The Public Health Emergency, first declared by the secretary of health and human services on Jan. 31, 2020, granted various authorities to the executive branch in response to COVID-19. Unfortunately, what began as a necessary and steadfast policy measure under President Donald Trump has devolved into an unprecedented, dictatorial abuse of power under the Biden administration. The Trump administration effectively used the Public Health Emergency executive powers to lead the world in the fight against COVID-19, forge an unprecedented public-private partnership to fund the development of therapeutics, and safeguard healthcare workers. There was a time and a place for such executive power, as with any catastrophic event. Contrast this with today. More than two and a half years later, COVID-19 has been in an endemic phase for many months, with high vaccination rates, decreasing hospitalizations, and plummeting death rates. Yet President Joe Biden has nonetheless continued the Public Health Emergency long past its first designated course. Biden's reason for this is not about science — it's about opportunities to abuse power. The Biden administration has routinely weaponized the PHE to overstep his constitutional authority — from his illegal extension of the Centers for Disease Control and Prevention's eviction moratorium to his unscientific forced masking requirements and vaccine mandates. The U.S. Supreme Court has already correctly ruled against Biden on both the CDC eviction moratorium and the Occupational Safety and Health Administration large employer vaccine mandate, finding that neither executive policy was within the legal bounds of Biden's pandemic emergency authority. Biden's federal employee COVID-19 vaccine mandate, which he initially admitted may not be constitutional, also remains in judicial limbo, as an appeals court has agreed to rehear the case. The PHE has also prevented states from auditing their Medicaid rolls, to the point that 1 in 4 Americans now relies on Medicaid. Biden touts the strongest economy in history, but then, he creates unprecedented governmental dependency. Medicaid is meant for deserving individuals. It is not to be used as another tool for handout addiction. Years later, Biden continues to hijack the intent of these emergency designations to steamroll his radical domestic policy agenda. He recently invoked the national emergency declaration and used a law passed in the wake of Sept. 11 as the legal basis for his unconstitutional student loan giveaway. The Public Health Emergency is set to expire on Oct. 15, but Biden will likely extend the authority of the federal government, as he is historically unwilling to concede his pandemic-era power. This despite the fact that, in a shameless moment of brutal honesty, Biden recently told 60 Minutes, ""The pandemic is over. We still have a problem with COVID. We're still doing a lot of work on it. It's — but the pandemic is over."" With Biden's emergency powers predicated on extending the pandemic, it's no surprise that the White House is downplaying these remarks, telling CNN that Biden's comments do not mark a change in policy. Biden's Freudian slip comes on the heels of Dr. Anthony Fauci telling PBS NewsHour in April 2022 that the U.S. is ""out of the pandemic phase."" More than a year into the Biden administration, the Public Health Emergency remains in effect for all the wrong reasons. What once was a genuine, necessary, and effective policy measure to combat the COVID-19 pandemic has been weaponized into a disingenuous, counterfeit policy trick to let Biden overstep his legal authority and legislate from the executive branch. The Democrats' reconciliation package would penalize our health care system and set American drug manufacturers back decades as they work to combat the world's most significant health care challenges—from Alzheimer's and cancer to COVID-19 and other diseases. Second, the proposal would do significant harm to patients and independent physicians, particularly in the oncology and rheumatology spaces. According to an Avalere analysis, the partisan reconciliation package would ""lead to a total reduction of 39.8% in add-on payments across all providers administering top Medicare Part B drugs."" For rheumatologists and medical oncologists, these specialists will see 48.5% and 42.9% reductions, respectively, in reimbursement. It is perverse to maintain that physician reimbursements are the main cause of why medicine in the U.S. is so costly. Physicians in recent years have often been in angst because of perpetually looming threats to cut their Medicare payments, as well as the general impact of inflation. So now, on top of the already inadequate payments and historic inflation, independent physician practices will be forced to close their doors, leading to increasingly more costly consolidation in the health care market and forcing patients to a more expensive site of service. If the Democrats' reconciliation package is signed into law, not only will Americans lose access to new curative medicines, but they also won't have the doctors to administer them. Even if patients are lucky enough to find a physician, patients will have to pay more for treatments and cures. Patients and physicians alike should balk at the idea of Washington bureaucrats having the power to regulate which drugs your child, mother, or grandmother should have access to in a time of need. Third, the new ""enhanced"" Obamacare subsidies authorized in this bill will cost taxpayers $248 billion over 10 years. These subsidies will inexplicably extend premium tax credits to wealthy Americans, which will line insurance companies' pockets to artificially lower premiums. Taxpayers are the ones who will pay for these increased Obamacare subsidies. This politically motivated shell game by Democrats will hurt taxpayers (also known as patients) while subsidizing health care for wealthy Americans. In fact, under this proposal, a couple in Pennington County, South Dakota making $500,000 per year would receive nearly $2,000 in annual subsidies. Think about that for a second. In President Joe Biden's America, someone making half a million dollars a year will have his health care subsidized. That is absolutely absurd. Instead of hurting patients, we should be pursuing common-sense, market-based solutions to lower the cost of prescription drugs, cap seniors' out-of-pocket spending, and increase competition and new drug innovation. Born in the town of Beebe, Arkansas in 1933, General Overholt attended the University of Arkansas where he earned both a bachelor's degree and a law degree. While attending law school, he served as the Comments Editor for the University of Arkansas Law Review. Following his graduation in 1957, General Overholt entered the Army's Judge Advocate General's Corps and was commissioned as a First Lieutenant in the U.S. Army. After his graduation from the Army's Judge Advocate General's school, General Overholt would go on to serve in various leadership roles within the United States Army including Assistant Judge Advocate General of the U.S. Army from 1981-1985 and Judge Advocate General of the U.S. Army from 1985-1989. General Overholt served a remarkable ten years as a General Officer, which included eight as a Major General. General Overholt has served on the North Carolina Board of Transportation (BOT) since 2009 and was instrumental in creating a new 2020 Department of Transportation (DOT) law that gave the BOT more oversight authority. This new legislation also shifted designation of board members from the Governor to the General Assembly. For the first time under this new authority, Speaker of the North Carolina House Tim Moore used one of the General Assembly's three appointments for General Overholt who was first placed on the BOT by Governor Beverly Perdue and was reappointed by Governors Patrick McCrory and Roy Cooper. General Overholt is the only BOT member who has been appointed by both Republican and Democratic Governors, plus a Republican Speaker of the House. General Overholt in action means seeing good government work. Between 2009 and 2020, General Overholt was instrumental in delivering over $800 million in new road projects to Carteret, Craven, Jones, Lenoir, and Pitt Counties. Of particular importance has been his support for military related transportation projects.
