Congressman Guest joined a bicameral group of legislators in an amicus brief supporting the arguments to overturn the vaccine mandate.\n\n\u201cVaccine mandates\u2014a prototypical state police power\u2014are not within the purview of the OSH Act, let alone something on which Congress intended OSHA to take unilateral action under its \u2018emergency\u2019 powers. The ETS Mandate proposed by OSHA cannot stand,\u201d the amici curiae argue.\n\nCongressman Guest has been critical of OSHA\u2019s overreach into public health policy and has questioned the authority of the agency to issue a nationwide vaccine mandate on certain businesses.\n\n\u201cOSHA does not have the authority to operate as a type of health police.
