Congresswoman Carolyn Maloney praised the governor for putting $1.5 billion into the budget for the second phase of the subway, which will extend downtown. Lowey (D-Rockland/Westchester), the Ranking Member of the House Appropriations Committee, today announced $110,000 in National Endowment For the Arts (NEA) grants for arts organizations in Westchester. Additional activities include talkbacks, community events, and an educational program for middle and high school students.  $30,000 for Hudson Valley Center for Contemporary Art (Peekskill) to support the residency component to complement the exhibition ""Threads."" The exhibition will feature artists who work with yarn, paper, twine, thread, and other domestic materials to create artwork inspired by their personal journeys. The artist residency component will include both international and local artists who will create work, give workshops, and mentor students. $25,000 for ArtsWestchester (White Plains) to support “Modern Families,” a visual exploration of the modern American family. “Modern Families” will explore the diverse faces and facets of the American family during the last century as portrayed by contemporary photographers. $10,000 for Copland House (Peekskill) to support performances of American music performed by the Music from Copland House ensemble and related educational activities, including commentary during performances and question-and-answer discussions.  In addition to the music of Aaron Copland, programs will feature music by composers such as Derek Bermel, Richard Danielpour, Gabriela Lena Frank, Paul Moravec, Tamar Muskal, Rob Schwimmer, and William Grant Still. $10,000 for the Clay Art Center, Inc. (Port Chester) to support the creation and installation of public art projects in White Plains. Healing Through Clay, an arts therapy program, will provide free clay classes for adults living with cancer and youth impacted by homelessness. Professional teaching artists will work with program participants under the supervision of Ariel Edwards, lead artist and Clay Art Center's Community Arts Director, to create mosaic works for public installation. We believe the State Department was wrong to certify Honduras’ compliance with these requirements.  There is significant evidence that impunity, corruption, and human rights violations continue unabated in Honduras.  For example, President Juan Orlando Hernández and his ruling National Party have admitted that they stole funds from the National Health Service and diverted those funds into their 2013 election campaign coffers; yet the Attorney General has not prosecuted them.  Héctor Iván Mejía, Director of Planning and Operations for the National Police (the third highest-ranking position), is documented to have committed gross violations of human rights and is still in office.  Most recently, a captain in the Honduran Armed Forces and former DEA informant has charged that Samuel Reyes, the Minister of Defense, is a drug trafficker.  While an ostensible cleanup of the police is being enacted to much fanfare, the government’s purging commission itself includes a leader of the 2009 coup.  The commission reports that a few hundred allegedly corrupt members of the police have been separated, yet as of this writing not a single case has evidently been forwarded to the Public Ministry for prosecution.  Judicial independence also continues to be undermined, contributing to further impunity.  In February 2016, a new Supreme Court was elected by the Honduran Congress in a process widely denounced as non-transparent and illegal. Last October, the government announced it would not restore four judges who were illegally deposed for publicly opposing the coup, although their reinstatement has been ordered by the Inter-American Court of Human Rights. That same month, the Honduran Congress named judges to a new anti-corruption court in a process widely criticized by civil society as non-transparent and failing to incorporate the mandated input of civil society. The military’s role in domestic policing also continues to expand, in violation of the Honduran Constitution.  In August 2016, the government announced the creation of two new additional battalions of the Military Police of Public Order (PMOP), which answers to a military command but performs domestic police functions.  Human rights groups have documented multiple committed gross violations of human rights by the PMOP, with impunity.  In another alarming example of the military’s expansion in domestic policing, the important task force FUSINA combines multiple civilian and military agencies, including regular police, in a single body under military supervision.  In addition to the previously mentioned requirements, we note that the 2016 Appropriations Act also mandated that the central government of Honduras create an “autonomous, publicly accountable entity to provide oversight” of the Plan of the Alliance for Prosperity of the Northern Triangle; implement policies guaranteeing the consultation of affected local communities and civil society groups, including Indigenous groups, in any activities of the plan; improve transparency; cooperate with commissions against impunity and regional human rights groups; and protect the right of the political opposition, journalists, trade unionists, human rights defenders and other civil society activists to operate without interference. Nevertheless, no functioning oversight body for the plan has been enacted. In fact, a new “Law of Secrets” sealing off government records has dramatically decreased transparency.  Moreover, the assassination of Indigenous leader Berta Cáceres in March 2016 has highlighted the ongoing and illegal failure of the government to consult with Indigenous and Afro-Indigenous people on the construction of hydroelectric dams and other development projects.  Moreover, the freedom of activists such as Cáceres to exercise basic civil liberties continues to be threatened, often fatally. President Hernández himself has repeatedly and publicly charged human rights defenders with undermining the country. The government has still failed to implement an already-weak law designed to protect human rights defenders.  The government has also failed to comply with an order of the Inter-American Commission on Human Rights mandating protection of over 300 Hondurans. This illustrates the Honduran government’s ongoing failure to cooperate with regional human rights groups, as Congress’s conditions require. A new Support Mission Against Corruption and Impunity in Honduras (MACCIH), formed by the Organization of American States in 2015, has reported that the Honduran government has failed to pass new legislation it has recommended, and that the government does not cooperate with it. Finally, we are concerned by a recent statement in which the Department of State declared that the United States does not oppose presidential reelection in Honduras, although the Honduran Constitution specifically bars reelection and even makes it a criminal act for a sitting president to advocate it.  By issuing this statement just days after President Hernández announced his candidacy for reelection, the State Department signals a disturbing lack of respect for the rule of law in Honduras, along with its support for an administration that has a long track record of undermining it. Maloney and Rangel below:   December 15, 2016   Carolyn Flowers Acting Administrator Federal Transit Administration 1200 New Jersey Avenue SE Washington, DC 20590-0001   Re: New York Metropolitan Transportation Authority’s Request to Enter Project Development – Second Avenue Subway Phase 2 Dear Acting Administrator Flowers,                 We understand that on November 21, 2016, the New York Metropolitan Transportation Authority (MTA) requested entry into New Starts Project Development (PD) under the Federal Transit Administration’s Capital Investment Grant Program for the Second Avenue Subway (SAS) Phase 2 Project.  SAS Phase 2 will be a new heavy rail line operating between East 96th Street/Second Avenue and East 125th Street/Lexington Avenue in Manhattan, and will run through the districts we represent.  Phase 1, from 63rd Street/Third Ave to 96th/Second Avenue is nearly complete and is due to open imminently.  We hope that you will approve the request expeditiously so that there can be a seamless transition from Phase 1 to Phase 2.                  As you know, the SAS has been on the drawing board since the 1920s.  There were three previous groundbreakings for the project and two elevated trains were torn down in expectation of the SAS.  Now, for the first time in history, the MTA is poised to open a portion of the SAS for revenue service.  We hope you will approve the MTA to enter PD for SAS Phase 2 in order to continue the momentum and ensure that the next phases move forward.  The MTA has built enormous institutional knowledge during the course of constructing SAS Phase 1, and it is important that those teams stay intact with a quick transition to SAS Phase 2.                 SAS Phase 2 will bring additional transportation capacity to East Harlem, a working class neighborhood with insufficient transportation alternatives.  The area has been undergoing significant growth, with new large residential buildings, new schools and a burgeoning commercial area near 125th Street.  The MTA projects that SAS Phase 2 will attract 101,000 daily riders and will decrease crowding on the Lexington Avenue IRT 4, 5 and 6 line (Lex Line) by 10%, building on the benefits of SAS Phase 1.  The Lex line is currently the nation’s most overcrowded subway and the relief is desperately needed.                 SAS Phase 2 will make use of existing tunnel segments between 99th and 105th Streets and between 110th and 120th Streets built during an earlier attempt to build the SAS, finally making good use of government funds expended decades ago.  Additionally, Phase 2 is critical for creating new connections for passengers between Westchester, Putnam or Dutchess counties or the local airport and creating inter-modal connection with Metro-North Railroad.  We understand that the MTA will do significant community outreach during this process, and will work to elicit community input, especially as it relates to the new station locations.                 The MTA’s 2015-2019 Capital Plan includes $1.5 billion for the SAS Phase 2.  We are concerned that any delay in entering into PD would make it impossible for the MTA to use the allocated funding during the current capital plan.  The MTA Board has approved award of the design and environmental consultant contracts for SAS Phase 2, and we understand that they expect to give the go ahead to proceed to both teams in December 2016.  The FTA’s quick approval of this project for PD will allow the MTA to move forward with this essential project.                 Phase 2 is a critical project for our communities and we hope that you will approve this project’s entry into PD so that it can move forward as quickly as possible.  Thank you for your kind attention to our concerns.  We look forward to working with you on SAS Phase 2.   Very truly yours,   CHARLES B. In the mid-1990s, Rep. Maloney began a campaign to resuscitate the Second Avenue Subway after the project had lain dormant for decades, and she has worked to include $1.3 billion in federal funding for the Second Avenue Subway in appropriations bills. Project Timeline 1919 – SAS was first mentioned in New York State Public Service Commission chief engineer Daniel Turner’s 1919  (Politico) The Great Depression foiled the first Second Avenue subway plans. After World War II, the idea for a Second Avenue Subway was revived and the 2nd and 3rd Avenue Els were torn down. But the 1975 financial crisis put an end to further building. 1991 – U.S. Secretary of Transportation was authorized under the Intermodal Surface Transportation Efficiency Act to review SAS along with other projects – no action taken 1995 - Transportation Equity Act for the 21st Century (TEA-21) authorizes $5 million for SAS study on how to reduce Manhattan traffic July 2000 - First federal funding – $3 million in FY2000 April 2004 - Second Ave. Subway Final Environmental Impact Statement (FEIS) was published. February 2005 - the Federal Transportation Administration (FTA) designated East Side Access and the Second Avenue Subway as “highly recommended” projects, the only projects included in TEA-LU to receive that designation. Last month, after 18 months of hard work, the American Museum of Women's History Congressional Commission presented its final report to Congress and the President. The Commission, made up of four Republican and four Democratic women, strongly recommends creating a new Smithsonian museum on the National Mall dedicated to telling the many stories of women’s contributions to our nation. We may still have to contend the inconvenience of ‘Trump traffic’ and the costs to local businesses of fewer shoppers willing to venture onto protected streets, but our out-of-pocket costs should be covered.  I will continue to press my colleagues to reimburse the city the rest that we are owed in the next spending bill. It is simply not fair to stick New Yorkers with the bill for this national security priority. In the meantime, back in New York, we’ve had some great progress on important local priorities. In Brooklyn, we will soon have our park! Just before Thanksgiving, the city finally reached a deal to acquire the last remaining 11 acres of land needed to complete Bushwick Inlet Park. The city had made a commitment to Northern Brooklyn more than a decade ago in exchange for zoning changes, and we could not allow them to renege on this important promise. I’m so proud to have worked so closely with my colleagues in government and the community, including joining a ""sleep-in” with residents, to make sure the city acquired all of the land promised to us. Queensbridge Houses, North America’s largest housing development, now has new weather-resistant roofs that will enhance the quality of life for the development’s more than 6,500 residents. I was proud to help bring $27 million in federal funding to this project that will ensure that there will be fewer leaks throughout Queensbridge, which will help to prevent mold and physical damage to the residences. And in Manhattan, the first phase of the Second Avenue Subway is nearly complete and the MTA has filed the paperwork with the Federal Transit Administration to begin the process of seeking federal funding for Phase 2! I recently spoke to MTA Chairman Tom Pendergast about this incredibly important project and made clear that I will do everything I can to make sure the federal government continues to do its part to support the next phases of the Second Avenue Subway. I thank the Army Corps and all of our government partners for their continued collaboration and quick efforts to reach this milestone ahead of schedule.” Staten Island Borough President James Oddo said, “The Army Corps Seawall Project is one of the most important projects for the future of our borough, as demonstrated in tragic detail by the devastation caused by Sandy. That is why Senator Schumer, Congressman Donovan, and I sent our letter to Assistant Secretary Darcy back in October urging the expedited approval of the Director’s Report. The federal government must do all in its power to remove each and every bureaucratic obstacle standing in the way of a completed line of protection on the East Shore, which is still dealing with the effects of Sandy. The fact that the Assistant Secretary of the Army agreed with us and issued this approval months ahead of schedule is excellent news. It’s not too often that government acts ahead of schedule on anything, much less on approving a project of this scope and size. I was happy to work in a bipartisan way with my federal colleagues.” Earlier this year, Schumer successfully pushed the Army Corps to expedite the review process of the Staten Island Sea Wall Project by issuing a “Director’s Report.” Specifically, the “Director’s Report” does not require a Civil Works Review Board and therefore expedites the review process because it cuts out this unnecessary step. The project’s final public notice period began in September and finished on October 17th. Once the public notice period ended, the “Director’s Report” was sent directly to the Assistant Secretary of the Army (Civil Works) for review and approval. Following the completion of the final public notice period, Schumer and Donovan urged the Department of the Army to swiftly approve these plans. The project is divided into three phases: feasibility, design, and construction. During the feasibility phase, which just concluded, the Army Corps determined whether construction was possible, estimated costs and benefits, and completed preliminary engineering work. During the design phase, engineers and architects will create detailed blueprints and construction plans. During the construction phase, the Army Corps and contractors will build the seawall based on the design. Assistant Secretary Darcy’s formal approval releases funds for the Corps to begin intensive design work. In a letter sent to Schumer and Donovan, the Assistant Secretary of the Army (Civil Works) wrote: “Today, I determined that the project is technically feasible, economically justified, and environmentally acceptable. The Corps will undertake pre-construction engineering and design, and construction of the project subject to the availability of funding provided for in PL 113-2.” Engineers will spend the coming months preparing specifications for the 4-mile long line of protection to defend against a 300-year flood. Construction is scheduled to begin in late 2018 or early 2019. New York City Council Minority Leader Steven Matteo said, “It has been more than 50 years since a seawall to protect our vulnerable East Shore communities was first planned, but the approval of the Director's Report is a big leap forward to making this vital project a reality. While we still have many obstacles to overcome – including the acquisition of properties, the remediation of Great Kills Park and the final design process – I am more optimistic than ever that we will put a shovel in the ground in the next few years. We must continue to be vigilant and work together to ensure that happens.” New York City Council Member Joe Borelli said, “Fortunately, Congressman Donovan and Borough President Oddo were able to bring this shore protection project to Staten Island. I thank them for their extraordinary efficiency, which brought final approval to this project months ahead of schedule. It is my hope that this will lead to more progress, as every year that passes without robust shore protections poses a risk to all we have rebuilt."" The project enjoys broad public support, and we speak every day with residents eagerly anticipating a future of reduced flood risk. The Corps has worked diligently and with urgency to reach this step in the approval process, and we wish to see the project receive final approval from your office as quickly as practicable. To that end, the Director’s Report will reach your desk in the coming days, and we respectfully ask that you review and approve it in a timely manner.
