We’ll hear of communities that meet every expensive requirement heaped on them by state and federal agencies only to be told at the end of the process, “Sorry, the rules have changed and you’ll need to start over.” We’ll hear of lawsuits filed over technicalities that reap unconscionable windfalls for the lawyers – all paid by struggling families in our communities. It is time that pendulum moved back to the middle, and the purpose of today’s proceedings is to define what reforms are necessary to restore common sense and rationality to these laws at both the state and national levels. He is leaving after a truly distinguished legislative career due to term limits, and it is a testament to his dedication to this district that he remains at his post actively engaged in these issues. Californians could not possibly have a more fearless or energetic defender against an over-reaching bureaucracy than Dan Logue and I am very glad to have him here today as well. The first I have talked about on past occasions: that long ago they seem to have abandoned “abundance” as our central objective and replaced it with the rationing of shortages. In fact, we have vast water and hydropower resources that we have simply chosen to abandon. I have raised a second major deficiency on many other occasions and raise it again today: the majority’s abandonment of any attempt at rational cost-benefit analysis or sound financial principles. The development of federal water and power projects was once clear and simple. Potential sources were identified through a forthright cost-benefit analysis. Once identified, the most cost-effective projects necessary to meet demand were then constructed by joint powers authorities established for that purpose. The federal government loaned the projects the funds necessary for construction, and these loans were then repaid by users through their water and power purchases. The communities and consumers that benefited from these projects entirely paid for them and taxpayers were held harmless. This process resulted in cheap and abundant water and power and in turn, unprecedented prosperity throughout the arid West. One of the bills today seeks to restore this principle, HR 6107 by the Ranking Member of the Natural Resources Committee, Mr. Hastings of Washington. It is unfortunate that the Administration has refused to testify on this bill today. The Western Area Power Administration markets and delivers around 10,000 megawatts of hydroelectricity produced at federal dams and paid for entirely by the users. But now, its administrator has expanded its mission to integrate wind and solar power. Since wind and solar power are entirely unreliable, they require a highly complex transmission system and a kilowatt-for-kilowatt backup system to maintain the electrical grid. These systems are extremely expensive and could not possibly survive a rational cost-benefit analysis. To make matters worse, WAPA was granted new borrowing authority and stimulus funding that imposes enormous additional potential costs both on taxpayers and ratepayers who receive no additional benefit. The borrowing authority even provides for forgiveness of the loans to companies that cannot repay them – forcing taxpayers and ratepayers to bail out fiscally irresponsible projects. HR 6107 attempts to restore accountability to the financing of this system by striking the bail-out provisions of current law and requiring that beneficiaries alone bear the cost of these projects – protecting both existing customers and taxpayers from being milked dry by these mandates and mission creep. Two bills utterly ignore cost-benefit concerns and continue to squander our resources. HR 3061 requires taxpayers to pay $4 million to study repairs on the Pine River Indian Irrigation Project – yet before that study is even begun, it authorizes a staggering $60 million to make those repairs. This is a prime example of abandoning any rational cost-benefit analysis and simply shoveling money at a problem that hasn’t even been defined. HR 5039 requires general taxpayers to underwrite and subsidize expansion of the Groundwater Replenishment System in Orange County, California. Once again, we see the majority abandon the principle that beneficiaries pay for water systems, and instead end up plundering one community for the support of another. Finally, we have HR 5413 to settle legal claims by the Pechanga Indians for water rights and development funding under the Winters Doctrine. I fully support this doctrine that assures Indian reservations legal access to water, but I also believe that we have a fiduciary responsibility in deciding legal settlements to do so within the parameters of the Federal government’s actual legal obligations. That means the affected parties and the Department of Justice negotiate a settlement to the satisfaction of both sides. If both sides cannot reach agreement, the matter should be left to the courts. If both sides can reach an agreement, then it should be presented to Congress for ratification. This bill doesn’t do that. Instead, it ratifies a settlement before it has been agreed to by all parties. For example, the California Endurance Riders Association had been using the El Dorado National Forest for many years. This time, when they sought a simple 5-year 10-event permit to continue doing exactly what they have been doing without incident for decades, the Forest Service demanded $11,000 in fees. They paid these fees, but the El Dorado National Forest management nevertheless pulled the approved permit and halted the process on utterly specious grounds. It then demanded an additional $17,000 fee, causing the Endurance Riders Association to cancel what had been a long-term civic tradition that had been a boon to the local economy. In 2010 this outrage was repeated after the group spent $5,800 for the “Fool’s Gold Endurance Run” that had been an ongoing event for more than 40 years. The Polka Dots Motorcycle Club tells a similar story of excessive Forest Service fees that forced them to cancel a ride they have sponsored for four decades. Likewise, the Gold Country Endurance Riders, an equestrian group, had to cancel an event they had been holding since 1993 because of a prohibitive increase in the permit fees. I seriously question the authority of the Forest Service to exact these fees at all, since federal guidelines do not require them if the surveys or research are done in the “public good.” Moreover, it is clear the Forest Service was not dealing in good faith with these groups and that it should refund these fees in full and restore to them the full access to our public lands that they have been accorded for many years. Second, the Forest Service is charging exorbitant Cabin User Fees to families that have had long-term possession of mountain cabins, based on peak market prices from 2007 and 2008. These inflated prices are many times the actual market price in this distressed economy, forcing many of these families to abandon cabins that they have had for decades and even generations. Third, my office has been approached by several families that have had long-established grazing permits dating as far back as 1931, who are now seeing conditions placed on their use that are simply ludicrous. For example, the Leavell Family has grazed cattle in the Tahoe National Forrest since 1931 and by all accounts has been an excellent and responsible steward of the land. The incidents of harassment that they have encountered from the Forest Service have been unconscionable. With absolutely no warning, the Forest Service presented them with a letter declaring that they were in non-compliance because of cattle that occasionally stray off the land. Yet in the past, federal regulations have prohibited them from building fences to prevent that very problem. The Forest Service recently charged that the cattle were damaging Aspen stands – allegations that further inspection proved to be groundless. Having failed to make its case on these grounds, the Forest Service then ordered the Leavells to remove cabins they have maintained and paid property taxes on for 79 years. Also without warning, the Forest Service told the Coughlin family that it was cancelling their long-standing grazing permit because of a lack of sufficient feed as determined by a Forest Service biologist. A subsequent field trip utterly disproved the biologist’s opinion – so the Forest Service next informed them that their permit is still in jeopardy because of the same wandering cows that it used as pretense in the Leavell’s case. Finally – and most importantly, since this affects the safety of entire communities in my district – I remain concerned over the demonstrated disinterest that the Forest Service has recently demonstrated in supporting sustainable timber harvests. The expensive and labor-intensive process of twig removal cannot achieve fuel reductions that reduce the risk and intensity of forest fires. We must restore responsible and sustainable thinning of over populated forests called for in the Herger-Feinstein Quincy Library Group Forest Restoration Act of 1998, and which the U.S. Forest Service is now thwarting in our region. For generations, the U.S. Forest Service maintained a balanced approach to the management of our forests that assured both healthy forests and a healthy economy. Now, it seems to be following a very different policy of exclusion, expulsion and benign neglect of our forests. My office has brought these concerns and complaints of arbitrary and capricious conduct to the Forest Service’s attention without a satisfactory resolution. Practiced in the marketplace, we would renounce these tactics as predatory and abusive. In the public service sector, they are intolerable. This is exactly the kind of abuse of process by this Congress that the American people are growing increasingly disgusted with. This section does not stop the oil leak in the Gulf, it does not clean up the oil in the Gulf, it does not address the needs of Gulf state communities, and it does not hold BP accountable for the Deepwater Horizon disaster. Rather, the majority is attempting to use that disaster as an excuse for enacting a Christmas-tree full of unrelated bills that can’t stand on their own merit and wouldn’t withstand scrutiny if taken up in their own right. The sponsor tacitly admits this by sneaking his bill into this one. Why is the majority trying to avoid scrutiny? Perhaps it is because it is unclear how much these provisions will cost and what, if any, benefits will be derived. For example, this measure protects so-called “Desired non-native species.” I would expect the sports fishermen in California will argue that the Striped Bass is a desired non-native species, given the popularity and economic impact of the industry in California and many other states around the country. However, the striped bass has devastated the populations of several native species that are now listed on the Endangered Species Act, including the notorious Delta smelt. The measure also conflicts with the Multiple Use Sustained Yield Act – because it limits the Forest Service’s ability to give “due consideration” to resource values other than species conservation. And by doing so, it removes cost-benefit consideration – including economic impact – read, JOBS – from decision making. It sets up standards that are contrary to established science on the subject. For example, it requires sustainable populations at the planning unit level – which is frequently a biologically inappropriate scale for a wide-ranging species. Simply stated, this ill-considered section places federal law in conflict with itself – because we are using a single crisis – the Gulf oil spill – to enact unrelated legislation without hearings, without serious consideration and without due process. The Gulf oil spill has done immense economic damage to the Gulf region. Why would we want to compound that damage by enacting a measure that ignores any cost-benefit issues and can only result in locking up vast additional natural resources that could be providing jobs for our people, revenues for our government and prosperity for our economy? Available USGS information suggests that several of these institutes have failed to follow matching requirements, and have in effect, taken the money and run. “Which all would suggest the need for more oversight and not less. Under current law, the USGS is required to submit a program report to Congress over how this program has spent our money every three years. The USGS has yet to submit that report. And yet, it is proposed not only that we further fund it without knowing how this money has been spent – the bill also reduces oversight further by subjecting the spending to review only once every five years. So instead of not getting a report every three years under this bill we won’t get a report every five years. “Moving along… “The other bill raises one question regarding water supplies along the Mexican border while ignoring a more important one. I refer to HR 4719 that seeks to create a permanent governmental entity aimed at providing more funding and water to the border region, although $1.4 billion federal dollars have already been spent for this purpose from 2000 to 2008. “We will hear testimony later today which questions why this bill is not focused instead on protecting the infrastructure that currently provides water. We will hear that the Rio Grande River has become “notorious for illegal crossings of persons and drugs” and of a recently thwarted plot by the Zeta Drug Cartel to blow up the Falcon Dam. “We have a picture of drug smugglers swimming across the Rio Grande that puts the issue in perspective. The open nature of the border has serious consequences not only on our water supplies but this nation as a whole. Two years later he invaded a nation that had nothing to do with the attack. For eight years now, the valiant men and women of our armed forces have fought with constraints never before imposed on American soldiers because of a strategy compromised by irresolution, and political correctness. The current administration has inherited an untenable situation. But it continues and amplifies the folly of its predecessor in three critical areas. First, the administration has defined victory not as destroying the ability and will of the enemy to make war, but rather as “winning the hearts and minds of the Afghan people.” This is a mistake. One nation cannot win the hearts and minds of another nation while waging war against it. The civilian populations of Germany and Japan despised the American occupation but were so exhausted and decimated that they could no longer resist it. It was then and only then – under military government and authority – that we began to shape those societies in a manner acceptable to civilized nations. Second, the administration has placed absurd restrictions on our forces that have greatly complicated their mission, and endangered their security. War is mankind’s most terrible scourge; it is barbaric and cruel and destroys many innocent lives. Most of the casualties of World War II were civilians. If we are to put our soldiers into combat, it must be with the freedom to wage war whether or not civilians happen to be present. Third, MacArthur was correct: in war there is no substitute for victory. By committing inadequate force to win the war and simultaneously announcing our timetable for withdrawal, I fear that President Obama has assured continued stalemate and given the enemy its most valuable ally: time. This policy further undermines the administration’s own civilian-centric strategy by relying on the cooperation of civilians who can reasonably anticipate a return of the Taliban within weeks of the already-announced American withdrawal in the summer of 2011. However, the precipitous withdrawal of American troops has grave implications that will follow us many years into the future and requires a belief beyond a reasonable doubt that greater harm will come to America by continuing the war than by ending it. If America immediately withdraws its troops as ordered by H.Con.Res. 248, we can reasonably predict on the one hand that we will prevent American casualties and conserve American wealth. But the cost will almost certainly be the immediate collapse of Afghanistan, the return of the Taliban, the re-establishment of Al Qaeda sanctuaries, the execution of Afghans who assisted the American forces, and the recognition by hostile governments around the world that America is incapable of defending her interests. The last outcome is the most dangerous because it will figure into countless calculations in unfriendly capitals around the world that could well cost many thousands of American lives in the future. We can be far more confident in predicting the immediate harm from withdrawal than we can predict conditions a year from now for two reasons. The first is the unpredictability of war. The President has recently altered the strategy by ordering a troop surge. For all the reasons discussed above, I doubt that it will succeed but I also must concede that it might. Skepticism that the administration will succeed is not the same as certainty that it will fail. The second reason is that policy can change. The administration has already hedged considerably on its withdrawal announcement. At any time it could restore common sense to its rules of engagement and provide ample force to produce victory. If the strategy is changed then the outcome is changed, but that possibility is foreclosed if the resolution is adopted. In short, the immediate and irremediable harm from a sudden troop withdrawal far outweighs my skepticism of our current strategy and tactics. This prompted the Fresno Bee – hardly a hotbed of conservative activism – to say that Secretary Salazar (quote) “either doesn’t understand the complicated Western water picture or he thinks Valley residents can be fooled by his pronouncements.” This is the same Secretary Salazar who admitted to the Natural Resources Committee last year that the government had the authority to turn the pumps back on but that it chose not to do so because (quote) “it would be like admitting failure.” Absent administration action, we have a bill languishing in the Natural Resources committee that will turn those pumps back on, authored by Mr. Nunes, but the committee obstinately refuses to hear it. Instead, we have Mr. Costa’s bill to use so-called stimulus funding to build fish screens. This is now being touted as some great new relief to the Valley. We’re not willing to turn the pumps back on – which costs taxpayers nothing – but we’re more than happy to shovel untold millions of dollars for fish screens and other environmental mitigations. The approach of the majority party reminds me of something Leo Tolstoy wrote about the Czar’s despotic rule. Despite heavy rains over the past month, the Administration continues to blame a relatively mild drought for the fact Valley farmers will receive only five percent of the water they are entitled to. This does not explain how, in far more severe droughts than this, Valley farmers have received far greater allocations. Nor does it explain how these massive water diversions for the Delta Smelt are justified if supplies are so constratined. Had the Democrats come to Fresno, they would have heard and seen the anguish of the people of the Central Valley of California. The water diversions have destroyed a half-million acres of the most productive farmland in America and thrown 30,000 Central Valley families into unemployment. They would have heard the stories of food lines in communities that once prided themselves on being the breadbasket of the western United States. They would have heard about the frustration of seeing produce imported from China being handed out in those food lines to the very same American farmers who once supplied the same produce to the world. And they would have seen the anger as the absent Interior Secretary’s testimony to the Natural Resources Committee last year was played back, in which he admitted that the Obama administration has the authority to turn the water pumps back on, but that it chooses not to do so because that would be “like admitting failure.” There is some good news. This afternoon, the day after our forum in Fresno, the Interior Secretary relented to the extent of releasing 350,000 to 400,000 acre-feet of water already owned by Central Valley farmers. Having demonstrated his authority to do so, he now needs to follow through and release the water that he holds hostage to the Delta Smelt. Meanwhile, Mr. Nunes of California has introduced HR 3105, the “Turn On the Pumps Act,” which does exactly the same thing that Congress did under far less severe circumstances several years ago in New Mexico. Met with the same intransigence from the Water and Power Subcommittee, Mr. Nunes has filed a discharge petition to bypass that subcommittee and bring that bill directly to the House for a vote. It needs 218 signatures. So far it has 105 – 104 Republicans and only 1 Democrat. Madam Speaker, I assure you that it is not only the Central Valley that is suffering. The willful destruction of 500,000 acres of American farmland by these massive water diversions – all for the enjoyment and amusement of the three-inch long Delta Smelt -- is reflected in the rising prices for produce that families are feeling far beyond the Congressionally created dustbowl of California’s Central Valley. Nor is the Delta Smelt doing any better. Despite these massive water diversions, the Delta Smelt population fell back to the historic low set in 2005, and is now well below the high points recorded in the late 1970s. Given these findings, how can anybody argue that the Delta pumping restrictions are benefiting the Delta Smelt. Madam Speaker, I promised to carry the plea from the many Americans who poured their hearts out to us in Fresno on Monday for Congress to come to the Central Valley and see what their policies have caused. To this day, woven into the fabric of our nation is the underlying ""first principle"" that Americans recognize life as a sacred gift from God, and that we believe protecting the lives and liberty of our people must be the primary responsibility – the first principle – of both our government and our people. This is where you begin to see the uniqueness of America, both throughout history, and in today's world. I still remember the story of Wesley Autrey, a Navy veteran and construction worker who in 2007 risked his life by jumping in front of an oncoming New York subway train in order to save the life of a perfect stranger. He deserved and received great recognition for heroic act, but I think this story depicts more than just an everyday American hero. Contrast Wesley's willingness to risk his life in that subway station to save the life of a stranger, with others in this world who dream of taking their own life and the lives of others, perhaps in that very same subway station, in the name of their radical terrorist ideology. Contrast the unconditional love shown by moms and dads across America who support their children's decision to serve in the military, risking their lives in defense of others, with others in this world who have used their own children as unwilling pawns in terrorist plots to take the lives of others. Contrast the outpouring of love and support from across America these past two weeks for Haitian orphans in need of adoption or other support, with the so-called ""one child only,"" and ""abortion on demand"" policies mandated by other governments on their people. In America, we believe our right to life is granted by God. The peaceful and positive Pro-Life message being shared by people across the nation is working, as we now once again live in a Pro-Life America.
