Unfortunately, some companies have hijacked the program to purchase and construct data centers. One report found that between 14% and 17% of data centers in the United States have been built, or will be built, in qualifying opportunity zones\u2014permitting Big Tech companies to qualify for tax incentives that were not intended for them.\n\nThis legislation follows Senator Hawley\u2019s bipartisan GRID Act, which prevents data centers from driving up energy costs and ensures that American consumers are not carrying the burden of the increased electricity usage.\n\n\u201cBig Tech companies are getting major tax breaks they don\u2019t need to build data centers communities do not want. We must close the loophole immediately,\u201d said Senator Hawley. \u201cI\u2019m introducing the No Tax Breaks for Data Centers Act to ensure Big Tech companies don\u2019t get tax breaks to build data centers on farmland.\u201d\n\nThe No Tax Breaks for Data Centers Act will:\n\nExclude data centers from the definitions of qualifying opportunity zone businesses and qualifying opportunity zone property, thus disallowing taxpayers from using the beneficial tax treatment of the Opportunity Zone program to invest in the purchase or construction of a data center.\n\nPreserve the Opportunity Zone tax incentive program for all other eligible opportunity zone businesses and property.", 1, "2026-09-18T09:27:43Z", "2026-09-18T09:29:09Z"]], "columns": ["url", "title", "date", "year", "month", "party", "chamber", "state", "member_name", "bioguide_id", "domain", "scraper", "source", "date_source", "text", "has_text", "collected_at", "updated_at"], "primary_keys": ["url"], "primary_key_values": ["https://www.hawley.senate.gov/hawley-introduces-legislation-to-strip-opportunity-zone-tax-breaks-for-data-centers/"], "units": {}, "query_ms": 0.9884079918265343, "source": "dwillis/congress-press", "source_url": "https://github.com/dwillis/congress-press", "license": "MIT", "license_url": "https://github.com/dwillis/congress-press/blob/main/LICENSE"}
