Rep. Greg Stanton today celebrated the unanimous passage of the final Water Resources Development Act of 2024, bipartisan legislation he shaped over many months of work on the House Transportation and Infrastructure Committee to authorize water projects in Arizona and across the southwest through the U.S. Army Corps of Engineers (USACE). This vote follows months of negotiations to reconcile House- and Senate-passed versions of the legislation.

“Arizonans know that we cannot take our water for granted. Years of historic drought are straining our already over-allocated water sources—especially the Colorado River. That’s why I’ve worked so hard to prioritize funding for forward-looking and locally-driven water infrastructure projects, so we can make sure we continue to meet Arizonans’ most basic needs,”Stanton said.

He worked to include several key Arizona water infrastructure investments in the final bill, including:

$250 million for Stanton’s signature Arizona Environmental Infrastructure Authority. Stanton’s AZEI, a fund he created in his first term, provides grants to small, rural or tribal communities throughout the state to address water infrastructure needs. Since its creation in 2020, more than two dozen projects have been funded.

In June, Stanton and USACE Commander Col. Andrew Baker were joined by Arizona mayors to sign project authorizations for several AZEI projects, including reactivation of the long-dormant Kyrene Reclamation Facility in Tempe, and construction of an aquifer recharge facility in the City of Maricopa, a detention basin to mitigate flooding in Flagstaff, and a new wells to meet water demands in Tolleson.

WRDA increases the program’s authorization to $250 million which will allow more communities across the state to access the program.

$215 million for the Tres Rios Wetlands ecosystem, allowing the remaining phases of the project to be built after more than a decade of delays. Tres Rios is a part of Rio Reimagined, an ongoing green infrastructure project along the Rio Salado spearheaded by the late Sen. John McCain and Rep. Ed Pastor. Specifically, the project is designed to provide flood control protection and the use of treated effluent from a regional wastewater treatment facility to restore hydrological connectivity and sustain fish and wildlife habitat.

The project is partially complete, with more than $100 million in federal funds spent to date. However, construction has been stalled since 2009 after the project reached its authorized federal funding limit. To restart the project, Stanton secured $1.8 million in the fiscal year 2022 federal funding bill to complete the necessary work needed to adjust the authorization level for the project.

“Phoenix would not be the city it is today without the Salt and Gila Rivers, which have supported life in our Valley for thousands of years. As the City continues investing in the Tres Rios Wetlands to improve water infrastructure and restore critical habitats, ongoing federal support to complete the project is vital,” said Phoenix Mayor Kate Gallego. “I am grateful that Representative Stanton shares this priority and feel fortunate to have him as a partner in Congress. Together, I know we will be able to realize our collective vision for Rio Reimagined.”

Key provisions of Stanton’s bipartisan, bicameral Drought Resilient Infrastructure Act, which he introduced with Arizona Senator Mark Kelly and Representatives Juan Ciscomani and Ruben Gallego in April to provide new resources and authorities through the USACE to support communities experiencing long-term drought conditions. Specifically, the bill:

Increases Capacity to Address Drought Resilience and Ecosystem Restoration: Adds drought resilience as an eligible activity under the USACE’s Section 1135 program, which allows the USACE to modify existing public works projects. Drought resiliency projects that can be carried out under this section include: (1) planting of native plant species that will reduce the risk of drought and the incidence of non-native species like salt cedars; (2) water conservation measures to mitigate and address drought conditions; (3) removal of sediment captured behind a dam to restore or increase storage capacity; and (4) other actions that increase drought resilience, water conservation or water availability.

Creates an Emergency Drought Operations Pilot Program: Creates a pilot program in Arizona, Nevada and California to allow the USACE to operate dams and reservoirs it owns or regulates to address drought conditions. This could allow facilities, like SRP’s Roosevelt Dam, to retain more water during wet years to save it for future dry years.

Forecast-Informed Reservoir Operations: Modifies the Forecast-Informed Reservoir Operation Pilot Program in the America’s Water Infrastructure Act of 2018 to require an evaluation and report of operations at a reservoir in the Colorado River Basin to determine the viability of forecast-informed reservoir operations, this involves including water conservation as a project purpose and modifying the facilities to support drought resilience.

However, some internet service providers in Arizona under contract with the RDOF program have shown no signs of progress and appear to have a high risk of defaulting on their commitments to provide internet service.

Stanton this week pressed FCC Chair Jessica Rosenworcel to clarify the timeline of eligibility for BEAD funding to ensure no communities are left behind. He also asked the chair to clarify the timeline and plan to allocate the second round of RDOF funding.

I’m proud to have introduced H.R. 9024, the Extreme Weather and Heat Response Modernization Act, with my colleague from Las Vegas, Ranking Member Titus. . . a bill that would give FEMA tools it desperately needs to address extreme heat.

We represent two states – Arizona and Nevada – on the very forefront of a public health crisis.

This week, back home in Phoenix, daily highs are supposed to dip below 100 degrees for the very first time since mid-May. 113 days, almost four straight months, of triple digit heat. That’s an all-time record. And more than half of those days had highs above 110 degrees.

We joke back home, “It’s a dry heat.” But heat like that . . . when the temperatures at night hover in the 90s. . . it takes a brutal toll on the human body. Especially for vulnerable populations like seniors, people with health conditions and people experiencing homelessness.

Last year, 645 people died from heat-related causes in Maricopa County—a 50% year-over-year increase.

Local governments are doing what they can. This summer the City of Phoenix, using a combination of one-time local, state, and federal resources, extended the operating hours at five of its heat relief sites… including providing overnight support at two locations. They recorded nearly 30,000 visits. . . 900 of those who sought relief from nighttime heat.

These cooling centers are essential, as most heat deaths occur outside. But increasingly, some of our most vulnerable residents aren’t even safe inside their homes. In Phoenix, air conditioning isn’t a luxury – it’s a necessity. And losing your AC is now a life-threatening event.

Since 2011, 819 people have died indoors from heat-related causes in Maricopa County. And in 75% of those cases, their air conditioners were either broken or turned off. These are some of our most vulnerable citizens. . . often seniors living alone, on a fixed income, who can’t afford to pay for a new AC unit or a high summer electric bill.

Again, city and county governments have stepped up to provide financial assistance utility assistance and repairs. But, as a former big-city mayor, I know firsthand how strained local government budgets already are.

If Phoenix was being hit with a hurricane, or pummeled by tornadoes, or extreme flooding, FEMA would be able to provide federal assistance. Well heat kills twice as many people each year as hurricanes and tornadoes combined.

Extreme heat is a long-term natural disaster, and we need the federal government to start treating it as such.

This bill, H.R. 9024, couldn’t come soon enough. It enables FEMA to better address extreme heat and to provide local governments with more resources to keep people safe, including unlocking federal funding for cooling centers.

Specifically, this bill will direct FEMA to review the process for determining incident periods for disaster declarations authorized by the Stafford Act, since heat is not currently recognized.

It also directs FEMA to consider what is eligible for hazard mitigation grants under the Building Resilient Infrastructure and Communities, or BRIC, program . . . like stockpiling and installing equipment, such as portable air conditioners, and allowing for community cooling centers and resilience centers to take part of this funding.

The bill directs FEMA to develop guidance for local entities to respond to extreme heat events, . . . and it authorizes a study measuring the impact of extreme heat on infrastructure, the economy, and public health in order to develop a framework for mitigation and response.

I’ll close by saying that while Phoenix and Las Vegas are on the frontlines of this crisis, communities around the country are dealing with more frequent dangerous heat waves. . . from the urban pacific northwest to the rural deep south. In March 2021, at Stanton’s urging, the House Judiciary Committee held a hearing on the impacts of radiation exposure for Downwinders – the first time in two decades that victims in the Southwest were given an opportunity to speak before a House committee on the urgent need for justice to their communities.

Stanton invited Mohave County Supervisor Jean Bishop to testify. She told the Committee, “While, at the time, we were encouraged to celebrate the advances of our government finding methods to protect U.S. citizens; unfortunately, we were blind to the fact that radioactive fallout would kill and sicken numerous members of our family.”

Congress voted to extend the RECA program for two years in May 2022 but did not expand eligibility to downwinders in Mohave and Clark Counties.

In March, the Senate passed a five-year extension of the RECA program and expanded the geographic downwinder eligibility to include all counties in certain Western states, including Arizona; added eligibility to people living around improperly stored nuclear waste sites; and extended the time for RECA eligibility from 1971 to 1990 for uranium workers (miners, millers, core drillers, and ore transporters).

RECA has awarded over $2.4 billion in benefits to more than 38,000 claimants to date. However, the program is scheduled to sunset on June 10th, 2024.

Background

The United States government conducted nearly 200 atmospheric weapons development tests as part of Cold War security from 1945 to 1962. These tests exposed thousands of Americans to cancer-causing ionized radiation from nuclear fallout. When the injuries were discovered, Congress attempted to make amends on behalf of the nation by passing the Radiation Exposure Compensation Act to establish a trust fund for partial restitution to individuals who have contracted certain cancers and other serious diseases that can be directly attributed to the radiation exposure from the nuclear weapons testing.

Unfortunately, that bill included serious boundary flaws that have prevented otherwise eligible Arizonans from receiving justice and the compensation to which they are entitled. Americans that reside in counties in close proximity to where the testing occurred are excluded from this program for no logical scientific reason, specifically residents in Mohave County, Arizona and Clark County, Nevada.

The serious effects of exposure to low doses of radiation can be unpredictable, but incredibly harmful. There’s a higher tendency among Downwinders to develop certain cancers including Leukemia, Multiple Myeloma, Lymphomas and many more. As a result, thousands have suffered from cancer, and far too many have died. The Congressmen also noted that tax rebates enacted by 21 states were determined to be tax exempt in guidance issued by the IRS in February 2023. Arizona's tax rebate wasn't signed into law for another three months, yet the IRS dragged out its decision to make the rebate taxable well past the period when state payments were issued.

“In December 2023, the IRS relayed its decision orally through a video meeting, providing no written explanation until February 15, 2024, eighteen days after the start of tax season, and only in response to a letter from the Arizona Attorney General challenging the decision.

“In addition to failing to specify the factual and legal basis for the twenty-one states' rebates and payments that were deemed nontaxable in 2022, and despite several of these programs being far less targeted at individual needs than the Arizona Tax Rebate, the inconsistent rationale left the state with no timely redress and no choice but to compel upon Arizona taxpayers an estimated $20.8 million in extra federal taxes. The inconsistency and delay in communication have resulted in undue financial strain on Arizonans.”

$1,666,279 for North Tempe to add an additional 100 units of affordable housing. These funds will be used to provide multi-family affordable housing for families, seniors, veterans and those with disabilities. The City of Tempe has committed to maintaining 49.3% of its housing inventory as affordable. Currently this supply is 26% and well below community demand.

Mesa

$959,752 for the City of Mesa to make water main improvements, and $800,000 for Mesa to install Smart Meters. These funds would allow the city to purchase equipment to inspect and repair its water transmission mains to maximize the efficiency of the distribution system to reduce water loss, and fund the purchase and installation of 12,000 smart meters in several vulnerable communities to promote water conservation and sustainability. As conditions on the Colorado River become more serious, it is important that the City and customers have greater stewardship over their water consumption and intuitive information to make water efficient choices at homes and businesses.

$1,000,000 for the City of Phoenix to help construct the new Fire Station 74 in Ahwatukee to meet the rapidly growing demand for fire and emergency response in the community. Due to the increased demand and population growth, the fire department emergency response times currently exceed the National Fire Protection Association response standards in this area.

Recruitment and relocation bonuses: If deemed necessary, provides recruitment incentives to new employees and relocation incentives to current employees to relocate to a different area. Employees receiving bonuses must enter into a written service agreement for at least two years.

Retention bonuses: Allows DHS to offer a retention bonus if an employee is likely to leave CBP. Employees receiving bonuses must also enter into a written service agreement for at least two years.

Special Pay Authority: Gives DHS the ability to use rural and remote location for consideration of a special pay rate.

Note on Bipartisanship

This is a framework and a discussion. The best immigration solutions have bipartisan consensus.

New Democrats are committed to lasting solutions to our nation’s problems and recognize such solutions are often the result of bipartisan efforts. There are areas to be flexible within this framework.

Section I: Strengthen America’s Economic Competitiveness

To build a 21st Century economy in which all Americans can succeed and establish the United States as the strongest economy in the world, the nation must develop a workforce that can continue to lead the world in innovation and advanced manufacturing. A key component of this effort is expanding and improving our high-skilled immigration to attract and retain the brightest minds from around the world. As business leaders from across the country have said, the United States should streamline the immigration process for high-skilled workers, recent college graduates and entrepreneurs to come, stay and contribute to our economy.

Eliminate the per-country cap for employment-based (EB) immigration visas and raise the family-sponsored per-country visa cap from 7 percent to 15 percent.

Increase the number available EB visas to keep up with workforce demands.

Section II: Build the Workforce Our Economy Needs

Worker shortages are creating supply chain bottlenecks and driving up costs for our most essential goods and services. From food to construction to health care, nearly every sector of the American economy faces rising costs due to workforce challenges. At the same time, small businesses can’t grow without a stable, reliable workforce. New Democrats believe the United States must take significant steps to meet the needs of American businesses and reform our worker visa system to meet labor market demands—because it’s good for business and for consumers.

Establish a pathway for migrant farmworkers in the United States to earn legal status and make commonsense reforms to the H-2A visa program.

Permanently authorize the Conrad 30 waiver program, which allows physicians studying in the United States on a J-1 visa a pathway into the country upon graduation.

Create a new temporary non-immigrant visa category for year-around work in industries experiencing occupation shortages.

Section III: Secure Our Nation’s Border, Once and For All

Both migrants and U.S. citizens deserve a secure southern border. Transnational criminal organizations trafficking drugs like illicit fentanyl and exploiting vulnerable migrants pose a danger to communities across America. The Customs and Border Protection agents who put their lives on the line every day to keep our communities safe have made clear that Congress needs to provide more funding to recruit and retain qualified personnel, and for improved technology and infrastructure. Migrants seeking to enter the United States are often forced to bypass legal pathways due to limited options, processing delays, and inconsistent adjudications.

Fund the Department of Homeland Security (DHS) at a sufficient level that ensures that Customs and Border Protection has no fewer than 22,000 full-time Border Patrol agents, increase the number of CBP officers at ports of entry by at least 500 to help halt the flow of illicit drugs such as fentanyl, increase CBP retention bonuses and raise the minimum pay rate of Border Patrol agents at or below the GS-12 pay scale level.

Fund DHS at a sufficient level that ensures it can upgrade the technology used at the border including investment in radar surveillance systems, mobile remote video surveillance systems, manned and unmanned vehicles; drones; the CBP One app; and CBP’s internal communications systems and improve infrastructure at the border including investment to upgrade roads and other pathways; clear invasive species that impede sightlines, and—in strategic locations where necessary—upgrade physical barriers.

Direct DHS to implement biometric monitoring at their ports of entry by 2030 in accordance with Congressional Mandate.

Section IV: Embrace Those Who are a Part of the American Fabric: A Pathway to Citizenship for Dreamers and TPS Holders

New Democrats agree with the majority of Americans that our nation is long overdue in providing certainty, stability and opportunity for Dreamers and TPS holders. These young people have lived in the United States for most of their lives and become integral members of communities across the country. Dreamers and TPS holders strengthen America everyday by getting an education, caring for their families, earning a living, and paying taxes. Nationwide, millions of small businesses, schools and doctors offices rely on these young people for a qualified, trained and stable workforce.

Grant Dreamers conditional permanent resident status if they sufficiently meet criteria, including passing security and law enforcement background checks; paying reasonable application fees; have received a high school diploma, GED, are in a program assisting them in obtaining a high school diploma or GED; or are working.

Grant Dreamers lawful permanent resident status if they acquire a degree from an institution of higher education, or complete at least two years of a post-secondary level degree program while remaining in good standing; complete at least two years of military service or are honorably discharged; OR maintain continued employment for a minimum of three years, at least 75 percent of which the individual was authorized to work in the United States.

Pursuant to current naturalization requirements, permit Dreamers to apply for U.S. citizenship upon maintaining permanent resident status for five years.

Grant Temporary Protected Status (TPS) and Deferred Enforced Departure (DED) Holders lawful permanent residence if they have been in the country over three years and pass security and law enforcement background checks.

Section V: Provide A Path to Legal Status for Those Who Pass a Background Check and Pay a Fine

If undocumented immigrants have been in this country for more than five years, working and paying taxes, they should be afforded the opportunity to earn their way to legal status. However, they have to satisfy certain requirements—including meeting strict eligibility criteria, paying a fine, and passing a criminal background check.

Grant undocumented immigrants who arrived to the United States when they were over age 18 and have been present for five years temporary legal status, only if they pay fine, pass a criminal background check, have not been convicted of a felony offense in the United States or their country of origin, and are enrolled in school or work full time.

At the end of five years, grant those individuals lawful permanent residence status if they continue to meet certain criteria.

Section VI: Fully Enforce Our Nation’s Immigration Laws

The American people need to have confidence that the United States will enforce all immigration laws. Undocumented immigrants who committed a felony, and those who fail to earn legal status, must be held accountable.

Initiate legal proceedings for undocumented immigrants that do not qualify for temporary legal status. Undocumented immigrants who committed a felony, and those who fail to earn legal status, must be held accountable.

Modernize compliance tools to digitally ensure U.S. employers can determine the work eligibility of new hires, with assistance to small businesses and safe harbor for employers that attempt in good faith to comply.

Provide judicial discretion for immigration judges to consider marital, veteran, and other ties to the United States and specific communities when deciding legal status cases.

Section VII: Reform our Broken Asylum System and Safeguard it From Abuse

Seeking asylum from violence and persecution is a human right protected under existing law, but paralyzing backlogs and chronic understaffing in immigration courts mean asylum seekers can wait years for a hearing. That’s unacceptable. New Democrats propose a structural overhaul of the broken immigration court system, one that reestablishes trust and transparency. Additionally, we must encourage and provide resources for migrants to apply for asylum before they make the dangerous journey to our border.

Transition the nation’s immigration court system into an independent judiciary, consistent with Article I of the U.S. Constitution.

Provide funding to hire additional immigration judges and staff support to address the significant backlog of asylum cases and accelerate the adjudication process.

Establish new regional processing centers (RPCs) in Latin America to allow asylum-seekers to visit the nearest RPC before traveling, receive an interview, and if eligible, be processed for lawful entry into the United States, Canada, Spain and other participating nations.

Section VIII: Strengthen U.S. Bilateral Relationships and Address Root Causes of Migration

The United States cannot do this work alone. We must prioritize deep and sustained engagement with Latin American nations–especially Mexico–as well as regional NGOs and the private sector to address the root causes of migration and combat drug trafficking. With Mexico surpassing China as the United States’ top trading partner last year, our economic relationship with Latin America is becoming increasingly important. Bolstering regional economic integration will improve the lives of people across the hemisphere and address the root causes of irregular migration.

Work with the Department of State, international non-governmental organizations (NGOs), and local authorities to disrupt the flow of drugs and illicit fentanyl and fentanyl-related substances, including by sharing information on precursor chemicals, providing more detection tools, addressing gang recruitment, and encouraging local education for local work.

Improve economic partnerships, including by exploring trade opportunities, access to financial markets, and foreign direct investment to solidify relationships.

Section IX: Expand Legal Immigration Pathways

Under current law, migrants face convoluted and restrictive legal pathways to immigrate to the United States. Therefore, they often choose to bypass the legal immigration process altogether and attempt dangerous and illegal border crossing between ports of entry. Expanding legal immigration pathways would alleviate the stress at the border, expand the workforce, and ensure migrant families remain united.

Expand employment-based pathways—including allocating 100,000 additional green cards per year for international graduates of U.S. colleges and universities, exempting the dependents of employment-based green card holders from numerical caps that apply to employment-based green cards, and establishing a “startup visa” program that would provide legal permanent status for immigrants seeking to start businesses in the United States.

Replace the outdated existing numerical caps for visas on employment, family reunification, and diversity bases with percentage-based caps that allow immigration to grow with the American population and economy.

Section X: Encourage the President to Take Executive Action

New Democrats urge the President to use all executive powers vested to him under the Constitution to take targeted steps that improve our immigration system. This grant represents a unique partnership of governments, involving State, federal, tribal, and county governments in the planning and development of the grant to address the safety and infrastructure needs in Arizona and within the Gila River Indian Community. The grant funding will be added to the $692 million in state of Arizona funding appropriated for the project and a $221 million contribution from the Maricopa Association of Governments (MAG) through Proposition 400. The total project cost is estimated at just over $1 billion.

Background

The grant - funded through investments from the bipartisan infrastructure law - provides necessary funding for the southernmost segment of the 26-mile stretch and completes funding for the upcoming expansion of I-10 between Phoenix and Casa Grande.

The overall project adds a third lane, meaning the freeway will have three lanes both ways between Arizona’s two most populous cities. It also includes the reconstruction of the I-10 Bridges over the Gila River and six interchanges. The federal grant is a competitive funding award through the U.S. Department of Transportation INFRA Grant Program.

The grant will contribute to the construction of the section of the project from just south of Casa Blanca Road to just south of State Route 387. Construction on I-10 is scheduled to launch in early 2024, with the first work including the removal and replacement of the Gila River bridges over I-10.

Significant partnerships with the Gila River Indian Community and other nearby communities have taken place over the past few years. An engineering and environmental study for the project is currently being completed in coordination with GRIC and MAG and includes the following proposed improvements:

Corridor Improvements - Capacity and Safety:

Adding a new general-purpose lane in the east- and westbound directions, extending the High Occupancy Vehicle (HOV) Lane on I-10 from Loop 202 to Riggs Road, and improving interchanges and crossroads will increase capacity and access. This improves safety by reducing congestion and travel times and lessening detoured traffic on the Gila River Indian Community.

Replacing I-10 bridges over the Gila River will maintain a state of good repair by modernizing this key infrastructure.

Building new and improved traffic interchanges creates safer crossings for farm equipment, bicyclists, and pedestrians and boosts connections and quality of life.

Installing fiber optic infrastructure within ADOT Right-of-Way will allow for the installation of sensors, cameras, and other highway safety-related technology.

Key Commerce Corridor, Arizona Jobs, and Local Connections:

As the principal roadway between metro Phoenix and Tucson for commuters, cross-country travelers, and commercial traffic, I-10 is a Key Commerce Corridor for Arizona and the U.S. The freeway provides a vital link for freight traffic from the ports of southern California and for international commerce, with a significant amount of freight transported along the route daily. The proposed improvements will boost the reliability of freight traffic in the corridor.

The project, coupled with others around the state, will help attract employers and create jobs in Arizona.

Locally, the route serves the Gila River Indian Community by improving connections to employment, medical, educational, and other critical services both within and outside of the Community.

Greg Stanton, chair of the New Democrat Coalition’s Immigration and Border Security Task Force, and 58 Coalition members sent a letter to Republican Speaker of the House Mike Johnson urging him to work across the aisle in good faith on bipartisan legislation to secure our southern border and reform our broken immigration system.

The letter reads in part:“It is unfortunate that you and members of your Conference have described the situation as a winning political issue, and suggested that you would wait to act on the border until a Republican president is elected. This is unacceptable. We respectfully urge you to put the American people and our nation’s security ahead of petty partisan politics. It is long past time to negotiate in good faith on a bipartisan solution to humanely secure our southern border and reform our immigration system.”

Dear Speaker Johnson,

The New Democrat Coalition has continually recognized the urgency of the situation at the border. In May, we called for comprehensive immigration reform and increased funding to secure the southern border. In July, we urged the Biden Administration to request supplemental resources to bolster border operations. In November, we implored you to bring the Administration’s national security supplemental to the floor for a vote. And we have repeatedly called for bipartisan solutions to meaningfully address the challenges presented by increased migration, the flow of illicit fentanyl through our ports of entry, and the backlog of visa applications and asylum cases in our immigration courts.

That is why we were dismayed by your comments this week that you refuse to even consider a bipartisan solution to securing our border or bring to the floor the national security supplemental. It is unfortunate that you and members of your Conference have described the situation as a winning political issue, and suggested that you would wait to act on the border until a Republican president is elected. The signs are incredibly popular with drivers. And in a nationwide survey completed by the FHWA, more than 80% of respondents said they understood the messages on creative highway signs.

In the letter, the Congressmen requested the FHWA:

Explain the analysis that went into the FHWA’s decision to issue this guidance in the Manual on Uniform Traffic Control Devices for Streets and Highways.

Specify if there was crash data or fatality data that went into these decisions, and how those statistics were tied to sign messaging.

“My team and I worked with ADOT to make [their grant] as competitive as possible,” Stanton continued. “It is my hope and expectation that this project will move forward very soon.”

Responsible stewardship of the economy must include immigration among other robust policies to complete our post-pandemic recovery.”

The letter echoes the calls from 126 employers who wrote to the Biden Administration asking to expand visa usage, and calls from 19 state attorneys general, including Arizona’s.

As members of the New Democrat Coalition, we write to ask that the Biden Administration take immediate steps to distribute work authorizations to immigrants more quickly and efficiently in order to fill worker shortages and further bolster the economy.

Under current law, asylum applicants must wait 180 days before receiving legal work authorization, or an Employment Authorization Document (EAD). In practice, these wait times currently last for many months beyond the initial waiting period, in part because the Administration faces a backlog across application and petition categories, resulting in an overall lack of resources and capacity to keep pace with EAD adjudications. These delays exacerbate the short-term need for employees in key industries and impose financial hardships on migrant families who would otherwise seek work and contribute to our economy.

Immigration is a key solution to U.S. workforce shortages. The Bureau of Labor Statistics’ Job Openings and Labor Turnover Summary, published October 3, 2023, show the number of job openings increased to 9.6 million on the last business day of August. Workforce shortages are particularly concentrated in manufacturing, farm work, and hospitality-- – all industries in which foreign labor plays a critical role. Easing workforce shortages will benefit other parts of the economy, such as by reducing inflation and more efficiently meeting post-pandemic consumer demand. A study by FWD.us estimated that adults admitted to the U.S. under humanitarian parole contributed to about 25 percent of the decrease in job openings in understaffed industries which would otherwise have remained unfilled.

Business leaders in many of our states and districts have led the call for reform. On August 15, 2023, one hundred twenty-six employers called on the Administration to expand visa usage and give states the authority to act on their workforce needs. This proposal is also backed by a bipartisan group of governors.

Comprehensive immigration reform must be led by Congress, and the New Democrat Coalition continues to call for common-sense, bipartisan immigration legislation. However, the Biden Administration should utilize its rulemaking authority to support employers and bolster the U.S. economy. To further remedy the workforce challenges facing these communities, we ask the Administration to take the following actions:

Coordinate with employers and stakeholders to develop policy proposals to shorten the waiting period for asylum applicants before they receive work authorization.

Continue aggressive efforts to prompt those migrants currently eligible for work permits to apply. We applaud the Administration for its campaign, beginning in September 2023, to inform the over one million migrants eligible for work permits that they are able to apply, and strongly encourage continued investment in similar programs.

Coordinate with local and state law enforcement officials to combat immigration scams targeting recent migrants, humanitarian parolees, and asylees.
