Today, Rep. John B. Larson (CT-01) released the following statement on the 5th Circuit Court of Appeal's decision that upholds a previous district court decision that struck down part of the Affordable Care Act. The 5th Circuit sent the case back down to a lower court to decide the constitutionality of the law. The Affordable Care Act (ACA) remains law while the lower court reaches a decision. Yesterday's ruling by the 5th Circuit Court of Appeals is deeply troubling. Despite the American people speaking up in 2017 that they wanted to keep the ACA, Republicans are still trying to dismantle it. They are jeopardizing access to health care and coverage for 130 million Americans with pre-existing conditions. This is yet another example of the Trump Administration and Congressional Republicans attempting to repeal the ACA through the courts, since they were unable to do so in Congress. Democrats in Congress will continue to fight these attempts to undermine health care coverage in the courts and in the Congress.
