The\r\nbill would lower prices and increase competition in the generic pharmaceutical\r\nmarket by establishing an Office of Drug Manufacturing within the Department of\r\nHealth and Human Services (HHS) tasked with manufacturing select generic drugs\r\nand offering them to consumers at a fair price that guarantees affordable\r\npatient access. The lawmakers also released a new staff report,Costly Cures:\r\nThe Broken Generic Drug Market and the Urgent Need for the Affordable Drug\r\nManufacturing Act, which identifies market failures in the\r\ngeneric drug industry and outlines how the Affordable Drug Manufacturing Act\r\nwould address these failures. It also identifies hundreds of examples of drugs\r\nthat are potential candidates for public manufacturing under the bill. \"There is not enough competition in the market for generic drugs, and\r\nthat allows giant pharmaceutical companies to line their pockets while millions\r\nof families are crushed by the rising cost of prescription drugs,\"said\r\nSenator Warren.\"Our bill would fix the broken generic drug\r\nmarket-making it more competitive and dramatically lowering prices.\" \"Our prescription drug market is broken. Drug manufacturers are price\r\ngouging consumers without enough competition from more affordable, generic\r\ndrugs\" said Congresswoman Jan Schakowsky. \"That's\r\nwhy I'm proud to reintroduce theAffordable Drug Manufacturing Actwith\r\nmy friend Senator Elizabeth Warren. It's time for our federal government to\r\nstep up and ensure Big Pharma to faces real, honest competition that will lower\r\ndrug prices for people across the United States.\" Prescription drug manufacturers have relentlessly raised prices on U.S.\r\nconsumers. In the first six months of 2019, pharmaceutical corporations\r\nincreased prices byover\r\n10%, while in the past 10 years, spending on retail prescription drugs in\r\nthe U.S. increased bynearly\r\n$100 billion. When patents on brand-name drugs expire, patients and providers have\r\ntraditionally relied on generic drug companies to enter the market and create competition,\r\ndriving down costs and ensuring a reliable supply of affordable drugs. But the\r\nnewreportreveals\r\nhow the generic drug market is plagued by market failures that keep the costs\r\nof drugs high. Senator Warren's and Representative's Schakowsky'sreportalso\r\nidentifies key drugs that could be publicly-manufactured under the bill,\r\nfinding that: \r\n Generic drug markets often\r\n     lack competition, resulting in higher prices.\r\n Uncompetitive generic drug\r\n     markets allow for market manipulation, causing rapid increases in generic\r\n     drug prices.\r\n Pharmaceutical companies have\r\n     been accused of engaging in illegal activity to keep generic drug prices\r\n     high.\r\n Uncompetitive generic drug\r\n     markets increase the risk of drug shortages, leaving patients without\r\n     critical treatments in times of need.\r\n The Affordable Drug Manufacturing Act would address these market\r\nfailures by giving the HHS Secretary the authority to manufacture generic drugs\r\nin cases where the market has failed and strengthen the generic market for the\r\nlong term by jump-starting competition. The Act: \r\n Establishes an Office of Drug\r\n     Manufacturing within HHS charged with lowering prices, increasing\r\n     competition, and addressing shortages in the market for prescription\r\n     drugs;\r\n Authorizes the Office to\r\n     manufacture generic drugs under one of the following key conditions: \r\n \r\n  No company is\r\n      marketing the drug,\r\n  Only one or two\r\n      companies are marketing the drug, and the price has spiked;\r\n  Only one or two\r\n      companies are marketing the drug, and the drug is in shortage; or\r\n  Only one or two\r\n      companies are marketing the drug, the price is a barrier to patient\r\n      access, and the drug is listed as an \"essential medicine\" by\r\n      the World Health Organization.\r\n \r\n Authorizes the Office to\r\n     manufacture any drug that the federal government has licensed, including\r\n     under existing compulsory licensing authorities;\r\n Allows the government to sell\r\n     publicly-manufactured drugs at a fair price that covers manufacturing\r\n     costs while ensuring patients have access to these drugs;\r\n Requires the Office to begin\r\n     public production of insulin, naloxone, and antibiotics within one year;\r\n Improves the ability of new\r\n     companies to enter the generic drug market by authorizing the public\r\n     manufacturing of active pharmaceutical ingredients;\r\n Requires the Office to offer\r\n     to sell the rights to publicly-manufactured drugs to manufacturers who\r\n     commit to keep the drug on the market at a fair price, but authorizes the\r\n     Office to resume production if a manufacturer violates these commitments.\r\n Under the bill, the federal government-at the discretion of the HHS\r\nSecretary-could manufacture hundreds of drugs and would be required to\r\nmanufacture insulin, naloxone, and antibiotics. The lawmakers'reportcontains\r\nkey detailed examples and a list of over 400 drugs that could qualify for\r\npublic manufacturing under the Affordable Drug Manufacturing Act.
