Under the current law, members of the National Guard and active reservists are exempt from meeting certain means test income requirements to qualify for Chapter 7 bankruptcy protection.Without Congressional action, that exemption was set to expire on December 19, 2015.The legislation that passed the House, H.R. 4246, would extend the expiring exemption through 2019. Following the passage of H.R. 4246, Congressman Costello released the following statement: By extending the National Guard and Reservist Debt Relief Act, we are ensuring that National Guard and Reservist members who may experience financial hardship will continue to receive bankruptcy relief without having to sort through the substantial paperwork required. Costello continued, Since 9/11, the National Guard and Reserves have risen to the occasion.They have been tested and have proven they are a critical, operational force and provide the support and end-strength to their active duty component.This legislation recognizes the sacrifices they have made to protect our nation by helping those who fall on hard times. I urge the Senate to pass this commonsense action and send it to the Presidents desk. Testimony in the 110th Congress noted that 40 percent of all Guard members are in financial hardship and 26 percent of National Guard members struggle with financial problems related to their deployment into war zones. The Pennsylvania National Guard is the third largest National Guard in the nation, and headquartered at Fort Indiantown Gap just outside of PA-06. Since 9/11, 44,967 Pennsylvania National Guard members have been mobilized for overseas operations. Currently, the 828th Finance Army National Guard located in PA-06 is deployed. National Guard sites in Pennsylvania include: 86 Readiness Centers 14 Field Maintenance Sites 6 Air National Guard Bases 2 Combined Support Maintenance Shops 2 Army Aviation Support Facilities. The National Guard just celebrated its 379th birthday on December 13, 2015. Background The National Guard and Reservists Debt Relief Act of 2008, Public Law No. 110-438, created an exception to the means tests presumption of abuse for members of the National Guard and Reserve who, after September 11, 2001, served on active duty or in a homeland defense activity for at least 90 days.The exception is also available for 540 days after the servicemember leaves the military. This exception, however, is set to expire later this year.
