committee is expected to craft a bipartisan tax bill this summer. \u201cI will continue to work with my colleagues, Democrats and Republicans, to secure the increased rum cover over rate of $13.25, both retroactively and with an extension, for the Virgin Islands and Puerto Rico.\u201d\n\nWhile Congresswoman Plaskett cannot support the bill in its entirety, Plaskett\u2019s legislation, the Restore Economic Vitality and Investment in the Virgin Islands (REVIVE VI) Act is included in the Republicans\u2019 bill \u2013 one of only four Democrat Ways and Means provisions. Plaskett shared the following statement on the Trump Administration\u2019s U.S. Trade Representative Office\u2019s (USTR) exemption for the U.S. Virgin Islands from punitive service fees and restrictions on shipping companies that have the potential to skyrocket costs for Americans \u2013 and would have done so exponentially for the Virgin Islands.\n\nThere would have been far-reaching economic consequences, including shipping delays and estimates of 50-60% increased shipping costs under the Proposed Action. However, the U.S. Virgin Islands falls within the 2,000 mile exemption (Annex II, Targeted Coverage, page 33) in the Notice of Action issued today by USTR. Furthermore, transport operators with fleets comprised of Chinese-built vessels would have been charged up to $1.5 million per vessel entrance to an American port, as well as an \u2018additional fee\u2019 of up to $1 million per vessel entrance to an American port if the number of foreign-built vessels in the operator\u2019s fleet is equal to or greater than 25 percent. Even vessels under the U.S. flag, operated and owned by a U.S. entity that are Chinese-built would have been subject to the fees in USTR\u2019s proposal. If the Proposed Action had been implemented, the unintended consequence would have been an increased presence of Chinese vessels and carriers transporting goods from sources outside of the United States\u2014including China\u2014within the United States\u2019 third border, the Caribbean Basin.\n\n\u201cI am grateful for the opportunity to speak with and question US Trade Representative Ambassador Jamieson Greer during a Ways & Means Committee hearing last week and at that time urging the Ambassador to consider the practical impacts of tariff actions on the U.S. outlying areas and ultimately reconsider those actions. Our communities would have borne a tremendous undue cost, which made clear the need for an exemption. I also led a letter to USTR Ambassador Greer and the Administration, with Members of Congress from both the Atlantic and Pacific areas to make the case for an exemption for the territories and US-owned companies and underscore the impact of these fees on the Virgin Islands, which would have permeated through the Caribbean region.\n\n\u201cUSTR Ambassador Greer took my letter into serious consideration when making final arrangements of this action. During the Biden Administration, I was able, in legislation, to change the percent of Medicaid payment by the federal government from 55% to 83% and raise the Medicaid cap. Medicare payments for the Virgin Islands are calculated using the Tax Equity and Fiscal Responsibility Act of 1982 (TEFRA). Under TEFRA, the respective base years are 1982 for the Schneider Regional Medical Center (SRMC) and 1996 for the Governor Juan F. Louis Hospital (JFL). The base year reimbursement system, which relies upon an inflation adjustment, does not accurately capture the expenses of patient care services. I have introduced legislation for healthcare equity in each Congress and included in annual appropriations legislation language to urge the Centers for Medicare and Medicaid Services (CMS) to update the payment data and formulas for the hospitals in the Virgin Islands. In addition, President Biden also agreed to raise the federal cost share to 98 percent in the case of larger critical infrastructure rebuilding projects approved before September 30, 2024, and completed before 2026.\n\n\u201cAs we know, the Virgin Islands government has been allocated billions of federal dollars for hurricane recovery projects\u2014for our schools, hospitals, water, power, communications, and other critical infrastructure. It would treat such investment as domestic rather than foreign investment and require investors to have an active trade or business in a U.S. territory with a certain percentage of income derived from such territory.\n\nTerritorial Tax Parity and Fairness Act - This bill would amend the Internal Revenue Code to apply the exemption that currently exists for U.S. territory residents from the law\u2019s definition of a United States shareholder to include bona fide residents of the Virgin Islands, like the existing treatment for bona fide residents of Puerto Rico and other U.S. territories. This will bring tax parity to investments in the Virgin Islands.\n\nTerritorial Tax Parity Act - This bill modifies the income source rules that apply with respect to the taxation of resident businesses in U.S. territories. This would make the Virgin Islands more attractive to businesses and investment and would create more jobs in the territory.\n\nTerritorial Tax Parity and Clarification Act - The bill would specifically create parity between the way capital gains income in the Virgin Islands is treated and the way that it is treated in Puerto Rico and other U.S. territories.\n\nTerritorial Tax Equity and Economic Growth Act - This bill modifies the residence and income source rules involving U.S. territories to provide for economic recovery in the territories.\n\nVirgin Islands Visa Waiver Act - This bill authorizes a non-immigrant visitor visa waiver program for nationals of certain countries to enter the U.S. Virgin Islands for up to 45 days (as currently provided to other U.S. territories). Under this visitor tourism program, the Department of Homeland Security (DHS) may provide a waiver admitting a non-immigrant visitor from a DHS-approved country into the Virgin Islands for up to 45 days.\n\nFuel Tax Cover Over Bill - This bill would amend the Internal Revenue Code to cover over (pay) to the Virgin Islands revenue from U.S. excise taxes on fuel produced in the Virgin Islands and transported to the United States mainland from the Virgin Islands, like the existing cover over program that exists for distilled spirits and other articles of manufacture.\n\nCongresswoman Plaskett further shared, \u201cAll of these bills, if passed, will protect jobs and the livelihood of our small business owners and increase the amount of revenue generated in the Virgin Islands. The territorial tax bills I\u2019ve introduced are critical and will address a long-standing issue\u2014to compensate for historical disadvantages, and to create jobs and middle-class economies, the territories have historically relied on provisions in the U.S. tax code that treat U.S. investment in the territories more favorably than investment in foreign jurisdictions. However, recently, including through new taxes on global intangible low taxed income (GILTI) in the Tax Cuts and Jobs Act of 2017, U.S. territories have been treated the same as foreign countries. This has had a negative impact on private investment and job creation in the Virgin Islands.
