Jones (NC-3) has joined 39 of his colleagues in filing an amicus curiae brief with the D.C. Circuit Court of Appeals in Sissel v. HHS, a case which challenges the legality of Obamacare on the basis that it violates the Origination Clause of the Constitution.\u00a0 While the Origination Clause states that \u201c[a]ll bills for raising Revenue shall originate in the House of Representatives,\u201d Obamacare\u2019s individual mandate penalty \u2013 ruled a tax by the Supreme Court in 2012 \u2013 originated in the Senate.\u00a0 Thus, the brief argues that the healthcare law should be ruled unconstitutional.\u00a0\n\u201cEven worse than the canceled insurance plans and skyrocketing premiums resulting from Obamacare is the fact that individuals are suffering these ill effects from a law that runs directly contrary to our Constitution,\u201d said Congressman Jones. \u00a0\u201cIt is my hope that the Court of Appeals will recognize the law\u2019s blatant violation of the Origination Clause and rule accordingly.\u201d\u00a0\u00a0\nSissel v. HHS was decided in June 2013 by the U.S. District Court for the District of Columbia in a ruling \u2013 made by an Obama-appointed judge \u2013 that upheld the constitutionality of the president\u2019s healthcare law.\u00a0 The D.C.
