Hecox (Idaho) and State of West Virginia v. B.P.J. regarding Title IX protections. Senator James Risch (R-Idaho.) is leading in the Senate and Rep. Riley Moore (R-WV-02) is leading in the House.\n\nBackground:\n\nLittle v. Hecox is set to review Idaho\u2019s Fairness in Women\u2019s Sports Act, which puts a ban on biological males from participating in female athletics. Passed in 2020, Idaho was the first state in the nation to impose such law. The Ninth Circuit held that the law violated the Equal Protection Act.\n\nWest Virginia v. B.P.J. will review West Virginia\u2019s Save Women\u2019s Sports Act, which prevents biological males from participating on girls\u2019 sports teams. The Fourth Circuit blocked the law for allegedly violating Title IX.\n\nArgument:\n\nTitle IX\u2019s prohibition of discrimination \u201con the basis of sex\u201d refers exclusively to biological sex, not gender identity, as understood when the law was enacted in 1972.
