Barr joined a slew of members of Congress and U.S. Senators who wrote an Amicus Brief urging the Supreme Court to uphold state bans on biological men participating in girls\u2019 sports in the upcoming State of West Virginia v. B.P.J and Little v. Hecox case.\n\nThe brief argues that when Congress enacted Title IX in 1972, it defined \u201csex\u201d in biological terms\u2014not as \u201cgender identity\u201d\u2014and that only Congress, not the courts, has the authority to change that definition. You can read the full brief here.\n\n\u201cThe text of Title IX uses \u2018sex\u2019 to mean biology\u2014not gender identity,\u201d the Amicus Brief reads in part. \u201cBecause Title IX was enacted under the Spending Clause, its requirements must be clear and unambiguous, and those provisions say nothing about gender identity. Congress should be given the option and ability to consider the policy implications of importing gender identity into the text of Title IX.\u201d\n\n\u201cWe must fight in Court, in Congress, and in every community to ensure President Trump\u2019s Executive Order protecting our girls is preserved,\u201d said Congressman Barr. \u201cMen do not belong in women\u2019s sports and I will continue to work alongside President Trump, my colleagues in Congress, and activists like Riley Gaines to protect female athletes and their private spaces.\u201d\n\n\u201cWest Virginia passed a law making it clear that men shouldn\u2019t play in women\u2019s sports. This is just common sense \u2013 men and women are biologically different. Men cannot become women and they certainly shouldn\u2019t be forced to compete together. We have a duty to protect our children and ensure that no more girls are injured by transgender athletes pretending to be women. I\u2019m proud to lead this bicameral amicus brief with Sen Jim Risch (R-Idaho) in defense of protecting women\u2019s sports at the Supreme Court,\u201d said Congressman Riley M. Moore (WV-02), who led the Amicus Brief.\n\nBarr also authored and introduced the Defend Girls\u2019 Athletics Act, legislation that is endorsed by women\u2019s sports and conservative activist Riley Gaines, to cut off federal funds to any school that refuses to implement President Donald Trump\u2019s national ban on biological men participating in girls\u2019 sports.\n\nBiological males are depriving female athletes of their athletic achievements. According to the United Nation\u2019s 2024 study titled \u201cViolence against women and girls in sports,\u201d biological males have won 890 medals in 29 different women\u2019s sports. The study also estimated that over 600 female athletes have lost accolades because of male athletes participating in their sport.\n\nEven worse than stealing glory from our female athletes, some girls have suffered permanent injury because of competing against biological males in sports.
