The Fiscal Year 2023 National Defense Authorization Act ends the harmful DOD vaccine mandate for active duty, reserve, and national guard personnel, preserving our military’s readiness and ensuring our troops will not be discharged for refusing the COVID-19 vaccine. The bill authorizes $858 billion for national defense, $45 billion above the President’s request. Background:

The Supreme Court’s 2015 decision in Obergefell recognized a legal right to same-sex marriage and gave those marriages legal rights in every state. The Supreme Court majority in Dobbs made clear that its holding did not cast doubt or put into question any of its precedents, including Obergefell and the right to same-sex marriage.

The bill passed by the House today provides the Attorney General and individuals claiming to be harmed by violations of this bill to bring civil suit in federal court. The Senate-amended bill also does not protect private entities if they are determined to be a state actor as a result of the services they offer on behalf of a government. Senate Republicans offered three amendments, which all failed, that would have eliminated the private right of action and prevented the government from taking action that would deprive religious and faith-based organizations of their tax-exempt status, licenses, and government contracts.

For years, the Left has sought to undermine the legitimacy of the Court, organizing smear campaigns against Justice Kavanaugh and Justice Thomas. On August 19, 2021, the Secretary of Defense directed the Military to “immediately begin full vaccination of all members of the Armed Forces under DoD authority on active duty or in the Ready Reserve, including the National Guard, who are not fully vaccinated against COVID-19.” On August 11, 2022, the Centers for Disease Control and Prevention updated its COVID-19 guidance to ease recommendations for people who are unvaccinated and have been exposed to COVID-19, essentially the same recommendation as those who have been vaccinated. Despite every branch of our military struggling to meet recruitment goals, Secretary Austin has continued to stand behind the COVID vaccination mandate which not only will require the discharge of trained and competent servicemembers but harm future recruitment.

On August 1, 2022, Secretary of the Air Force Frank Kendall penned a letter to all Airmen, Guardians, civilian employees, and families that concludes with commending them as they “met and defeated the pandemic.” If that is the case, it is worth questioning why the Air Force has not abandoned its vaccine mandate, particularly given the CDC’s new guidance and its own study showing natural immunity from prior infection granted stronger levels of protection against the Delta variant of COVID-19 than vaccination alone.

On October 15, 2021, Moore wrote a letter to the Secretary of Defense urging him to delay the COVID-19 vaccination requirements for members of the military and civilian contractors until a full review of concerns from the medical community on potential health risks from the vaccine can be completed and evaluated.

The Congressional Budget Office (CBO) confirms that $20 billion of the revenue generated by this bill will come from IRS audits of lower- and middle-income taxpayers. It was CBO's own numbers Democrats relied on to claim they could pull in $124 billion (after spending $80 billion for 87,000 new agents).

The “Inflation Reduction Act”:

Provides $369 billion in Green New Deal giveaways that will increase our reliance on China.

Boosts Taxes During a Recession: The 15% minimum tax on book income amounts to a double tax in the middle of a recession while raising prices and killing jobs – something that former President Obama and Senator Manchin have both argued makes no sense.

$124 billion tax on American pensions: The bill includes a new excise tax on stock repurchases. Contrary to the cynical rhetoric peddled by Democrats, stock buybacks return value to the 58 percent of Americans invested in the stock market and the 60 million Americans with a 401(k) plan. This $124 billion tax hike would hurt every American in the stock market and the retirement savings of working-class Americans – all to pay for payoffs to liberal special interests in the form of more than $400 billion on Green New Deal giveaways.

Fund Biden’s IRS Army: Biden’s IRS Army: The bill weaponizes the Internal Revenue Service (IRS) with about $80 billion in new funds (6x IRS’s annual budget) meant to hire tens of thousands of new IRS agents who will spy and harass Americans. This would include $45.637 billion in funding for IRS enforcement. This funding could be to enforce the IRS’ proposal to spy on Americans with more than $10,000 worth of financial transactions. Provides tax Breaks for Green Energy Corporations: The bill would reauthorize expired tax subsidies and extend others that benefit green energy technologies almost exclusive. $52 billion tax hike on small businesses: Under current law, small businesses who file taxes as individuals are limited in their ability to deduct losses. This provision, along with the 20 percent deduction for small businesses included the Tax Cuts and Jobs Act, is set to expire after 2026. In a last-minute amendment, Senate Democrats extended the limit on small business losses but did not extend the 20 percent pass through deduction. This amounts to a $52 billion tax hike on small businesses. Worse, this amendment was included to replace an extension on the cap on the State and Local Tax Deduction as a pay-for. CHIPS-Plus Act:

After failed conference negotiations on an American competitiveness package to confront China, the Senate amended H.R. 4346 to send billions of taxpayer dollars in subsidies and tax credits to a specific industry that does not need additional government handouts. While acknowledging the threat China poses to American industrial supply chains, this corporate welfare bill will not effectively address that important challenge. At a time when Democrats’ reckless spending policies have led to historically high inflation, the government should not be injecting hundreds of billions of dollars in additional subsidies into the economy. This legislation comes to the House precisely as Senate Democrats have allegedly struck a deal on their partisan reconciliation bill, pairing up a tone-deaf agenda that on one hand gives billions away in corporate handouts, and on the other hand undoes historic tax cuts implemented by Republicans. The partisan Democrat agenda has given us record inflation, and now they are poised to send our country into a crushing recession.

CBO estimates that CHIPS-Plus increases the deficit by $79.3 billion over the years 2022 to 2031. Specifically, Division A would increase direct spending by $51.9 billion (CHIPS for America Fund and Wireless Supply Chain Innovation) and decrease revenues by $24.3 billion (25 percent Advanced Manufacturing Refundable Investment Credit) over the next ten years.

These CHIPS subsidies will not alleviate existing semiconductor supply constraints because it will take years for new facilities to ramp up and begin production. Moreover, this corporate welfare package will create a windfall for many successful companies that have already committed to build in America, with projects currently underway.

The bill provides $52 billion in semiconductor-related grant funding to the Biden Administration that lacks sufficient guardrails, has little Congressional direction on how it should be distributed, and provides limited opportunity for future Congressional oversight, allowing this inept administration to pick favorites and attach strings when distributing these federal dollars.

In addition, the bill authorizes the appropriation of about $200 billion over the 2022-2031 period, primarily for research activities, including $81 billion over 5 years for the National Science Foundation.

Instead of industry specific subsidies, broad based tax incentives would do more to increase the U.S.’s global competitiveness. For about the same cost as CHIPS subsidies ($52 billion in grants + $24 billion tax credit), Congress could enact a powerful set of incentives to allow all American companies to compete and win in the global economy:

Double research and development (R&D) tax credit through 2025 ($69 billion).

100 percent expensing through 2025 ($5 billion).

Allow R&D costs to be deducted immediately through 2025 ($4 billion).

The Alabama legislature enacted the Human Life Protection Act in 2019, reflecting the will of the citizens of the state. The bill imposed a near total ban on abortions in the state. I will not allow those voices to be silenced by radical federal abortion bills.

I urge my colleagues to oppose this measure, and all of the extreme measures yet to come attacking the most vulnerable.

Wipes out all pro-life protections at the federal and state levels and removes states’ ability to legislation on abortions.

Weakens conscience protections for medical professionals and limits their right to refuse to participate in abortion procedures.

Allows for discriminatory abortions based on sex, race, or disability.

Ensuring Access to Abortions:

H.R. 8297 is another reactionary piece of legislation that was thrown together last week in response to the Supreme Court’s Dobbs ruling in June. This bill is poorly written and full of loopholes that raise serious concerns and questions regarding parental rights and access to chemical abortions. Active Shooter Alert Act

This bill failed to pass the House on suspension last month and creates new and unnecessary authorities within the Department of Justice with the mandate to create new alert systems for active shooter scenarios. This new alert system that solely focuses on attacks with firearms versus all violent attacks is unnecessary and redundant due to existing state and local alert systems.

This legislation establishes an Active Shooter Alert Coordinator at the Department of Justice to encourage communities to develop mass alert systems that will notify people in the immediate vicinity of an active shooter in a populated area.

The bill fails to clearly state when the new system should be used by broadly defining “active shooter” and “populated area” in a way that will allow for active shooter alerts to be sent in virtually any scenario involving the discharge of a firearm.

State and local officials already have the ability to use the existing Integrated Public Alert and Warning System to alert the public to emergency situations, which include active shooters.

As of 2019, there are more than 1,400 alerting authorities across the country, and 400 additional applications were pending with FEMA.

""This action by the Biden Administration's Department of Justice will continue to erode the public’s trust in the election process and will raise public perception that fraudulent votes are being cast,” said Rep. Gary Palmer. “My bill, H.R. 8223, the Citizen Ballot Protection Act, will fix the problem by amending the National Voter Registration Act of 1993 to give states the ability to verify the citizenship status of their voters when they register. This is a commonsense solution that allows states to require proof of citizenship for something as sacred as voting.”

Background:

To strengthen voter roll integrity, many states are adding proof of citizenship requirements before someone can register to vote. However, this protection does not extend to voters that register through the National Voter Registration Act (NVRA) federal mail voter registration application form. This federal form is used to register to vote in federal elections and the information collected by the form is listed in the NVRA.

Because proof of citizenship is not listed as an option to add to the form, in Arizona v. Inter Tribal Council of Arizona, the Supreme Court in 2013 held a state requirement to show proof of citizenship in order to register to vote in federal elections violates the NVRA.

Without the proof of citizenship requirement, individuals must only attest under penalty of perjury that he or she is a citizen.

The Citizen Ballot Protection Act (CBPA) would amend the National Voter Registration Act to make clear that a state may impose a proof of citizenship requirement in order to register to vote in a federal election.

The bill respects and upholds the role of states in administering federal elections, gives states the option to add more security to their voter registration process, and helps states that have proof of citizenship requirements to streamline their registration process so both their version of the federal mail voter registration form and the state’s regular voter registration form can have the same review process.

Background:

There is a growing push to let noncitizens vote, especially in some liberal states where noncitizens are allowed to register. New York City recently approved legislation that will allow as many as 800,000 non-citizens to vote in local elections.

To strengthen voter roll integrity, many states are adding proof of citizenship requirements before someone can register to vote. However, this protection does not extend to voters that register through the National Voter Registration Act (NVRA) federal mail voter registration application form. This federal form is used to register to vote in federal elections and the information collected by the form is listed in the NVRA.

Because proof of citizenship is not listed as an option to add to the form, in Arizona v. Inter Tribal Council of Arizona, the Supreme Court held a state requirement to show proof of citizenship in order to register to vote in federal elections violates the NVRA.

Without the proof of citizenship requirement, individuals must only attest under penalty of perjury that he or she is a citizen.

""I was honored to attend the first stop on Alabama’s Challenge statewide tour that took place in my district in Dothan. It was great to see so many people come together with the common goal of supporting veterans and their families, while providing veterans with a job fair and other valuable resources.

""Too often, we view improving mental health as the only tool in our toolbox for preventing veteran suicide. This is simply not the case. I am glad that we are here today to look at economic risk factors, as it is important to ensure that we work to eliminate stressors on veterans related to housing, employment, hunger, and self-worth.

""While veteran unemployment has decreased to the pre-pandemic levels that were achieved during the Trump Administration, it does not tell the whole story. We all know that the Biden economic agenda has forced millions of Americans to tighten their belts as inflation continues to rise unabated. From the gas pump to the grocery store, veterans and their families are feeling the pain. To combat this burden, V.A., Labor, and other agencies will need to reexamine every economic program they administer to ensure that they are meeting the needs of veterans. ""I was disappointed with the testimony from the Federal agencies on the first panel. Their written statements read more like a regurgitation of the programs they offer and promised collaboration through interagency working groups. We need more than promises and work groups if we are truly going to get a handle on this epidemic and save veteran lives. It was disappointing that these written statements said very little about whether these programs and work groups actually prevent suicide. More emphasis must be placed on collecting meaningful data on these programs and holding them accountable for improving outcomes so we can ensure we are not just sending good money after bad.

""While it is certainly worthwhile to conduct oversight on the programs that can improve economic worth and prevent suicide, I do want to make sure we strike the right balance and avoid perpetuating the “broken veteran” narrative. We know that veterans have lower rates of unemployment and are more successful in higher education than non-veterans. They are the best of this nation and not the ticking time bombs that some portray them to be. Nonetheless, it is critical that we do what we can to reduce the stigma of veterans standing up and asking for help, regardless of if it is for their mental health or finances.
