These policies undermine girls\u2019 achievements, ruin the potential for future scholarships and opportunities, and put their safety in jeopardy,\" said Congressman Emmer. \u201cGovernor Walz continues to harm Minnesota girls by rejecting common-sense policies that would keep biological boys out of their sports.\u201d\n\nBackground\n\nCurrently, the MSHSL\u2019s policy \u201callows participation for all students consistent with their gender identity or expressions\u201d for participation in athletics.\n\nOn September 30, 2025, the U.S. Department of Education (ED) and U.S. Department of Health and Human Services (HHS) announced that both the MSHSL and Minnesota Department of Education (MDE) are in violation of Title IX.
