Since I learned of the urgent need from Senator Richard Ojeda at Five Loaves & Two Fishes Food Bank in McDowell County, Ive been working with Bob and Linda McKinney, local officials and businesses to help secure a forklift that will allow them to continue receiving shipments and feeding the people of this community. Weve since seen such a wonderful outpouring of support, starting with United Rentals of Beckley which allowed the Food Bank to have immediate use of a forklift that got them through such a critical time of year. A long-term solution was always the goal, and today I am so proud and grateful to announce that Toyota Motor Manufacturing West Virginia (TMMWV) has stepped forward, in great fashion, to donate a forklift to Five Loaves & Two Fishes. I know everyone is moved and humbled by this incredible act of community giving by Toyota, and also relieved to see a permanent forklift finally here in Kimball where the need remains great, and the desire to help and serve remains strong. I would like to thank Tom Lego, Leah Curry and TMMWV for making this moment possible and especially for the individuals, families and children whose lives will be touched by this generous donation. The Senators said in part: Given this increase in black lung disease and the devastating impact that this disease has on coal miners and their families, we believe that it is critical that we maintain this rule. Claims that the Respirable Dust Rule is unnecessary, imposes a costly burden, or provides little to no benefit to society ignore the fact that it can take up to a decade or longer for simple black lung disease to develop. We are also keenly aware that the rate of black lung disease fell after Congress passed the Coal Act of 1969 and that comprehensive evidence that this rule has been effective will not be fully available until 2026 at the earliest. We should not abandon our coal miners three short years after the rule went into effect. U.S. Senator Joe Manchin (D-WV) sent a letter to Scott Gottlieb, Commissioner of the Food and Drug Administration (FDA), and Robert Patterson, Acting Administrator of the Drug Enforcement Administration (DEA), asking the administrations to consider rescheduling and requiring additional risk mitigation for the drug gabapentin, a nerve-pain medication labeled as a drug of concern by the West Virginia Board of Pharmacy. Senator Manchin said in part: While our focus is appropriately on the devastating impact of prescription opioids, there are other prescription drugs that are also contributing to this crisis. In fact, the West Virginia Board of Pharmacy recently designated the nerve-pain medication gabapentin as a drug of concern after the number of overdose deaths related to the drug increased from 36 in 2012 to 106 in 2016. Though gabapentin is currently listed as a Schedule V drug under the United States Controlled Substances Act, West Virginia is not the only state raising concerns about this drug; officials in Kentucky and Ohio have also increased regulation on and surveillance of gabapentin. The GAO report’s findings are in line with a USA Today investigation that prompted Manchin and Heller to introduce the VA Provider Accountability Act. The VA Provider Accountability Act addresses issues raised in the GAO report by requiring the VA to report major adverse actions to the National Practitioner Data Bank and state licensing boards. It will also prohibit the VA from signing settlements with fired or dismissed VA employees that allow the VA to conceal serious medical errors or purge negative records from personnel files. “This GAO report, like the USA Today report that preceded it, is disturbing and shows a pattern of incompetence that could hurt both VA and non-VA patients. These claims must also compete with other priority claims for payment in the event of an employer bankruptcy. A large portion of American workers feel the impact of cut pension benefits.
