Congress is making real progress on addressing the rising cost of home ownership, and this bill keeps us moving toward a future where an affordable home is once again within reach for every family.\u201d\n\n\u201cNew Hampshire is in a full-blown housing crisis, and hardworking people are paying the price every month in higher rents and home prices they cannot afford,\u201d said Congresswoman Goodlander (D-NH). \u201cRight now, a single federal rule is senselessly jacking up costs and adding massive delays to the urgent mission before us: building the tens of thousands of homes the people of New Hampshire urgently need. Our bipartisan Build Housing Affordably Act cuts needless red tape that is standing in our way and paves the way for affordable homes, built much sooner, at a lower cost to the Granite Staters who need them.\u201d\n\nClick here for the full text of the bill.\n\nClick here for one-pager on the bill.\n\nClick here for a detailed section-by-section of the bill.\n\nBackground: After passage of the \"Infrastructure Investment and Jobs Act\" in 2021, Build America, Buy America requirements\u2014which require iron, steel, manufactured products and construction materials for federally assisted infrastructure projects to be domestically produced\u2014have been applied to the construction, rehabilitation and repair of affordable housing projects.\n\nWhile well-intentioned, BABA has proven to be a top regulatory barrier to building more affordable housing supply using federal programs like the HOME Investment Partnership Program. Congressman Flood has highlighted the effects of BABA on affordable housing projects at past congressional hearings this Congress, including:\n\nFull Committee Hearing with HUD Secretary Turner in January, 2026.\n\nSummary: The Build Housing Affordably Act streamlines BABA implementation to strike a better balance between promoting domestic production and continuing the development of affordable housing projects across the country. The bill would:\n\nRequire the Department of Housing and Urban Development (HUD) to conduct a study of the effects on BABA on affordable housing development and the BABA waiver process. Following the completion of this study, HUD must present its findings in a report to Congress.\n\nHalt implementation of BABA for covered affordable housing projects until 60 days after the report is delivered to Congress.\n\nInstitute a 90-day timeline for reviewing BABA waivers for affordable housing projects.
