Twenty-six states, including Alabama, have an injunction in place that prevents the rule from taking effect while the rule is being challenged in court.\n\n\u201cAmid the Biden\u2014Harris administration\u2019s unprecedented assault on Title IX, we write to urge the National Collegiate Athletic Association (NCAA) to update your student-athlete participation policy to require that only biologically female students participate in women\u2019s sports. The 2024 Summer Olympics are upon us, and the NCAA has boasted about its athletes\u2019 participation. Yet the NCAA has still taken no steps to protecting a critical portion of these athletes. Several organizations\u2014including the National Association of Intercollegiate Athletics (NAIA) and the Court of Arbitration for Sport\u2014in addition to more than 20 states, have acted recently to protect women\u2019s sports. We urge the NCAA to follow suit and take similar action to promote fair play,\u201d the Senators wrote.\n\nJoining Senators Tuberville and Blackburn are Senators Mike Braun (R-IN), Katie Britt (R-AL), Ted Budd (R-NC), Bill Cassidy (R-LA), Kevin Cramer (R-ND), Mike Crapo (R-ID), Ted Cruz (R-TX), Steve Daines (R-MT), Joni Ernst (R-IA), Josh Hawley (R-MO), Cindy Hyde-Smith (R-MS), James Lankford (R-OK), Cynthia Lummis (R-WY), Roger Marshall (R-KS), Pete Ricketts (R-NE), Jim Risch (R-ID), Marco Rubio (R-FL), Rick Scott (R-FL), Thom Tillis (R-NC), John Thune (R-SD), and Roger Wicker (R-MS).\n\nThe letter is endorsed by Riley Gaines, Concerned Women for America, Heritage Action, the Ethics and Religious Liberty Commission, Independent Women\u2019s Forum, the Independent Council on Women\u2019s Sports, the Independent Women\u2019s Law Center, Champion Women, and the Our Bodies Our Sports Coalition.\n\nRead the letter here.\n\nBACKGROUND:\n\nAs a former educator, mentor, and coach for more than 40 years, Senator Tuberville is concerned about the future of girls\u2019 and women\u2019s sports. He began his career coaching high school girls\u2019 basketball shortly after the enactment of Title IX, and witnessed the law\u2019s positive impacts firsthand. Senator Tuberville has been a vocal advocate of preserving Title IX and urged Joe Biden\u2019s Department of Education officials to keep the protections in place.\n\nIn June 2022, on the 50th anniversary of Title IX\u2019s enactment, the Education Department issued a proposed rule to allow biological males to compete in women\u2019s sports. Senator Tuberville urged Joe Biden\u2019s Education Department officials to keep the protections in place and cited his concern about the negative implications it would have for female athletes.\n\nDespite receiving nearly 240,000 comments in opposition to the proposed rule, the Education Department ignored every single one and published the final Title IX rule in April 2024. This is not the expected sports rule\u2014the Education Department is working on a separate effort to allow biological men to compete in women\u2019s sports.
