U.S. Senator Pat Roberts (R-Kan.), a senior member of the Senate Health, Education, Labor and Pensions (HELP) Committee today announced unanimous Senate passage of his bipartisan Ensuring Innovation Act. I'm proud that our bipartisan bill to help lower prescription drug costs has unanimously passed the Senate, said Roberts. We are one step closer to making important generic prescriptions more readily available for folks who need them. This legislation ensures that only true pharmaceutical innovations receive market exclusivity by clarifying the definition of new chemical entity (NCE). The updated definition helps to lower prescription drug costs by clarifying that NCE exclusivity cannot be granted to manufacturers for making minor changes to existing drugs. Roberts introduced this bill alongside Sen. Bill Cassidy (R-La.) and Sen. Tina Smith (D-Minn.) in May 2019.
