https://www.crapo.senate.gov/media/newsreleases/release_full.cfm?id=349250 FDA Heeds Call From Crapo And Others To Revise Fresh Produce Rules 2013-12-20 2013 2013-12 Republican House ID Michael Crapo C000880 www.crapo.senate.gov     legacy December 20, 2013 FDA Heeds Call From Crapo And Others To Revise Fresh Produce Rules FDA received thousands of negative comments; will propose and seek comment on new rule language Washington, D.C. - The Food and Drug Administration (FDA) will revise key provisions of its proposed fresh produce rule after Idaho food producers deemed the new water quality and manure standards unworkable.  Idaho Senator Mike Crapo has repeatedly pressed the FDA for revisions since the draft rules were released pursuant to the Food Safety Modernization Act of 2011.  "The announcement from the FDA is not only a victory for Idaho's farmers and ranchers, but more importantly a victory for consumers across the state and country," said Crapo.  "For months, the agriculture industry in Idaho expressed its concerns about the cost these proposed rules would have on the industry if not properly tailored.  The FDA has heard these concerns and I call on the administration to take a vastly different approach in addressing the needs of both small and mid-sized farms and ranches." On January 4, 2013, the FDA issued a proposed rule for growing, harvesting, packing and holding fresh produce.  Among its requirements, the proposed rule would require weekly testing of all agricultural water at a cost of $35 to $40 per week.  If levels of coliform bacteria exceed the FDA's stringent standard, the farmer must cease irrigation until the water is in compliance, running a high risk of ruining a crop.  The FDA estimates that the cost of implementing this rule would cost a producer approximately $5,000 to $30,600 per farm, depending on size, with a total industry cost of $460 million. Currently agencies base wildland fire suppression budgets on the average costs of the past 10 years, which has underestimated the actual costs 8 of the past 10 years, and forced the U.S. Forest Service and Interior Department to steal money from other important programs to make up the difference. This measure would move any fire suppression spending above 70% of the 10-year average to a disaster funding account that is separate from Forest Service and Interior budgets. Interior and the Forest Service estimate 1 percent of fires consume 30 percent of firefighting budgets, and thus should be treated as true natural disasters. The bill passed the House by a vote of 332-94, with support from 169 Republicans and 163 Democrats.  Simpson said the agreement avoids another government shutdown, preserves dozens, perhaps hundreds, of jobs at Idaho National Laboratory, lays the groundwork for extending PILT payments, achieves greater savings for taxpayers than those contained in sequestration, and does all of it without raising taxes. “My Republican colleagues and I have been seeking reforms to sequestration that lessen the pain on the military, allow Congress to budget in a more orderly process, and maintain or enhance the long-term savings achieved by the Budget Control Act. The first adds a permanent repeal of the onerous 2.3% excise tax on medical devices like pacemakers, CT scan machines, and defibrillators and passed the House by a vote of 248-174. Res. 354, by the House and Senate this week; legislation that will address the impending closure of the Federal Helium Reserve in early October by allowing it to continue supplying helium while also reforming our nation’s helium policy.  "Thousands of high-tech manufacturing jobs in the United States depend on a reliable supply of helium,” Simpson said.  “Micron Technology, which is based in my district, is a large semiconductor manufacturer and a global leader in computer memory technology, and they depend on helium for their manufacturing processes.  If the Reserve stopped making helium available for sale to private entities like Micron, a significant delay might not just slow the production of computer chips, but the computers, life-saving medical devices, and weapons systems that they power.” The Federal Helium Reserve was created in 1926 to ensure a steady helium supply for the nation’s defense needs.  However, federal demand did not live up to expectations, and by the 1990’s, the Reserve had accrued a $1.3 billion debt.  In 1996, Congress passed reforms to require the sale of the Federal Helium Reserve by 2015.  The Reserve is expected to pay off the debt earlier than expected, by October 2013, without having sold off all of the helium. As a result, the Reserve, by law, will close and no longer have the authority to sell the remaining 11 billion cubic feet of helium.  This will create an immediate worldwide helium shortage and cut the domestic supply in half.  “This bill gets the government out of the helium business and moves toward a market based approach,” Simpson said.  “It also reduces the federal deficit by $90 million over 10 years.”  H. To deprive itself of such a combat-proven workhorse such as the A-10 would be a mistake and adversely impact the ability of the Air Force to support the warfighter on the ground.
