Patty Murray, D-Wash., and I drafted will soon become law. We think it's a small step toward fiscal discipline in Washington. The non-partisan Congressional Budget Office estimates the bill will reduce the deficit over the next ten years by over $20 billion. And unlike current law, it will provide much-needed relief to our already strained defense budget. One part of the bill has become particularly controversial: the reduction in cost-of-living adjustments (COLAs) for working-age military retirees. The federal government has no greater obligation than to keep the American people safe and we must take care of the men and women in uniform who put their lives on the line. For that reason, Congress is understandably hesitant to make changes to military compensation. But even hesitance has a cost. The need for reform is undeniable. Since 2001, excluding the costs of the wars in Iraq and Afghanistan, the cost per service member in the active-duty force has risen by 41% in inflation-adjusted dollars. Defense Secretary Chuck Hagel, a combat vet himself, has said "that we can no longer put off military compensation reform. DOD's leadership, Chairman Dempsey, the service chiefs, the service secretaries, and myself, we all know that we need to slow cost growth in military compensation. Otherwise, we'll have to make disproportionate cuts to military readiness and modernization." Here's what the new law will do. We make no changes for those currently at or above age 62. This reform affects only younger military retirees. Right now, any person who has served 20 years can retire —regardless of age. That means a serviceman who enlists at 18 becomes eligible for retirement at 38. The late 30s and early 40s are prime working years, and most of these younger retirees go on to second careers. All this reform does is make a small adjustment for those younger retirees. If they retire before age 62, the annual increase in their retired pay will be 1% less than the inflation rate. On either side are dusty rows of almond, peach and orange trees. In the summer, the ground is tan and dry. Telephone poles measure out the time for passing cars, their sagging power lines scalloping out to a vanishing point on the horizon. Somewhere almost halfway from San Francisco to Los Angeles is a town called Huron. This is where Carla (not her real name) used to work, shaking almonds from the trees at harvest time for $8 an hour. This is also where she was raped by her foreman. But as a Mexican immigrant with no papers, she was afraid to tell anyone. It’s a common tale. Some 630,000 of the 3 million migrant farm laborers in the United States are women, and at least 60 percent are undocumented. Most are subject to sexual abuse but fear deportation if they speak up. The reauthorization of the Violence Against Women Act (VAWA), which expired almost a year and a half ago, would have helped change that. But after being held hostage by House Republicans who wanted fewer protections for women, it died in the 112th Congress. The next class of legislators will have to start from scratch on a new bill. Meanwhile, women are waiting. A 2010 survey by Irma Morales Waugh of the University of California, Santa Cruz, reported that 80 percent of female farmworkers interviewed had been subject to sexual assault or harassment. This law is offensive at its core. In 2010, Wisconsin enacted a law that allowed the Department of Public Instruction to conduct a hearing on the offensive nature of a Native American public school nickname, logo, mascot or team name if one complaint was received. The so-called School Mascot bill not only essentially repeals this law, it provides more control to the Walker administration by giving hearing supervision to the Department of Administration. In addition, the new law has onerous requirements that will cause complainants to gather signatures from 10 percent of the school district population in order to file a complaint. On July 3, 1863, the third day of battle, Cushing and the 110 men under his command received the full force of Confederate artillery and Pickett's Charge of 13,000 infantry. Over the course of just a few hours, all of his officers had been killed and Cushing himself was wounded. But he continued to fight, and sustained two more wounds before dying on the field of battle. Recommendations for the Medal of Honor must be formally made within two years of the heroic action and awarded within three years. The legislation passed by Congress makes it possible to waive this requirement. Before the Affordable Care Act, if people with Medicare hit a certain threshold of spending on prescription drugs, they would suddenly have to pay out of pocket for the entire cost of the prescription drugs until they reached catastrophic coverage. In other words, the alternative to an agreement would be so painful that the supercommittee would just have to reach one. Unfortunately, the committee couldn’t come to an agreement. And this year, the sequester took effect. Now, House Republicans wanted to keep these savings. In fact, we wanted to save more. But we didn’t think our troops should bear the brunt of these cuts. The Defense Department warned it would have to shrink our armed forces and make serious cuts to training, readiness, and modernization. Members of both parties quickly realized there was a better way to cut spending. When Senator Murray and I started these negotiations, we agreed on some ground rules. It seems to me that the details look a fair bit better than the general outline that had been reported in the press over the past week or so, particularly on the question of whether the entitlement cuts that would replace some discretionary sequester cuts could be expected to actually materialize. As it stands, this strikes me as more or less a very small-scale version of the sort of thing that Republicans hoped might be made possible by the sequester but Democrats insisted could not be: a trade of discretionary savings for mandatory savings without real tax increases. The latter point depends on your view of user fees—I generally think funding government services through user fees is much better than doing so through general revenue, so I take a move toward (slightly) greater reliance on such funding in a few programs to be a reduction in the burden on taxpayers in general without an increase in the size of government. From the point of view of policy, the deal is a modest achievement—which is all that can be expected, given the unfortunate fact that Barack Obama is president and Democrats control the Senate. The trade-off in the deal of minor mandatory cuts for relatively small domestic discretionary increases is basically a wash. That leaves the defense increase, which, while insufficient, is an important step in the right direction. That alone would make the deal worthwhile. But the restoration of the normal appropriations process will also have a good effect, allowing Republicans to argue for reforms and articulate priorities in several domestic policy areas, rather than being the party of a mindless sequester that does little to cut spending, nothing to advance conservative ideas, and discourages efforts at reform. From the point of view of politics, the budget deal is a significant achievement. It averts a meltdown scenario next month, in which it would have become clear that House Republicans don't in fact have the votes in their own conference to insist on the budget caps and sequester. So the real alternative to the deal isn't a more fiscally conservative outcome achieved by Republican unity; it's GOP political disarray and policy defeat.
