The legislation replaces the flawed No Child Left Behind Act (NCLB) of 2001.The bill passed the House of Representatives by a vote of 359-64. I am very pleased that on the 50th anniversary of the Elementary and Secondary Education Act (ESEA) we have finally succeeded in getting rid of NCLB and have an ESEA that rewards students progress rather than setting arbitrary benchmarks. The Every Student Succeeds Act replaces the adequate yearly progress standard with benchmarks that celebrate individual student and teacher success in moving ahead academically. Moreover, the bill reduces the testing burden and delegates to the states how best to achieve high academic standards, while keeping the U.S. Department of Education as referee so that states cannot game the system and reduce our childrens ability to compete in the global economy. The bill also retains some good provisions from NCLB that require disaggregated data to make sure minority, English-as-a-second-language and special needs students are not left behind and finally allow more district flexibility in applying for waivers when facing difficult economic situations. This is a serious effort to boost student achievement nationally, while allowing states and school systems to design programs they feel best suit their state and its children.
