Information Courtesy of the Homeland Security Committee This legislation would is an important first step in strengtheningthe vetting system for Syrian and Iraqi refugees being admitted to the U.S. What the Bill Does: Under the American SAFE Act requires comprehensive background checks of every refugee from Iraq or Syria and certification that each does not pose a threat before they can be admitted into the United States. Specifically, under this legislation, no refugee from Iraq or Syria will be admitted into the United States unless: 1) the FBI Director certifies the background investigation of each refugee; and 2) the Secretary of Homeland Security, along with the FBI Director and the Director of National Intelligence (DNI), certifies to Congress that each refugee is not a security threat to the United States. It also creates an additional layer of protection by requiring the DHS Inspector General to independently assess the refugee approvalsmaking sure that high-risk individuals do not slip through the cracks. Current Practice: Currently, the State Department determines presents the cases to the Department of Homeland Securitys Citizenship and Immigration Services (USCIS) for adjudication. USCIS interviews the applicants and performs security vetting, along with other federal agencies. Applicants who pass the interview and vetting process are then matched with organizations that facilitate their resettlement into the U.S. Why this Bill is Necessary: Senior U.S. law enforcement and intelligence officials have expressed concern that we do not have the information needed to confidently vet Syrian refugees to make sure they do not have ties to terrorism. This bill ensures that the FBI, as our top law enforcement agency, validates the background checks conducted by DHS of these refugee applicants. In addition, requiring certification to Congress from DHS, the FBI, and the DNI will ensure that proper oversight of this system is in place. | 1 | 2026-03-30T12:14:52Z | 2026-03-30T12:14:52Z |
