Under the Arizona Water Settlements Act of 2004, the State of New Mexico has the legal right to claim the water and take the funds by December 31, 2014. “I applaud the ISC for doing what is best for New Mexico: ignoring special interest groups, and acquiring much-needed water that the state is legally entitled to,” said Pearce. “For almost a decade, there has been a spirited debate over whether or not to proceed with a plan to take this water. Had the State not taken it, we would have lost millions of gallons of water that New Mexicans desperately need.
