We have an infrastructure problem. The United States is the world’s largest producer of natural gas, with abundant reserves, American workers ready to build, and the technology to power our homes, businesses, and industries for generations. But producing energy does little good if we cannot build the infrastructure necessary to move it where it is needed. Increasingly, the obstacle is a legal system that can turn federal approval into the beginning of years of litigation. When the Federal Energy Regulatory Commission issues a certificate of public convenience and necessity for an interstate natural-gas pipeline, the project has already undergone extensive federal review, environmental analysis, public comment, and expert agency consideration. Judicial review should remain available to people genuinely harmed by an agency decision. But it should not become a mechanism for opponents to delay an approved project until it becomes too expensive to build. The Mountain Valley Pipeline demonstrates the consequences. The project was originally expected to enter service in 2018 at an estimated cost of $3.5 billion. After years of litigation, regulatory setbacks, and construction delays, its cost reached approximately $7.85 billion. Congress ultimately had to intervene in 2023 to expedite completion of a project that had already received federal approval. Other projects never made it that far. The roughly $8 billion Atlantic Coast Pipeline was canceled even after its developers prevailed in a 7-2 Supreme Court decision in a major permitting dispute. As artificial intelligence continues to transform the digital landscape, automated bots now account for more than half of all global web traffic, with malicious bot activity increasing at an alarming rate. Many AI-powered web crawlers ignore existing industry standards, disguise themselves as human users, or conceal their identities altogether, making it increasingly difficult for website operators to determine who is accessing their systems and how their content is being used. These deceptive practices increase cybersecurity risks, impose significant infrastructure costs, and make it more difficult to distinguish legitimate automated activity from malicious actors. The Stealth Bot Prohibition Act requires automated web crawlers to accurately identify themselves and disclose their purpose when accessing websites. It also prohibits deceptive "stealth bots" that intentionally misrepresent their identity or impersonate human users while collecting data for use in connection with generative AI services. The legislation authorizes the Federal Trade Commission (FTC) to enforce these requirements through civil penalties against violators. “The rise of artificial intelligence presents incredible opportunities, but innovation must never come at the expense of those who create original content.
