Phil Roe, M.D. (R-Tenn.), released the following statement after yesterday's Fifth Circuit Court of Appeals ruled the individual mandate in the Affordable Care Act (ACA) as unconstitutional: The individual mandate, which was enacted as the key mechanism in the Affordable Care Act to compel people to either purchase insurance or be taxed, has long seemed unconstitutional to me. When the Supreme Court originally upheld Obamacare in 2012, it was the first time the U.S. government forced citizens to purchase a product. The Fifth Circuit Court of Appeals ruling last night affirmed my original understanding of why the mandate should be unconstitutional. This ruling confirms that Americans should not be forced to buy a product they can't afford or don't want. This ruling should be a wake-up call to Democrats that we need to come together to pass bipartisan, patient-centered health care reforms that will lower cost and encourage competition.
