BOP’s Criminal Alien Removal Procurement Regulations, require one facility in the Northeastern U.S. and another facility to be located anywhere in the country.  MVCF, which is operated by the GEO Group, Inc., has served as the region’s preferred facility since 2006. The policy reversal follows efforts by Members of Congress to prevent commissioned officers from being forced to retire at their highest previous enlisted rank, including legislation introduced by U.S. Representatives Glenn 'GT' Thompson (R-PA) and Tim Walz (D-MN), H.R. 5832, the Proudly Restoring Officers of Prior Enlistment Retirement (PROPER) Act. "Under the criteria for officer separations, these soldiers should not have been considered," Secretary McHugh stated yesterday afternoon, following the announcement. "This is an issue of fundamental fairness, and today we have taken appropriate action. These soldiers have served their country honorably both as enlisted soldiers and, now, as officers.  We owe them nothing less. We appreciate that this oversight was brought to our attention, and are glad we were able to take corrective action in the best interests of these soldiers." Under the Obama Administration’s force restructuring and end strength reduction plan, many prior-enlisted commissioned officers were being involuntarily retired at their highest enlisted rank, despite years of service in commissioned status.   Under current law soldiers must serve a minimum of 20 years to become eligible for retirement. In order to retire with officer rank, at least 8 of those years must come after receiving a commission. Some soldiers who have served over 20 years total, but less than 8 years as commissioned officers, were being involuntarily retired at their highest enlisted rank, which equated to forced demotions and large reductions in retirement benefits. The ESA peer review process is designed for federal agencies to make formal solicitations of expert opinions and analyses on one or more specific questions or assumptions being used to justify a listing designation.  The Committee report found that frequent FWS recruits for peer review roles are the same scientists that supplied the research at hand, rather than independent experts without any obvious connection to the species under review. “This report reinforces existing concerns over the lack of transparency and questionable processes used by the federal government to develop listing designations under the Endangered Species Act,” stated Rep. The Army is currently undergoing a significant downsizing, as combat forces draw down from Iraq and Afghanistan and the Obama Administration executes a broader force restructuring and end strength reduction plan, which includes plans to involuntarily retire up to 30% of commissioned officers and shrink the Army to 450,000 soldiers. Under current law soldiers must serve a minimum of 20 years to become eligible for retirement. In order to retire at the rank of an officer, at least 8 of those years must come after receiving a commission. Some soldiers who have served over 20 years total, but less than 8 years as commissioned officers, are now being involuntarily retired at their highest enlisted rank, which has led to a large cut in their retirement. In the letter, Shuster emphasized that the proposed WOTUS rule presents serious federalism concerns since it would call for an extra-constitutional relationship between the federal government and the States in the regulation of local land-use matters.  The proposed WOTUS rule would significantly increase the amount of private property subject to federal control, including timberland, farmland, and innumerable waterbodies and other private lands.  Finalizing the rule would allow the federal government to govern virtually any activity impacting an area where water flows, which means federal government permits would be required for all sorts of routine activities – including installing a playground in a backyard or extending a driveway – and would provide a new litigation tool for far-left environmentalists to attack private citizens and businesses.  The public comment period for WOTUS ends on November 14th.
