The Committee leaders warned these agencies to stay within the bounds of authority granted to them by Congress.\n\nIn a letter to the Administrator of the EPA, Michael S. Regan, and the Assistant Secretary of the Army for Civil Works, Michael L. Connor, Graves and his colleagues noted the recent Supreme Court decision, West Virginia v. EPA, in which the majority opinion noted that there are extraordinary cases in which an agency must point to \u201cclear congressional authorization for the authority it claims.\u201d\n\nIn particular, the letter highlighted attempts to expand the definition of \u201cwaters of the United States\u201d (WOTUS) under both the Obama and Biden Administrations. The letter explained, \u201cthe fight over the definition of WOTUS is characterized by opportunistic attempts by both the Obama and Biden Administrations to administratively expand the authority of both the EPA and the Corps.\u201d [Graves and colleagues] argued that the West Virginia v. EPA opinion gives \u201creason to hesitate\u201d that Congress meant to confer to the EPA and the Corps the authority they claim.\n\nGraves and colleagues also highlighted a prior Congressional letter signed by over 200 Members requesting the Corps to halt all current rule making actions until the Supreme Court rules on the pending Sackett v. EPA case, which deals precisely with the definition of WOTUS. They stated, \u201cWe reiterate that request, and now further stress that the Agencies must consider the decision of West Virginia vs. EPA prior to issuing a rule making that would clearly surpass the Agencies\u2019 congressional authority to define WOTUS.\u201d\n\nMembers asked for the EPA and the Corps to provide lists of all pending and expected rule makings related to WOTUS and to provide the specific Congressional authority for each.", 1, "2026-03-30T01:40:41Z", "2026-04-08T03:08:33Z"]], "columns": ["url", "title", "date", "year", "month", "party", "chamber", "state", "member_name", "bioguide_id", "domain", "scraper", "source", "date_source", "text", "has_text", "collected_at", "updated_at"], "primary_keys": ["url"], "primary_key_values": ["https://graves.house.gov/media/press-releases/graves-reminds-administration-congress-writes-laws-when-it-comes-wotus"], "units": {}, "query_ms": 1.8765879794955254, "source": "dwillis/congress-press", "source_url": "https://github.com/dwillis/congress-press", "license": "MIT", "license_url": "https://github.com/dwillis/congress-press/blob/main/LICENSE"}
