(October 3, 2017) Congressman Steve Pearce today released the following statement after the House of Representatives voted and passed H.R. 36, the Pain-Capable Unborn Child Protection Act. This bill seeks to protect unborn children who are 20 weeks or older: “Today’s bill is something we as Americans can unite together around. We have scientific proof that an unborn child at 20 weeks into a pregnancy – the end of the 5th month – has the capability to feel pain. I cannot sit back and allow this brutal act to continue. This is about protecting the lives of children who have a heartbeat and can feel. This is about the right to life. As an elected official, it is my duty to protect the rights and liberties of all New Mexicans, and today, I feel I did just that. I’m proud to have co-sponsored this crucial piece of legislation, and will continue to stand up for the sanctity of life, New Mexican values, and the rights of those who cannot protect themselves,” stated Rep. Pearce. “Today’s legislation also comes at a time when New Mexico itself has been struggling to uphold the law since an investigation by the U.S. House of Representatives Select Panel on Infant Lives issued two criminal referrals to New Mexico’s Attorney General after uncovering multiple instances of criminal misconduct and violations occurred between University of New Mexico and Southwestern Women’s Options. New Mexico’s Attorney General has yet to act on either of the two criminal referrals,” stated Rep. Pearce. “Human life must be valued. This bill today takes a huge and necessary step toward avoiding future pain and suffering by mothers and children.” Background Medical evidence has proven that by week 20, the end of the 5th month, unborn children feel pain. H.R. 36 protects pain-capable unborn children while containing a life-of-the-mother exception that allows late-term abortions in the event that it would save the mother’s life. This bill also has exceptions for cases of rape and incest. In September 2017, Rep.
