WASHINGTON, D.C. – U.S. Rep. Ed Whitfield (KY-01), Chairman of the House Subcommittee on Energy and Power, today held a hearing entitled “Evaluating the Role of FERC in a Changing Energy Landscape.” The hearing focused on the legal and regulatory authorities of the Federal Energy Regulatory Commission (FERC) and the manner in which it has been carrying out its statutory duties under the Federal Power Act, Natural Gas Act, and other authorities. “I have serious concerns regarding how the president’s policies directly aimed at trying to bankrupt the coal industry will impact grid reliability, fuel diversity, and electricity prices for families and businesses,” stated Whitfield in his opening statement. “Given FERC’s role in overseeing the reliability of the grid, I am very interested in understanding what impacts FERC believes will result from the elimination of a significant portion of affordable and reliable baseload generation.” FERC’s stated mission is to “assist consumers in obtaining reliable, efficient and sustainable energy services at a reasonable cost through appropriate regulatory and market means.” One of the issues Whitfield’s hearing examined was FERC’s coordination with the Environmental Protection Agency (EPA) regarding the potential impacts that EPA’s new and proposed regulations have on FERC’s ability to meet and comply with its mission statement. The Environmental Protection Agency recently announced new emissions standards for coal-fired power plants that would make it illegal to build a new plant because the technology to comply with the standards is not yet commercially available. To push back against the EPA’s unilateral implementation of these regulations, Whitfield unveiled bipartisan, bicameral legislation that would require Congressional approval of new regulations. “The sectors and industries regulated by FERC comprise a substantial portion of the U.S. economy and infrastructure, so it is critical that FERC carry out its statutory duties independently and effectively, and do so in a manner that will help facilitate our new era of energy abundance,” concluded Whitfield.
