However, the Supreme Court ruled in United States v. Paroline that an individual defendant who may have received, distributed, or possessed child pornography may not be held liable for a victim’s aggregate damages incurred by potentially thousands of others who have viewed her images, and that defendants may be made liable only for the harm caused by their own conduct, not the conduct of others.   Because of the nature of the crime, child pornography trafficking victims are involved in countless cases across multiple jurisdictions and time. This means that in order to obtain restitution, a victim’s request must be presented in multiple cases across the country. Since the process is so lengthy and overwhelming, only about 20 out of the thousands of child pornography trafficking victims have sought restitution.   The Justice for Child Victims Act remedies this problem by creating a compensation fund that is paid for by child pornography defendants as an alternative avenue for victims to obtain financial support for their losses. As I walked through the museum's entrance, I could not help but think of my late grandfather, born in 1921, and who had seen, endured, and persevered through experiences that many of us today cannot even imagine. He would have stood in wonderment and amazement at the monument to the African American story that now sits on our national mall. I have an unending appreciation for the African American men and women who endured so much to open doors for generations that followed, without them I would not have the privilege of serving the citizens of South Carolina in the United States Senate. Walking through the museum, I experienced not only the weight of the pain and suffering of African Americans throughout the history of our country but also a sense of accomplishment, pride, hope and optimism. African Americans have forever touched the landscape of American history with historic contributions that have enriched our culture, expanded our intellect, and advanced opportunity for people around the world. In the spirit of your efforts to build a living history, I am writing to you today in regards to an important piece of our history I believe has been overlooked. I was saddened and extremely disappointed to learn that the museum excluded the celebration of one of the nation's most influential African Americans and preeminent legal minds, and the second-ever African American to serve on the United States Supreme Court, Associate Justice Clarence Thomas. While Justice Thomas and I do not share the same keen mastery of constitutional law, I can identify to some degree, with some of the inherent stereotypes and personal obstacles that Justice Thomas overcame to reach the pinnacle of his profession. I can attest that, similar to Justice Thomas, as an African American man growing up in abject poverty of the Deep South, without the full arsenal of a nuclear family, and having struggled early on in school, options for my success seemed limited and role models or mentors were hard to find. The National Museum of African American History and Culture has an exhibition specifically entitled ""Making A Way Out of No Way,"" which seeks to explore ""themes of agency, creativity, and resilience through personal stories of African Americans who challenged racial oppression and discrimination and created ways out of ""no way."" I cannot think of a more appropriate African American figure to encapsulate the ""Making A Way Out of No Way"" mantra than Justice Thomas and the impossible socioeconomic obstacles and bigoted hurdles that he has overcome and continues to battle. With those thoughts in mind, I respectfully request that the Smithsonian strongly reconsider the omission of Justice Thomas' significant legacy in the National Museum of African American History and Culture and take the appropriate steps to include a more comprehensive account of his legacy to African American history. House Oversight Committee Update The United States Forestry Service (FS), which is part of the U.S. Department of Agriculture, has recently faced scrutiny following media reports of sexual harassment and gender discrimination. On Thursday, the House Oversight Committee held a hearing to examine sexual harassment and gender discrimination at the U.S. Department of Agriculture (USDA). As witnesses courageously shared heartbreaking accounts of sexual harassment, hostile work environments and discrimination, it was clear the USDA has not held employees accountable or disciplined perpetrators. No one should ever feel unsafe in his or her work environment, and perpetrators should face consequences. The legislation was initiated in response to the growing number of anti-Semitic incidents that have been reported on college campuses nationwide. Statistics show there has been a sharp increase in religiously-motivated hate crimes, many specifically involving anti-Jewish sentiments. According to the Anti-Defamation League, in 2015 there were 90 anti-Semitic incidents that were reported across 60 college campuses, while in 2014 there were 47 incidents on 43 campuses. ""There is simply no place in our country for this kind of intolerance,"" said Scott. ""It falls on us to stand up and do more to stamp out anti-Semitism and other forms of religious discrimination. We must hold to the ideals that our nation was founded on and promote freedom of religion. We must protect that freedom and encourage it."" ""The rise in incidents of religious discrimination and religiously-motivated hate crimes is completely unacceptable. We have to not only condemn it, but work to stop it,"" Senator Casey said. If passed and signed into law by the President, the U.S. Department of Education would be able to use the State Department's definition of what constitutes an anti-Semitic act to assist in investigating illegal discrimination on college campuses. The legislation was initiated in response to the growing number of anti-Semitic incidents that have been reported on college campuses nationwide.  Statistics show there has been a sharp increase in religiously-motivated hate crimes, many specifically involving anti-Jewish sentiments. According to the Anti-Defamation League, in 2015 there were 90 anti-Semitic incidents that were reported across 60 college campuses, while in 2014 there were 47 incidents on 43 campuses.  “There is simply no place in our country for this kind of intolerance,” said Scott. “It falls on us to stand up and do more to stamp out anti-Semitism and other forms of religious discrimination. We must hold to the ideals that our nation was founded on and promote freedom of religion. The Senators joined together to ensure the U.S. Department of Education (DOE) has the necessary statutory tools at their disposal to investigate anti-Jewish incidents. A recent FBI crime report notes that 58.2 percent of religiously-motivated hate crimes were due to the offender's anti-Jewish leanings, and the Anti-Defamation League found that the number of anti-Semitic attacks at colleges and universities doubled in 2015. Currently, the DOE's Office for Civil Rights has stated they will not tolerate incidents such as these, but has not issued firm guidance on what constitutes anti-Semitism. The Anti-Semitism Awareness Act would codify the definition as one adopted by the U.S. State Department's Special Envoy to Monitor and Combat Anti-Semitism.
