Jim Inhofe (R-Okla.), senior member of the Senate Environment and Public Works (EPW) Committee, and Sen.-elect Shelley Moore Capito (R-W.V.) released the following joint statement today in response to the Environmental Protection Agency\u2019s (EPA) decision to regulate coal ash under subtitle D of the EPA\u2019s Resource Conservation or Recovery Act (RCRA):\r\n\u201cWhile the rule\u00a0may not be as bad as some had feared, it will\u00a0make states and utility companies vulnerable to new regulatory costs and expensive litigation.\u00a0It is nothing more than a continuation of the president\u2019s war on fossil fuels and another attack on America\u2019s most abundant, affordable and reliable source of energy: coal.\u00a0\u00a0By regulating coal ash\u00a0under subtitle D of EPA\u2019s Resource Conservation or Recovery Act (RCRA),\u00a0the Administration is subjecting states and industry to\u00a0citizen lawsuits. This\u00a0places\u00a0wealthy, left-wing\u00a0environmental\u00a0activist groups\u00a0in the driver\u2019s seat of enforcing this\u00a0federal rule.\u00a0It\u00a0will lead to\u00a0excessive litigation and increased costs to consumers while putting at risk the reliability of our electric grid.\u00a0\r\n\u201cThe rule has long been touted as a knee-jerk reaction from the Tennessee Valley Authority (TVA) Kingston spill in December 2008,\u00a0but today\u2019s new mandate from EPA\u00a0would not have prevented the TVA or other high-profile\u00a0accidents. Instead, it has a potential to cost our economy $22.8\u00a0billion and leave\u00a0up to\u00a064,700\u00a0people without jobs.\u00a0A federal\u00a0mandate\u00a0on coal ash\u00a0serves\u00a0as a 'one-size fits all' approach and would leave a detrimental impact to\u00a0states that have responsibly and effectively managed coal ash.\u00a0 States have been paving the way on properly disposing and recycling coal ash, and in the new Congress, we will give states an opportunity to show they are not in need of\u00a0another\u00a0big government intervention.\r\n\u201cWe are not pleased with this outcome.
