Steven Horsford (NV-4) led their colleagues in calling on U.S. Customs and Border Protection (CBP) Commissioner Rodney Scott to immediately address administrative backlogs preventing American businesses from receiving refunds for duties paid under the Trump Administration\u2019s illegal use of the International Emergency Economic Powers Act (IEEPA).\n\nBusinesses have reported that delays in CBP\u2019s Consolidated Administration and Processing of Entries (CAPE) system are preventing importers from meeting the agency\u2019s 90-day deadline to request refunds \u2014 potentially costing small businesses money they are legally owed.\n\n\u201cSadly, businesses in our districts have reported significant logistical hurdles that they must clear to receive a refund,\u201d the lawmakers wrote. \u201cUnder no circumstances should these companies bear the brunt of both the tariffs struck down by the Supreme Court and the denial of tariff refunds because of administrative mismanagement of the CAPE system.\u201d\n\n\u201cMichigan businesses should not have to pay the price once let alone twice, first through illegal tariffs, and again because government red tape prevents them from getting their money back,\u201d said Rep. Haley Stevens. \u201cSmall businesses in Michigan operate on tight margins, and every dollar matters. CBP must fix these administrative roadblocks and make sure businesses receive every dollar they are owed.\u201d\n\nThe Supreme Court ruled in February 2026 that President Trump\u2019s use of IEEPA to impose sweeping tariffs was unlawful. Rep.
