Although we often didn’t agree, Justice Breyer was among the last independently-minded liberal justices on the Court, and I have always appreciated his reasoning in Van Orden v. Perry, a case I litigated, where his concurring opinion produced a major victory for religious liberty and was the necessary fifth vote for Texas to prevail. His replacement, now Justice Jackson, certainly has big shoes to fill.
