Full text of the letter is below: Dear President-Elect Trump,           Congratulations on your election victory.  As you and the Transition Team begin developing policy priorities for the next Administration, members of the bipartisan Cuba Working Group (CWG) strongly urge you to support the restoration of U.S. engagement with Cuba.   The CWG was founded on the belief that increasing trade, travel and investment in Cuba will not only open new markets and create jobs in both countries, but also promote human rights and better hemispheric relations as well as improve the security posture of the United States.            Americans support the easing of commercial restrictions in Cuba because it will result in increased jobs, economic growth and productivity gains for the United States economy.  In fact, the U.S. International Trade Commission (USITC) released a report earlier this year that found if U.S. restrictions on Cuba were lifted, U.S. exports of selected agricultural and manufactured goods could increase to a total of roughly $2.2 billion, up from a mere $180 million in 2015.  Policies that improve commercial relations could potentially create thousands of jobs here in the United States and open valuable new markets for our exports. The restrictions the U.S. government imposes on American business activity in Cuba have not only stymied America’s economic potential, they have provided the repressive Cuban regime with an excuse on which to place blame for their own economic woes.  Additionally, there is little credible evidence that sanctions have improved the human rights situation in Cuba, a top priority of the CWG.             The recent death of Fidel Castro represents a dawn of a new era in Cuban leadership and America must use this opportunity to help chart a new course for Cuba’s future.  We believe America’s greatest ambassadors - the American people and the U.S. private sector – will always be the most effective conduit for the spread of American influence. We urge CMS to utilize every tool under current statutory authorizations to improve access to treatment options for those struggling with substance use disorders. From abuse of prescription drugs to cocaine, methamphetamines, and new synthetic drugs, our country has experienced a substance abuse epidemic that has exposed several barriers to patient care. In 2013, 6.7 million Americans took medication not prescribed to them. More than 100 Americans die from drug overdoses every day, and nearly half of those deaths are due to opioids. These trends hit our children the hardest. One in four college age kids have reported using pain pills that are not prescribed to them. Opioid dependence is a crippling addiction that needs to be treated as the medical condition we know it to be. Currently, numerous chemical dependency treatment facilities exceed the Institutions for Mental Diseases (IMDs) exclusion for Medicaid coverage, which sets a cap of 16-beds. It is not clear whether an exception process exists or if there are any criteria outlined for an exemption to this rule. Many of our states should be recognized for the diverse nature in which services are insured and provided through non-profits, managed care, congregate care and residential community treatment among other options, many of which have more than 16 beds. Additionally, we have serious concerns about the recent managed care rule that only allows for 15 days of care furnished in an IMD setting over a 30-day period. To cap a patient’s stay at a treatment facility at 15 days is simply unrealistic. These patients need time to recover, not only from physical dependency, but also from mental and emotional trauma. A 15-day limit is just not practical and does not take into account the numerous studies suggesting the cost-savings, readmissions reductions, overdose preventions, and recovery efficacy from longer lengths of stay in residential settings as a patient progresses down the clinical continuum of care. CMS should be commended for the steps it has taken to increase eligibility and provide care for those most in need. Coordinating behavioral treatment with methods to mitigate physical injuries has reduced costs and improved the lives of patients. Several recent rules have established your willingness to work towards goals that reduce this epidemic. However, we urge you to continue your efforts to ensure you take every step to remove barriers to substance abuse treatment including removing SUD from the definition of mental disease for the purposes of determining if a treatment facility is an IMD. If, for example, the taxpayer purchases a HSA-eligible health plan and then immediately incurs medical expenses before opening the HSA, the taxpayer may not use tax-favored HSA funds to pay the expenses. The provision would treat HSAs opened within 60 days after gaining coverage under a HSA-eligible health plan as having been opened on the same day as the health plan. This would allow for a reasonable grace period between the time of coverage through a HSA-eligible health plan and the establishment of an HSA. Section 3: Maximum contribution at deductible and out-of-pocket level. Under current law, annual HSA contributions are limited. These limits are updated annually for inflation and are less than the combined annual limit on out-of-pocket and deductible expenses. FSOC, U.S. District Judge Rosemary Collyer found that the FSOCs methodology to designate nonbank financial firms for heightened federal regulation also known as systemically important financial institutions, or SIFIs is fatally flawed, stating that the actual designation for MetLife was unreasonable. This decision has sent reverberations across the financial sector and calls into question the incredible expansion of this countrys regulatory state. Even the authors of Dodd-Frank have expressed their surprise that the FSOC has such sweeping power. Last July, former Rep. Barney Frank (D-Mass.) said he didnt believe that companies that just sell insurance should be designated as SIFIs. Before that, Chris Dodd (D), then a Connecticut senator, in 2010 suggested that he didnt envision traditional insurance to be designated as well. Nonetheless, the FSOC has already designated three insurance companies. However, the Metlife decision not only calls into question the legality of these designations but the entire basis of them as well. Many are concerned that the FSOCs designations have codified the too-big-to-fail taxpayer bailout mentality into law. This new alignment sends a clear message: that SIFIs may actually be more likely to receive a taxpayer bailout in the event of another crash. Further complicating matters is that the SIFI designation distorts market forces, thus locking institutions into this status eternally, even if they change their business model. Also concerning is that the FSOCs 10 voting members are all appointed by the president. Other federal financial regulators, like the Securities and Exchange Commission, are led by a five-person bipartisan commission. This foundational reorganization of our economy completely removes the constitutional oversight authority of Congress and is done without any accountability to the American people. Even more worrisome, all of this is done by unelected bureaucrats. In response, on April 14, the House of Representatives passed my legislation: the Financial Stability Oversight Council Reform Act. OFR has received its fair share of criticism too. In 2013, its Asset Manager Report was not only condemned by the industry, but the Securities and Exchange Commission (SEC) also expressed concern. According to a Reuters report, the SEC was concerned that the people who conducted the study lacked a fundamental understanding of the fund industry itself and the Treasurys research arm failed to take a number of the SECs critical feedback into account. Thus, the SEC created its own comment period for the report. Better Markets, a group that regularly advocates for increased government regulations, criticized OFR for the inexplicably and indefensibly poor quality of the work presented in the report. Despite all of this and the fact that Rep. Frank also condemned the idea of designating asset managers, many fear that FSOC is moving forward with plans to designate them too. It is important to note that imprudent nonbank SIFI designations have real consequences that hurt real Minnesotans. With the added regulations that come with a designation, so do the costs of complying with them. These costs are passed directly onto consumers, making insurance policies and loans more expensive for American families and businesses. As I have heard throughout Minnesotas Sixth Congressional District over the past 15 months, everyday Minnesotans have real stories about the negative effects these harmful regulations are having on their lives. This is why I introduced the FSOC Reform Act last July. Reasserting 'power of the purse' By subjecting FSOC and OFR to the congressional appropriations process under this legislation, Congress will reassert its power of the purse restoring critical checks and balances that are fundamental to our democracy. In terms of post-recession economic growth, Obama’s recovery ranks dead last. Taken cumulatively, the lost output of this recovery compared to past recoveries is a whopping $5.4 trillion. What’s holding us back? While there are many contributing factors, one of the most important is our broken corporate tax system. At 35 percent (39.1 percent when you include state business taxes), the United States has the highest corporate tax rate in the industrialized world. Our tax system treats investment worse than most advanced countries. U.S. businesses must wait to deduct their capital costs for as long as 39 years. To make matters worse, we are also the only major country that taxes its businesses on income earned anywhere, rather than just income earned on American soil. Collectively, these policies make America a very bad place to do business.  Since 2012 alone, at least 22 major American companies have left the United States and moved overseas to take advantage of lower tax rates, taking with them jobs and investment. In addition, as much as 75 percent of the cost of the corporate tax rate is passed on to labor. While brewers are generally required by state law to utilize licensed beer distributors to store and deliver their products to retailers, ABI also exercises vertical control through ownership of multi-brand beer distributors in some states. The distributors owned by ABI also sell beer brands that directly compete with ABI. In fact, recent takeovers make ABI one of the fastest growing beer distributors in the United States, having acquired 12 independent distributors in nine states since 2012. ABIs effective control as the major supplier to independent distributors, combined with its direct ownership of distributors and recent acquisitions of craft brewers, allows for greater opportunity to suppress the sale of the various brands of other brewers. Should ABI acquire additional independent distributorships in targeted markets or place further pressure on independent distributors to abandon the distribution of non-ABI brands, including a significant number of craft brands, those brewers will have only one viable distribution option in those markets. This is an outcome that will further limit access to many U.S. markets that are currently only served by two major beer distributors. As such, the Department must prevent negative effects of the proposed transaction on Americas craft brewers and consumers, who may be left with fewer choices and experience higher prices. Small brewers also are concerned that the ABI acquisition of SABMiller creates the potential to constrain access to commodities that brewers rely on to make their products. These materials include hops, barley, cans, and bottles. The proposed acquisition would lead to a uniquely powerful global player in these markets with the capability of subtly affecting prices and supplies of essential commodities for other brewers. In the end, price increases and supply disruptions could have an adverse effect on both competition and beer consumers.
